On the above date, at approximately 2040 hours, I, Officer Perkerson, was dispatched to 2665 Cobb Pkwy in reference to a person who was drunk. While enroute, dispatch advised the person drunk was a Hispanic male and was outside aggravating other guests. Dispatch also advised that the male told another guest he had a firearm.
The male matched the description of an individual from case #2511-1413, which took place at approximately 1947 hours. In this case, a caller stated a Hispanic male wearing a black sweatshirt, white shirt and grey pants was drunk and attempting to enter the Mosque located at 6045 Pine Mountain Rd.
Officers searched the area but were unable to find the male. The male also matched the description of an individual from case #2511-1398, which took place at approximately 1714 hours. In this case, a drunk Hispanic male wearing a white shirt, blue jeans and a jacket was following a juvenile around at the Quick Trip located at 2761 Cobb Pkwy while cussing at him in Spanish. Officers attempted to locate the male but were unable to.
Upon arrival at 2665 Cobb Pkwy, I was approached by the property manager, [WITNESS #1]. [WITNESS #1] stated the Hispanic male, later identified as Joaquin Leal, was on the balcony in front of room #[REDACTED] and he was extremely drunk. [WITNESS #1] also stated that another resident approached Joaquin earlier in the evening to ensure he was current on his rent. [WITNESS #1] stated the guest notified her that Joaquin stated he was an MS13 gang member and that he had a firearm.
I observed Joaquin sitting in a plastic chair on the balcony, wearing a white shirt and grey pants, vomiting between his feet. I approached Joaquin and began giving him verbal commands to raise his hands, to which he was slow to respond to. While I spoke with Joaquin, he turned to face me and I observed his eyes were squinted. Additionally, Joaquin began slurring his words, had an empty bottle of an alcoholic beverage beside him, and he smelled of the odor of an alcoholic beverage. I had Joaquin stand up and he was unsteady on his feet.
Based on Joaquin being intoxicated in a public space and his attempt to intimidate other guest, he was placed under arrest. I placed Joaquin in handcuffs, checked them for fit, and ensured they were double locked. I searched Joaquin’s person incident to arrest, yielding negative results for weapons or contraband. I escorted Joaquin to my patrol car, placed him in the rear right compartment, and secured his seatbelt.
I transported Joaquin to the Cobb County Adult Detention Center, where he was turned over jail staff without incident.
I to returned to the Kennesaw Police Department and was granted warrant 25-W-9725 signed by Judge Boone for the charges of Public Drunk (OCGA 16-11-41(a)) and Disorderly Conduct (OCGA 16-11-39(a) (1)).
Joaquin was issued a Criminal Trespass Warning from 2665 Cobb Pkwy.
I searched my rear passenger compartment before and after the transport. No weapons contraband were located.
