On August 1st 2026 at approximately 0459, I was on duty and working in my official capacity as a Deputy assigned to the patrol division with the Coweta County Sheriff’s Office. I was driving my Coweta County issued marked patrol vehicle, which is clearly identifiable as a law enforcement vehicle as it has visual and audible emergency equipment along with Sheriff markings on three sides.

I was driving on Highway 154 approaching the I-85 bridge when Coweta County 911 advised of a vehicle driving reckless Southbound on I-85 in the area. Coweta County 911 advised that a caller was behind the vehicle it was failing to maintain lane, almost colliding with other motorists, and at one point stopped in the middle of the Interstate. The caller advised a silver Toyota Camry or Corolla displaying Georgia license plate [REDACTED] was approaching exit 51. I entered the entrance ramp to continue southbound past the 51, when the caller advised the vehicle had just got off.

While I was turning around at the next exit to come back, Deputies in the area began searching for the vehicle. Deputy Menet #082, was patrolling on Highway 29 near the Publix when he saw a vehicle speeding through the parking lot. Deputy Menet entered the parking lot to make contact with the vehicle. The vehicle had stopped in the parking lot and the driver was exiting the vehicle. Deputy Menet made contact with a 2018 gray Toyota Camry displaying Georgia license plate [REDACTED], which not only matched the description of the vehicle the caller described but was almost the exact tag given, and the vehicle had damage to the front and sides.

The vehicles front bumper was damaged and partially hanging, the front bumper had long grass stuck in the grill and the driver door at the bottom of the vehicle also had grass hanging. The shoulder of I-85 currently has long grass and it appeared as this grass was from the vehicle not only leaving the roadway, but crossing out of the emergency lane and into the grass shoulder of I-85.

When I arrived on scene I began speaking with the driver, Dominic Clark, and asked where he was coming from. Dominic then began telling me how he was “farting” and needed to go to the bathroom and he was about to go to the bathroom in this parking lot. While listening to Dominic speak he kept burping and every time he burped I could smell a strong odor of an alcoholic beverage. When I looked at Dominic’s eyes, I could see they were blood shot and watery.

I asked Dominic to tell me where he was coming from and he stated from his mothers, which I later learned was in the state of Florida. Dominic told me he lived in Atlanta and was returning from Florida. This is the opposite of what Dominic told Deputy Menet as he stated he was leaving Atlanta and driving to Florida.

However I then asked Dominic how much alcohol he had to drink tonight. Dominic stated none. Dominic then stated the red solo cup was his girlfriends. I asked Dominic where his girl friend was as he is the only occupant with the vehicle. He advised she was at home. This did not match with his story because if he was coming back from Florida with his girlfriend, how could she already be home.

I kept listening to Dominic and he changed his statement again. Dominic then admitted to consuming alcohol and he had one drink. I asked Dominic when and where he had this drink. Dominic advised he did not remember where he was only that he was in Fort Walton and he did not know what drink he had. Dominic advised his girlfriend got him a mixed drink and that he had not had anything else to drink, and that he had the drink over 4 hours ago. This also did not make sense to me, as if that was the truth Dominic would not be displaying such strong signs of impairment and he would not have an open container inside his vehicle.

I suspected that Dominic was knew he was impaired and he was trying to find an explanation for why he smelled like an alcoholic beverage bit he did not want to admit to how much he actually drank and how long it had been. The longer I spoke with Dominic the more he burped and the stronger I could smell the odor of an alcoholic beverage coming from his breath.

I asked Dominic if he would consent to performing Standardized Field Sobriety Tests. Dominic then told me that he would not because he an injury to his leg. I then asked Dominic if he would let me check his eyes and he would not have to walk. Dominic consented to me checking his eyes. Before conducting any tests I made sure all flashing lights on the patrol vehicles were turned off and moved Dominic to the front of a patrol vehicle where it was a flat and level surface.

I then conducted Horizontal Gaze Nystagmus HGN, my observations once I began were as follows:

I placed Dominic in the starting position, placed my finger approximately 12 inches away from his face and checked for equal pupil size and tracking. I then began my evaluation and checked both eyes for lack of smooth pursuit which was observed. I then checked for distinct and sustained Nystagmus at maximum deviation, which was observed in both eyes. I then checked for Onset of Nystagmus prior to 45 degrees which was observed in both eyes.

My last test was vertical gaze Nystagmus to which I also observed in both eyes. I also noted that during these tests Dominic stated to stop messing with him by holding up two fingers, however I only ever used the same single finger. I then asked Dominic if he would consent to blowing in a preliminary breath test (PBT) to which he denied and stated not without his lawyer.

I have been a Deputy for nearly 4 years, I am certified in Standardized Field Sobriety Tests, I have conducted dozens of DUI investigation’s which have determined if drivers were under the influence of alcohol to a less safe limit and were arrested, as well as determining drivers were within a less safe limit and not arrested. Based upon my knowledge, training, and experience, combined with the totality of circumstances. Dominic operated his vehicle on Interstate 85 in Coweta County in a reckless manner so much so, that a motorist felt he was going to cause an accident and called 911. The caller gave a correct and accurate description of the vehicle along with almost the exact tag and described the driving behavior common with someone under the influence of alcohol.

I also can observe Dominic to have blood shot watery eyes, the strong odor of an alcoholic beverage coming from his breath, he has burped constantly while speaking with him. Dominic has also tried to be dishonest with me over his alcohol consumption before then admitting to consuming alcohol but in a way that does not make sense. Dominic has also displayed 6 out 6 signs during HGN, which is indicative of a .1 blood alcohol concentration.

Therefore, I determined that Dominic was a less safe driver and placed him under arrest for driving while under the influence of alcohol less safe. I then secured Dominic’s hands behind his back with double locked handcuffs and asked him how old he was. Dominic advised he was over the age of 21, therefore I read him Georgia Implied Consent Notice for suspects over 21. Dominic refused and I secured him in the rear of my patrol vehicle.

I then conducted a search incident to arrest for intoxicants inside the immediate reach of the driver’s seat. In the passenger seat was the red solo cup I previously observed, as well a second, along with half drank bottle of Liquor in the passenger floor board. I then transported Dominic to the Coweta County jail without incident. While transporting Dominic Deputy Menet stood by with the vehicle, which was turned over to Bucks Towing. While at the jail I turned Dominic over to booking staff along with his property, and three citations.

I charged Dominic with DUI less safe alcohol. Reckless Driving, and open container.
