On 12/27/2025 at approximately 23:38 hours, I Ofc. Baez #553 with the city of Newnan Police Department was dispatched to 19 W Court Sq Alamo Jacks in regards to disorderly conduct.

Upon arrival officers were informed that later identified Mr. Herbert Labaff and Mr. Cole Labaff were using vulgar and profane language within Alamo Jack’s. Both parties were observed by [REDACTED BY AGENCY] who is the manager of Alamo Jacks, shoving and arguing with guest within the establishment.

Upon [REDACTED BY AGENCY] witnessing the incident, he asked both parties to leave and notified off duty ofc Matt Brown who was working security to escort them out the establishment. As both parties exited, Mr. Herbert directed his behavior toward Ofc Brown. Ofc Brown asked both parties to leave the surrounding property of Alamo Jack’s to which at that point, Mr. Herbert balled his fist in a aggressive manner and approached Ofc Brown.

Ofc Brown gave lawful commands to step away and leave, although Mr. Herbert using both hands to shove Ofc Brown back and striked him across the left side of his face using his left hand. At that time, Ofc Brown attempted to detain Mr. Herbert although Mr. Cole stood between Ofc Brown and Mr. Herbert. Mr. Cole shoved Ofc Brown preventing him from approaching Mr. Herbert.

As Ofc Brown attempted to detain both parties, a brief foot pursuit occurred. As responding officers arrived on scene, we were informed that both parties may possibly be within the surrounding area. As officers bolo the area, both parties were located within the alley way of Madison St and West Washington St.

Both parties were later apprehended and placed under arrest. The handcuffs were placed behind their back, were checked for fit and double locked. Both parties were searched incident to arrest, and prior to being placed into the back of the patrol vehicle to which nothing was located.

Both parties were transported to Coweta County jail, where they were searched once more prior to entering the jail, and nothing was located. My patrol vehicle was searched prior to and after transport, to which no items were located. Both parties were turned over to jail staff for booking.
