On November 16th, 2025, I, DS Poe while on routine patrol I observed a black in color truck (Tag [REDACTED]) with the female passenger, later identified as Mrs. Sabreena Sweat, not wearing her seatbelt. Due Mrs. Sweat not wearing her seatbelt I initiated a traffic stop utilizing my blue lights and sirens and the driver, later identified as Mr. Joshua Sweat, pulled into the McDonald’s off of S Hwy 29.

When I exited my marked patrol vehicle I could smell and strong odor of Marijuana and as I approached the vehicle on the passenger side I was able to confirm that it was coming from inside the above vehicle. I introduced myself and explained the reason for the traffic stop being Mrs. Sweat not wearing her seatbelt. Mr. Sweat advised it was his fault his wife was not in her seatbelt due to their 15 month old baby being in the backseat, in a car seat facing the truck bed. Mrs. Sweat also acknowledged that she did not have her seatbelt on. During my conversation with the couple, they notified me that Mrs. Sweat is also 4 months pregnant.

Due to the strong odor of Marijuana I asked both occupants to step out of the vehicle and stand in front of my marked patrol vehicle. I advised the couple that I asked them to step out of the vehicle due to the odor of Marijuana and requested consent to search both their persons to which they agreed. DS DeSilva searched Mr. Sweat while I searched Mrs. Sweat and neither party had illegal narcotics or paraphenalia on their persons. Prior to me searching the vehicle Mr. Sweat advised that he was smoking Marijuana while driving with his 15 month old baby in the backseat and pregnant wife of four months in the front passenger’s seat. Mr. Sweat advised that he threw the Marijuana out of the car at some point between there residence, [5100 BLOCK] US Highway 27 and this stop location.

I searched the above vehicle and did not locate any illegal narcotics or paraphenalia. At which time I advised Mrs. Sweat she could return to the vehicle with her 15 month old baby. I asked Mr. Sweat where he threw out the Marijuana he was smoking due to myself and two other Deputies being in the area in which Mr. Sweat was driving prior to me conducting my traffic stop. I was able to ascertain that Mr. [SWEAT] threw a “small” amount of Marijuana near the Elementary School at the County line. Further I asked Mr. Sweat how much he smoked and he stated, “0.5 grams.” I did advise that Mr. Sweat that he can get a DUI while driving under the influence of Marijuana to which he advised he understood. Mr. Sweat advised he smoked the 0.5 grams 15 minutes prior to the initiation of the traffic stop.

Due to Mr. Sweat driving while smoking Marijuana on the Highways of this state while having his 15 month old baby in the back seat, his wife who is 4 months pregnant I placed Mr. Sweat under arrest. I advised Mr. Sweat to turn around and place his hands behind his back to which he complied and I placed handcuffs on, checked for fit, and double locked them. All contents in Mr. Sweats pockets were turned over to his wife Mrs. [SWEAT]. Mr. Sweat’s cell phone and wallet were placed into Mr. Sweat’s property at the Coweta County Jail.

Mrs. Sweat is receiving a citation for 40-8-76.1 Safety Belts; Required Usage (citation number E0104957). The above vehicle was turned over to Mrs. [SWEAT], a licensed driver.
