On 07/24/2026 at approximately 11:43pm, I (Ofc M Smith) was in the area of Jefferson St near Clark St, Newnan, GA 30263 conducting speed enforcement when I observed a white Tesla Model Y that was traveling at 42 mph in a posted 25 mph zone. I observed as the vehicle negotiated the right-hand curve on Jefferson St after passing Clark St. While negotiating the curve in the area of the start of the continuous turn lane, the vehicle crossed the double yellow lines into the turn lane and onto the double yellow lines on the opposite side of the lane.
I pulled out behind the vehicle and activated my emergency lights and sirens in the area of Jefferson St near the intersection of Jefferson Pl. The vehicle shifted from the left-hand lane into the right-hand lane and continued on Jefferson St until reaching the intersection of Sutherland Dr where the vehicle made a right turn and brought the vehicle to a stop. I then made contact with the driver, identified as Jurell Jones, and notified her of the reason for the stop.
While speaking with Jones, I noticed that she had glassy eyes and could smell the odor of an alcoholic beverage coming from inside the vehicle. I had Jones exit the vehicle and asked her how much she had to drink before driving and she advised that she had a Seltzer at The Alamo, and later advised that she had a drink with her friends while at Taco Mama. I asked Jones if she would let me check her eyes to make sure she was safe to drive and she advised that she would be willing to do so.
I started by asking Jones a series of medical questions to ensure she did not have any conditions that would hinder her ability to perform the Horizontal Gaze Nystagmus (HGN) test. After ensuring she could safely perform the test, I had Jones get into the starting position for the HGN test. I gave Jones the instructions for the test and ensured that she understood before beginning. Before starting the test, I ensured that Jones had Equal Pupil Size, Equal Tracking, and No Resting Nystagmus.
I then began the test and started by checking for Lack of Smooth Pursuit (present in both eyes), Distinct and Sustained Nystagmus (present in both eyes), and Onset of Nystagmus Prior to 45 Degrees (not present). After checking all of the required points of the test, I also checked Jones for Vertical Nystagmus which was not present. At the conclusion of the test, I noted 4 of the 6 possible clues of impairment. I also noted that Jones was swaying throughout the test.
I asked Jones if she would be willing to complete the Walk and Turn test and she stated that she watches a lot of Tik Tok videos that suggest that you should not participate in the tests. I again asked Jones if she would be willing to complete the tests and she did not agree so I moved on. I then retrieved my Portable Breath Tester from the rear of my vehicle and Jones advised that [REDACTED BY AGENCY] shows her Tik Tok videos that suggest you should not complete the test and refused the test before being asked.
Jones was then placed in handcuffs that were behind her back and double locked after checking fit. I had Jones sit on the front bumper of my patrol vehicle where I read Georgia’s Implied Consent Notice for Suspects Age 21 or Over and requested a breath sample which Jones refused. I, again, read Georgia’s Implied Consent Notice for Suspects Age 21 or Over and requested a blood sample which Jones refused.
Jones was then placed in the rear seat of my patrol vehicle with her safety belt fastened and she was transported to Coweta County Jail. Jones vehicle was turned over to [REDACTED BY AGENCY] by her request. The rear seat of my patrol vehicle was checked before and after transport and found to be free of any contraband.
