On 06/18/2026 at approximately 12:21am, I (Ofc M Smith) was in the rear parking lot of 1 Joseph Hannah Blvd, Newnan, GA 30263 (Newnan Police Department) when I observed a vehicle in the cemetery (located at [90 BLOCK] Jefferson St, Newnan) that neighbors the parking lot. It appeared that the vehicle was stuck in the cemetery, backing up and pulling forward, in an attempt to find an exit.

Due to the time and location, I drove to the cemetery where I located a black Chevrolet Avalanche driving back and forth over grave ledgers. I activated my blue and red flashing lights and exited my vehicle. Upon approach to the vehicle, I turned on my department issued flashlight and shined it toward the driver of the vehicle, identified as Hollis Walls, who did not initially acknowledge my flashing lights or my presence, continuing to move his vehicle. At that point, I activated the strobe function of my light and shined it directly at Walls and he stopped his vehicle. I advised Walls to put his vehicle in park and he did so.

While speaking with Walls, I immediately noticed that he had glassy bloodshot eyes and a droopy/drowsy expression on his face. I had Walls exit his vehicle and asked him if he knew where he was at and he advised that he was in Cartersville. I asked Walls where he was trying to go and he initially advised he was going to Carrollton but later advised that he was leaving Carrollton going to Smyrna. I asked Walls if he knew, approximately, what time it was and he advised that it was around 8-9:00am. While speaking with Walls, I noted that he urinated on himself at some point before exiting his vehicle.

Due to Walls overall appearance and his age, I requested EMS to respond to the scene to ensure there were no present health concerns. While waiting for EMS, I had Walls walk to my vehicle and had him sit on the front bar of my vehicle. While walking to my vehicle, I noted that Walls walked very slow with his arms hanging loosely to his side. I asked Walls if he had anything to drink prior to drinking and he advised that he was thirteen years sober. I asked Walls if he took and medication and he advised that the only medication that he takes is for [REDACTED BY AGENCY]. While speaking with Walls at my vehicle, I noted that he had low and slow speech as well as droopy eyelids and relaxed/flaccid muscle tone.

Upon arrival, EMS conducted their evaluation of Walls. [REDACTED BY AGENCY] did not show any other signs of any medical emergency, [REDACTED BY AGENCY].

After ruling out possible medical issues, I asked Walls if he would be willing to perform the Standardized Field Sobriety Tests (SFST) and he advised that he would. Walls also stated that he had [REDACTED BY AGENCY] January, which I took note of and did not conduct the Walk and Turn or One Leg Stand test to prevent any injury.

I started by asking Walls a series of medical questions to ensure he did not have any conditions that would hinder his ability to perform the Horizontal Gaze Nystagmus (HGN) test. After ensuring he could safely perform the test, I had Walls sit up right on the front bar of my vehicle so he could support himself without aggravating or causing any injury to hip. I gave Walls the instructions for the test and ensured that he understood before beginning. Before starting the test, I ensured that Walls had Equal Pupil Size, Equal Tracking, and No Resting Nystagmus.

I then began the test and started by checking for Lack of Smooth Pursuit (present in both eyes), Distinct and Sustained Nystagmus (not present), and Onset of Nystagmus Prior to 45 Degrees (not present). After checking all of the required points of the test, I also checked Walls for Vertical Nystagmus which was not present. At the conclusion of the test, I noted 2 of the 6 possible clues of impairment. I also noted that Walls was having difficulty keeping his head still throughout the test and was reminded to do so multiple times. I noted that Walls had constricted pupils as well.

After concluding SFST, I retrieved my Portable Breath Tester (PBT) from the rear of my patrol vehicle along with a new straw for testing. I set up my PBT and explained how to provide a sample for the PBT and administered the test to Walls. After administering the test, the PBT gave a positive result for the presence of alcohol, showing a Breath Alcohol Content (BrAC) of 0.050 g/210L. After advising Walls of the results, he claimed that he had one shot of tequila at approximately 7:00pm.

After collecting the sample for a preliminary breath test, I retrieved my pupillometer from my vehicle. I took note that I was in a dark and dimly lit area so I would expect pupil size to be approximately 5 to 8.5mm. I advised Walls of my intention to check his pupils and he advised he that I could do so. I placed the gauge next to each eye separately and measured both pupils to be approximately 2mm, leading me to believe that Walls was under the influence of alcohol in combination with a Narcotic Analgesic.

At that point, I advised Walls that he was under arrest for DUI. I read Georgia’s Implied Consent Notice for Suspects Age 21 Or Over and requested a blood sample, which Walls agreed to provide. At that time, EMS was still on scene so I requested they collect as sample. [REDACTED] was able to collect two samples which were bagged, tagged, and later added to evidence for submission to testing.

Walls was then placed in handcuffs that were behind his back and double locked after checking fit. I checked Walls information at that point and found that he also had Limited Driving Permit from a previous DUI charge. Walls was turned over to booking officers with citations for DUI- Combination and Violation of Conditions of Limited Driving Permit.

During my investigation, Ofc R Fowler located three firearms that were sitting in the passenger seat of the vehicle. Ofc Fowler collected a Smith and Wesson M&P Shield, and two Smith and Wesson Body Guards each with a magazine and ammunition. After collecting the firearms, Ofc Fowler met with FTO Vena and OIT Sutton at the Police department where he assisted OIT Sutton with submitting the firearms and blood test kit for training experience. Each firearm was logged into evidence for safe keeping. Walls vehicle was removed from the location by Parker’s Towing.

The rear seat of my patrol vehicle was checked before and after transport an found to be free of and contraband.
