On 9/13/12025 at 12:36 AM, I, D/S T. Scott responded to 1 Amlajack Blvd in reference to a hit and run that occurred on I-85 S Mile Marker 52. Dispatch notified units that the caller was following behind someone that struck his vehicle. The vehicles continued south and parked at the Race Trac at exit 47.

I made contact with both vehicles and drivers in the parking lot. The victim, [REDACTED BY AGENCY] stated that he was driving southbound near mile marker 52 when his vehicle, blue Ford Focus (MS Tag: [REDACTED]), was struck by the other vehicle, gray Toyota Tundra (GA Tag: [REDACTED]). He stated that the truck did not stop and he followed him here. There was minor damage to the rear left bumper of the Ford Focus.

I then spoke to the driver of the Tundra, Joshua Jensen, and he stated that he was on the way home from the Braves game and was very tired. He stated it was possible that he was in an accident and fell asleep. He was stopping to get an energy drink. While speaking to him I could smell the strong odor of an alcoholic beverage coming from his breath. He also had red blood shot watery eyes and slurred speech. While standing he was swaying and uneasy on his feet. I asked if he had been drinking and he said he had a few drinks an hour ago. There was a few small scratches with blue paint transfer on his front right bumper.

I then asked Mr. Jensen if he would consent to the field sobriety testing, to which he agreed.

Field Sobriety:

Medical rule out: Mr. Jensen does not wear contacts or glasses. He has not had any recent accidents or surgeries and said he could walk in a straight line with no issues.

I started the first part of the Field Sobriety Test by conducting the HGN test. I completed all three tests during this phase including the medical rule-out at the start.

Horizontal Gaze Nystagmus (HGN):
I put Mr. Jensen into the starting position and gave the instructions.

Results:
6/6 positive clues

Lack of smooth pursuit in both eyes, nystagmus at max. deviation in both eyes, and onset of nystagmus prior to 45 degrees.

Walk and Turn Test:
I put Mr. Jensen into the starting position and gave the instructions and demonstration.

Results:
3/8 positive clues

Could not balance during instructions, stepped off line, used arms for balance.

One Leg Stand:
I put Mr. Jensen into the starting position and gave the instructions and demonstration.

Results:
2/4 positive clues

Swayed and dropped foot (once).

This concluded field sobriety testing.

At this point, I made my decision that Mr. Jensen was impaired to the point where he could not safely operate a motor vehicle and that he was going to be arrested for Driving Under the Influence Alcohol.

I asked Mr. Jensen if he would consent to a portable breath test which he agreed and blew a 0.088.

Due to Mr. Jensen being in physical control of a motor vehicle with the odor of an alcoholic beverage on his breath and his person, his bloodshot watery eyes, the unsafe driving, and results of field sobriety tests, I determined that he was DUI-Alcohol.

At this time, I placed Mr. Jensen under arrest and read him the GA Implied Consent to obtain his blood to which he agreed at first.

Nothing was found during a search of the passenger compartment.

Mr. Jensen was charged with:

DUI-Alcohol
Failure to Maintain Lane
Hit and Run

Mr. Jensen was transported to Fire Station 1 for the blood draw and once on scene decided to refuse a blood draw. He was then taken to CCSO jail for processing. A 1205 form was filled for the refusal.

The vehicle was left in the parking lot with [REDACTED].
