On November 7th, 2025, at approximately 0100 hours I was dispatched to [600 BLOCK] Burbank Cir SE in reference to a domestic assault in progress. The caller was a neighbor claiming they had heard arguing, claiming it sound like one of the parties was being hit. The caller also claimed the female in said situation had come over earlier to seek help due to threats from the male at the residence.
Once on scene, after knocking on the front door and announcing ourselves as police officers I heard a female voice from behind the door. This voice would later be identified as our victim, [VICTIM #1]. [VICTIM #1] claimed everything was okay and she did not need any help. I requested she step out and she eventually did. [VICTIM #1] remained adamant she was okay and no one else was in the house with her. She was not willing to aid police in our investigation.
[VICTIM #1] would later reveal there was someone in her backyard but was again extremely cautious and hesitant to identify or reveal their location. After announcing for minutes, the male was eventually found in the back yard, this male would later be identified as the offender, Ashley Michalec. Michalec remained cautious and claimed to be unaware of our presence, claiming he didn’t know we were calling for him.
Once out front the parties were separated. I started speaking with Michalec. Immediately after catching a glimpse of him in the light, I noticed multiple fresh scratches on his face around his eyes. When asked about these Michalec claimed he got them walking through branches in the backyard, none of which I could find considering I was 5 inches taller than him.
Michalec maintained nothing physical had happened tonight. He claimed this was simply a verbal argument over relationship issues that had resulted in loud yelling for quite some time. It was at this point apparent considering Michalec’s speech, and odor of alcoholic beverage coming from him he was under the influence. He also informed me he had taken a few shots of vodka prior to our contact. In the short time I spoke with Michalec he was unable to present a coherent story of the night’s events. He maintained it was simply a verbal argument, and at one point his girlfriend grabbed his arm, I was not able to gather more.
I then talked with [VICTIM #1]. [VICTIM #1] was also visibly impaired, she admitted to having a number of mixed drinks before our arrival and seemed to have a distracted demeanor inquiring about my taser and firearm mid-questioning. [VICTIM #1] claimed they had simply been in a heated verbal argument. [VICTIM #1] asked if we would be arresting her boyfriend. [VICTIM #1] pleaded to have us not arrest Michalec, citing it “would only make things harder for me here”.
[VICTIM #1] claimed if we arrested him, she would be the one paying his bail to get him out. I informed [VICTIM #1] a decision hadn’t been made yet and explained what I thought happened based off the injuries present on both parties. [VICTIM #1] then informed me and other officers present she didn’t want him (Michalec) to go to jail but was now worried she would not be able to take care of her dogs if both parties were not home. [VICTIM #1] claimed Michalec had gotten physical with her, even choking her at one point.
At this point myself and other officers moved inside with [VICTIM #1]. [VICTIM #1] walked us through the house to show alleged damage Michalec had caused. [VICTIM #1] claimed he broke her vanity mirror table, which I witnessed shattered with belongings fallen to the floor. [VICTIM #1] also showed her iPhone which she claimed he had also broken during their altercation.
[VICTIM #1] claimed this all started in their bedroom, where a verbal argument over relationship issues started. [VICTIM #1] claims at one point Michalec gets on top of her while she’s laying down and chokes her, with one hand for approximately 30-60 secs. [VICTIM #1] says she feared for her life and began to claw at his face. [VICTIM #1] claims this caused him to stop, this when the harassment started. [VICTIM #1] claims he brought a toaster from the kitchen and told her she should kill herself and that he allegedly hopes she gets raped. [VICTIM #1] had noticeable marks on both the left and right side of her neck consistent with being grabbed and choked.
I asked [VICTIM #1] to go in further detail about the alleged strangulation. I read her a strangulation questionnaire.

- Did the suspect put his hand/object over your nose mouth? No
- (Get the victim to show you where and how strangulation occurred, preferably on video.)
- What did the suspect say while he was strangling you? Something, Can’t recall
- What did the suspect’s face look like while he was strangling you? Couldn’t see it
- Were you shaken simultaneously while being strangled? Describe. Can’t recall.
- How long did the suspect strangle you? 30-60- secs
- How many times were you strangled? Describe each incident and method. Just once
- How much pressure/How much pain? (on a scale of 1 – 10) 5
- Did you black out/lose consciousness? No
- Any difficulty breathing? Any complaint of hoarse or raspy voice after strangulation? No
- Any complaints of pain to throat, coughing, or trouble or swallowing after strangulation? No
- Did you vomit, urinate, or defecate as a result of being strangled? Vag*nal period blood discharge.
- What caused the suspect to stop? Clawing at his eyes, hitting him
- Any prior incidences of strangulation? No
- Note and photograph any visible marks on neck, eyes, behind ears or face
Based off [VICTIM #1]’s story and questions I felt as if I had enough for charges of Aggravated Assault.
I left OFC Wilson inside to read a domestic violence lethality questionnaire with her answers as follows:
- Has he/she ever used a weapon against you or threatened you with a weapon? No
- Has he/she threatened to kill you or your children? No
- Do you think he/she might try to kill you? No
- Does he/she have a gun or can he get one easily? No
- Has he/she ever tried to choke you? Yes
- Is he/she violently or constantly jealous or does he control most of your daily activities? No
- Have you left him/her or separated after living together or being married? Yes
- Is he/she unemployed? No
- Has he/she ever tried to kill himself? No
- Do you have a child that he/she knows is not his? No
- Does he/she follow or spy on you or leave threatening messages? No
[VICTIM #1] was provided with both the state and county domestic violence help line phone numbers as well.
Michalec was placed under arret with handcuffs on wrists, double locked and checked for fit. He was searched and placed in the rear of patrol vehicle with my rear camera recording.
Michalec was transported to the Smyrna City Jail and released for booking procedures.
A warrant for Aggravated Assault Strangulation, O.C.G.A 16-5-21 was applied for and signed by Judge Barry Morgan.
Warrant# 25-W-9466.
Michalec was later picked up from Smyrna Police intake and transported to the Cobb County Adult Detention Center where he was released to jail staff for booking procedures.
