On 11/26/2025 at approximately 1545 hours Officer Smith and I were dispatched to a Domestic Dispute involving a gun inside the Walmart North at 3826 Cobb Pkwy.

Upon arrival to the scene officers Campisi and Heflin had already arrived and had gotten directions from witness [WITNESS #1] that the suspect was inside at one of the registers checking out. Officers entered the building at this time and headed toward the suspect at the self-checkout terminal.

Officer Heflin and Campisi grabbed ahold of the suspect, a white male that was later identified as Michael Brian Smart and removed the firearm from his pocket. The gun was cleared, and I secured the weapon while Officer Smith and Heflin escorted Mr. Smart outside. Mr. Smart was searched with cuffs being double locked and placed into officer Heflin’s vehicle as other officers arrived on scene. The firearm was placed into an evidence bag with the extended magazine along with 32 9mm rounds. 27 of those rounds being full metal jacket and five of them being hollow point rounds.

Officers then went to speak with the victim, [VICTIM #1], who had her Juvenile Daughter with her at the time of the incident. [VICTIM #1] stated that her and the Offender, Mr. Smart, had been shopping for groceries inside the Walmart when an argument broke out between them. In the altercation she was heard by witness [WITNESS #1] stating, “don’t touch my baby” and [VICTIM #1] grabbed the back of Mr. Smart’s hair, throwing him into the freezer. Mr. Smart then shoved [VICTIM #1] back and they went through the store yelling and screaming at one another. The juvenile daughter was sitting in the cart throughout this period of time. Mr. Smart was heard to be yelling racial slurs while walking through the store.

The altercation continued up to the self-checkout terminal where [VICTIM #1] grabbed her juvenile daughter and went to exit the store. Mr. Smart followed behind them, continuously yelling and threatening [VICTIM #1]. When [VICTIM #1] kept walking away Mr. Smart took out a Glock 19 with an extended magazine and started waving it in the air and towards the general direction of [VICTIM #1].

At one point another witness, [WITNESS #2], overheard Mr. Smart state, “I will shoot you” to the victim and she yelled “Shoot me then” back. Mr. Smart then left [VICTIM #1] and his Juvenile Daughter in the parking lot, walked back inside the Walmart and put the gun back into his pocket and then proceeded back to the self-checkout terminal where they had left their shopping cart. It was at this time that officers arrived on scene and detained the suspect.

Officer Smith and I went to check with Walmart Employees to see the video evidence that was collected during the incident. There were no cameras in the frozen aisle where the altercation began in the store. Video evidence captured Mr. Smart and [VICTIM #1] arguing as they headed towards the front of the store and then leaving the store from the self-checkout line with their Juvenile Daughter in the victim’s arms. Mr. Smart pulled his firearm out and was waving it in the air frantically as they went outside into the parking lot. This video evidence was put onto a disc and collected as evidence.

[VICTIM #1] told officers that there have been multiple other altercations where Mr. Smart threatened her with his gun. Due to the previous incidents, she noted that she was in fear that Mr. Smart would shoot her today. She was advised of victim resources that she has access to and Mr. Smart was transported to Cobb County Jail by PSL Walper. The Glock, its magazine, and the bullets were placed into evidence along with the surveillance footage.

Mr. Smart was charged with Aggravated Assault, Terroristic Threats, Possession of a Firearm During the Commission of a Felony, Reckless Conduct, and Cruelty to Children 3rd (warrant #25-W-10065).
