On the date above, I, Officer Smith, was dispatched to a [4300 BLOCK] Thorngate Lane in reference to child abuse case. Dispatch stated the complainant, [WITNESS #1], stated she observed a young boy, wearing a black shirt and PJ shorts with bulldozers on them, wandering in the streets. [WITNESS #1] advised dispatch that the boy, later identified as [JUVENILE #1], was unable to tell her where he lived, that he was not really communicating with her, appeared thin, and had a bloody arm.

Upon arrival, I made contact with [WITNESS #1]. [WITNESS #1] advised that she observed [JUVENILE #1] walking in the neighborhood, and stood by with him waiting for his parents to come looking for him. [WITNESS #1] stated after waiting approximately 30 minutes, and [JUVENILE #1]’s parents not coming to look for him, she contacted the police.

I observed [JUVENILE #1]’s arm was bleeding, and he had several injuries to his legs. [JUVENILE #1] appeared malnourished and was nonverbal while speaking with officers.

After speaking with [WITNESS #1], Sgt. Bobo advised that he recognized [JUVENILE #1] because he had previously responded to his residence after a neighbor reported that [JUVENILE #1] had left the house unsupervised. After running an inquiry of local history regarding [JUVENILE #1], it was determined that this had occurred three times, including this incident.

Sgt. Bobo and I responded to [2600 BLOCK] Thorngate Way. After knocking on the front door several times, I made contact with [JUVENILE #1]’s father, Kaleb Anderson. Kaleb appeared heavily intoxicated, his eyes were bloodshot and watery, he was swaying, and he smelled of an alcoholic beverage.

I asked Kaleb if he knew where his son was, and he responded that he must’ve gotten out. I asked Kaleb where he was, and he stated he was asleep in his bedroom. I asked Kaleb if anyone else was inside the residence. Kaleb stated [JUVENILE #1]’s mother, Brittany Anderson, was asleep in their bedroom.

Kaleb then led me to their bedroom to wake up Brittany. Kaleb led me through the garage to his bedroom which was in the garage, and the room was separated by a black sheet.

While in the bedroom, I smelled the odor of urine coming from inside the room. The room was filled with trash, next to the bed and on the floor. I observed [JUVENILE #1]’s bed on the floor in front of Kaleb and Brittany’s bed, and it appeared dirty. I observed dishes that had food still on them, and it appeared the bedroom had not been cleaned for months.

I observed Brittany lying in the bed asleep. Brittany was awoken by Kaleb and appeared confused. I stepped further into the bedroom, announced that I was Kennesaw Police, and advised Brittany to wake up. Brittany laid bed for approximately another minute or two before realizing the police were at her residence.

Once outside, I could smell the odor of an alcoholic beverage coming from Brittany’s person. Brittany had slurred speech, and her eyes were bloodshot and watery. I asked Brittany if she knew where [JUVENILE #1] was. Brittany stated she did not know.

I asked Brittany who was watching [JUVENILE #1], and Kaleb interrupted, stating Brittany was supposed to be watching him. I asked Brittany and Kaleb how many alcoholic beverages they consumed, and Kaleb stated he had two shots. Brittany originally stated she only had a couple of sips of an alcoholic beverage, but then stated she had two shots of Vodka.

Brittany provided a breath sample for the PBT, and it resulted in a .253 BAC. I advised Brittany that she had way more than two shots, and she continued stating she only had two shots of an alcoholic beverage. I looked at Brittany’s pupils and observed they were pinpoint and non-responsive. Although Brittany and Kaleb denied taking any illegal substances, based on my training and experience in DUI enforcement, I believed Brittany was also impaired by an illegal substance.

I asked Kaleb how long he was asleep for, and he stated approximately an hour and a half. Based on Brittany’s PBT results and her stating she had also been asleep for over 30 minutes, it was determined that Brittany had been intoxicated prior to Kaleb going to sleep. I confirmed with Kaleb that he left [JUVENILE #1] in Brittany’s care.

Based on [JUVENILE #1]’s appearance, his being left unsupervised and exiting the residence, his wandering the neighborhood for over 30 minutes, and Brittany and Kaleb not knowing where he was and appearing highly intoxicated, both Brittany and Kaleb were placed under arrest.

Brittany and Kaleb were handcuffed behind their backs, which were checked for fit and double-locked. Both Brittany and Kaleb were searched incident to arrest and seat-belted in the rear area of my patrol vehicle.

Brittany’s mother, [REDACTED], responded and took custody of [JUVENILE #1] without incident.

I transported Brittany and Kaleb to the Cobb County Adult Detention Center, and they were booked into the jail without incident.

I returned to the Kennesaw Police Department and applied for an arrest warrant. Judge Ronna Woodruff signed warrants number 25-W-7361 and 25-W-7632 for Reckless Conduct and Cruelty Children in the 2nd.

A DFCS referral was completed for the incident.
