On 01/08/2026 at approximately 1644 hours, FTO White and I responded to Ebenezer Rd at the intersection of Sandy Plains Rd in reference to a car crash that just occurred.
When I arrived on the scene, I conducted my investigation into the incident. While conducting my investigation, I noticed that one of the drivers, later identified as Ms. Jill Spiva, was under the influence of alcohol.
Later in my investigation, I found a half-empty bottle of Smirnoff vodka that was located in Ms. Jill’s vehicle behind the driver’s seat, near the center console in a white bag.
Ms. Jill refused to participate in Standardized Field Sobriety Tests.
FTO White read Ms. Jill Implied Consent, to which Ms. Jill refused to consent to a blood draw.
I then transported Ms. Jill to Kennestone Hospital for medical evaluation. Ms. Jill refused any medical treatment and was medically cleared.
FTO A. White spoke with Cobb County Judge Karega and petitioned for a search warrant for Ms. Spiva’s blood. The search warrant (Cobb County Search Warrant 26-SW-000032) was granted and executed at Kennestone Hospital without issue, and an inventoried copy of the search warrant was provided to Ms. Spiva and placed in her property at Cobb ADC.
I then transported Ms. Jill to Cobb County Adult Detention Center for processing.
Ms. Jill was charged with the following:
DUI Alcohol/Less Safe OCGA (40-6-391(A)(1), Citation #4136650). Open Container Violation OCGA (40-6-253, Citation #4136651).Failure to Maintain Lane/Improper Lane Change OCGA (40-6-48, Citation #4136652).
