[NARRATIVE #1 on January 01, 2026]
On January 1, 2026, at 0158 hours, I, Officer Alas, was dispatched to 3940 Cherokee Street, Unit 201 Mazzy’s, in reference to an intoxicated and disorderly customer. The complainant advised the subject had not paid his tab and that a manager was following him outside. While en route, I was advised the subject had fled the bar and was last seen near the intersection of Jiles Road and Cherokee Street.
Upon arrival, I made contact with Ryan Dubsky at the intersection of Jiles Road and Cherokee Street. I advised Ryan of police presence and asked him what had occurred at Mazzy’s. Ryan stated that nothing had happened and that he was walking home from the bar. While speaking with Ryan, I detected a strong odor of an alcoholic beverage emitting from his person. Ryan was swaying side to side and had glossy eyes. Ryan also attempted to light a cigarette, stomped it out, and then moments later picked the cigarette back up and lit it again.
While officers stood by with Ryan, Officer Angulo went to Mazzy’s and spoke with the manager, [WITNESS #1]. Officer Angulo advised me that Ryan had walked out on his tab and, while doing so, slapped a female’s buttocks. Management advised they wanted Ryan to pay his tab and be criminally trespassed from the business.
I returned to Mazzy’s with Ryan, where he paid his tab in the amount of $26.50 for five Miller Lite beers. While at the business, I spoke with [VICTIM #1], who advised she had been touched by Ryan. [VICTIM #1] stated she was standing and waiting to pay her tab when she felt someone grab and squeeze her buttocks. She stated she initially believed it was her husband, but when she turned around, she observed it was Ryan. [VICTIM #1] stated Ryan said, “Oh yeah,” while doing so. She advised she did not immediately tell her husband because she did not want him to react, but informed him shortly afterward.
I also spoke with a waitress at Mazzy’s, [WITNESS #2], who advised she witnessed the incident. [WITNESS #2] stated she observed [VICTIM #1] standing and waiting to pay her tab when Ryan walked by and smacked the center of [VICTIM #1]’s buttocks.
I asked Ryan what he had touched [VICTIM #1] in any way and he denied ever doing say. Ryan said that never happened.
While speaking with [VICTIM #1], she advised she wished to prosecute.
Ryan was placed under arrest. Both wrists were handcuffed behind his back, double-locked, and checked for proper fit. A search incident to arrest was conducted on Ryan’s person, and no contraband was located. Ryan was placed in the rear passenger compartment of my patrol vehicle until Transport Officers Smith and Calzada arrived on scene.
A criminal trespass form was completed, and copies were issued to both the business and Ryan. Ryan was transported to the Cobb Adult Detention Center by transport officers with all necessary paperwork.
I returned to Kennesaw Police Headquarters, where I applied for and was granted an arrest warrant. The warrant was signed by Magistrate Judge Che Karega, warrant number 25-W-3. Ryan was charged with the following offenses:
Public Drunkenness (O. C. G. A. S 16-11-41)
Sexual Battery (O. C. G. A. § 16-6-22.1)
The departments copy of the trespass form was turned in at the end of shift

[NARRATIVE #2 on January 01, 2026]
On 01/01/2026 at approximately 0242 hours, I, Transport Officer Josh Smith, met with Officer M. Alas at Mazzy’s Sports Bar and Grill at 3490 Cherokee Street, Unit 201 to facilitate the transport of Ryan Dubskу.
Upon arrival, I activated my department-issued body-worn camera and assumed custody of Mr. Dubsky and his personal property. He was handcuffed to the rear, and the restraints were checked for proper fit and double-locked for safety. A search of Mr. Dubsky for weapons and contraband was conducted with negative results.
Mr. Dubsky was then escorted to the transport van and secured in the left rear passenger area. The L3 camera system inside the van was operational and recording. Due to the absence of seat belts in the rear of the transport van, I instructed Mr. Dubsky to hold onto the blue safety strap affixed to the interior wall for the duration of the transport. The rear door was closed and locked.
I transported Mr. Dubsky without incident to the Cobb County Adult Detention Center. Upon arrival, he was released to jail staff along with all required documentation.
A search of the transport van’s passenger compartment was conducted both before and after the transport, and no contraband was located.
