On [08/09/2026] at approximately 00:07 hours I, Ofc Baez #553, with the city of Newnan Police Department was patrolling the area of Bullsboro Dr when I noticed a Maroon Nissan Altima GA/ [REDACTED] failing to maintain their lane.
I initiated a traffic stop on the described vehicle, which came to a stop Bullsboro Drive and Ashley Park Blvd. I approached the vehicle, and made contact with the driver identified as Mr. Jerry Kinsey. I explained to Mr. Kinsey the reason for the traffic stop was due to failing to maintain lane. Upon the initial interaction with Mr. Kinsey, I detected a strong odor of an alcoholic beverage emitting from his breath, slowed speech, and droopy eyes.
I then asked Mr. Kinsey if he had consumed any alcoholic beverages to which he stated yes. Mr. Kinsey state he drank two beer approximately one hour ago. I suspected that his answers were not truthful due to his physical characteristics which I had observed during our interaction. At that time a DUI investigation was conducted. Mr. Kinsey voluntarily participated in standardized field sobriety testing.
During SFSTs the following clues of impairment were observed:
HGN: 6/6 (Lack of smooth pursuit, Distinct & sustained nystagmus at maximum deviation, Onset prior to 45 degrees)
Walk and Turn: 5/8 (Lack of balance during instructions, Starts too soon, Misses heel-to-toe, steps off line, improper turn)
One Leg Stand: 3/4 (Sways while balancing, Put foot down)
Mr. Kinsey had difficulty dividing attention between listening to instructions and performing the tasks as explained and demonstrated. Mr. Kinsey’s behavior and demeanor were consistent with impairment by alcohol, as they demonstrated poor concentration, and an inability to follow clear instructions. Mr. Kinsey agreed to submit to a Preliminary Breath Test (PBT) to which the results indicated a positive presence of alcohol.
Due to the described physical characteristics and clues of impairment which I had observed, Mr. Kinsey was placed under arrest for DUI, and failure to maintain lane. The handcuffs were placed behind his back, double locked and checked for fit. Mr. Kinsey was then searched incident to arrest to which nothing was located on his person.
Prior to placing Mr. Kinsey in the back of my patrol vehicle he was searched again to which nothing was located. Mr. Kinsey was seatbelted into my patrol vehicle, I then advised Mr. Kinsey of the implied consent notice for suspects age twenty one and over for breath to which he replied with a verbal no, implied consent notice for suspects age twenty one and over was read once more for blood to which he replied with a verbal no.
Mr. Kinsey was then transported to Coweta County jail. Mr. Kinsey was searched once more prior to entering the jail to which nothing was located. Mr. Kinsey and his belongings were released to Coweta County jail staff for booking. Mr. Kinsey was provided a DDS 1205 form.
