Officer’s Narrative:

On Tuesday, November 11, 2025, at approximately 2034 hours, I was dispatched to a domestic dispute located at [REDACTED BY AGENCY]. The caller stated that his mother was being attacked by a male and that he was possibly armed. The caller also stated he wanted to met officer at the business of Golden Coral located at 2211 Cobb Pkwy SE due to being afraid of being in the area of the suspect. The caller also gave a description of the male, which was black male wearing grey shorts and wearing a grey/white hoodie.

I then arrived at the business of Golden Coral and met with the caller and his mother, who were identified as [REDACTED BY AGENCY] (Juvenile 1) and Ms. [VICTIM #1]. Ms. [VICTIM #1] stated that her and her boyfriend, identified as Mr. Benjamin Wilson, were in a verbal argument due to Ms. [VICTIM #1] moving to another residence. Ms. [VICTIM #1] then stated the verbal argument started getting heated and told Mr. Wilson to leave the residence. Ms. [VICTIM #1] then stated while walking pass Mr. Wilson while he was grabbing his items, Mr. Wilson then grabbed her by the neck using both hands and threw her to the ground. Ms. [VICTIM #1] then stated while she was on the ground he continued to choke her for approximately 10-20 seconds, until her son walked in and observed her getting choked.

Ms. [VICTIM #1] then stated Mr. Wilson, then began acting like he was not choking her and instead was trying to calm her down. Ms. [VICTIM #1] then stated her son, then began calling 911, in which then Mr. Wilson started chasing her son. Ms. [VICTIM #1] then stated at the time she did not know what had happened between Mr. Wilson or son, but both met back up and drove to Golden Coral to meet with officers. I then observed Ms. [VICTIM #1], for any physical marks, scratches, bleeding or bruising, in which I observed presence of Petechia, which is red blood dots, on her right eyeball.

I then spoke with Ms. [VICTIM #1]’s son, in which he stated to me that after seeing her mother being choked, he began calling 911. Juvenile 1 then stated while he was doing so, Mr. Wilson was trying to grab his phone and was trying to prevent him. Juvenile 1 then stated Mr. Wilson then stated to him that “He had something for him”. And heard a metal item. Juvenile 1 then stated that due to him being afraid, he ran out the apartment complex. Juvenile 1 also stated that Mr. Wilson chased after him trying to prevent him from calling 911. Juvenile then stated he lost Mr. Wilson and returned back with his mother.

I then read Ms. [VICTIM #1] Domestic Violence lethality assessment, and her answers are the following:

  1. Has he/she ever used a weapon against you or threatened you with a weapon? NO
  2. Has he/she threatened to kill you or your children? YES
  3. Do you think he/she might try to kill you? YES
  4. Does he/she have a gun or can he/she get one easily? NO
  5. Has he/she ever tried to choke you? NO
  6. Is he/she violently or constantly jealous or does he/she control most of your daily activities? NO
  7. Have you left him/her or separated after living together or being married? NO
  8. Is he/she unemployed? YES
  9. Has he/she ever tried to kill himself/herself? NO
  10. Do you have a child that he/she knows is not his/hers? YES
  11. Does he/she follow or spy on you or leave you threatening messages? NO

Ms. [VICTIM #1] did trigger the assessment and was provided the Domestic Violence Hotline Number.

Ms. [VICTIM #1] was read Strangulation Questionnaire, and her answers are the following:

  1. Did the suspect put his hands/objects on your neck? Yes
  2. If so, describe method. One or two hands? Forearm? Object? Two hands
  3. Did the suspect put his hands/object over your nose mouth? No
  4. What did the suspect say while he was strangling you? Does not know, was trying to breathe
  5. What did the suspect’s face look like while he was strangling you? Doesn’t know
  6. Were you shaken simultaneously while being strangled? Describe. Yes, shaken up and down
  7. How long did the suspect strangle you? 10-20 seconds
  8. How many times were you strangled? Describe each incident and method. Once
  9. How much pressure/How much pain? 10 for both
  10. (On a scale of 1-10) 10
  11. Did you black out/lose consciousness? NO
  12. Any difficulty breathing? Any complaint of hoarse or raspy voice after strangulation? Difficulty breathing, difficulty breathing while being choked
  13. Any complaint of pain to throat, coughing, or trouble or swallowing after strangulation? Yes trouble swallowing
  14. Did you vomit, urinate, or defecate as a result of being strangled? No
  15. What caused the suspect to stop? Son walking in
  16. Any prior incidences of strangulation? No

While I was speaking to both Ms. [VICTIM #1] and her son, Officers located Mr. Wilson leaving the complex, Mr. Wilson was given multiple verbal commands and was not compliant. Mr. Wilson was eventually taken into custody and transported to the Smyrna City Jail and awaited transport to Cobb County Adult Detention Center.

I went before Cobb County Magistrate Court Judge Amanda Perez and secured warrant #25-W-9593 for the following charges for Mr. Wilson:
