On 06/22/2025 at around 0157 while responding to a noise disturbance, I witnessed a vehicle reversing down Calhoun St. The driver, identified as [REDACTED BY AGENCY] informed me that a van that was currently passing me had hit his vehicle and failed to stop. I then asked other responding officers to stop the van while I got [REDACTED BY AGENCY] information. [REDACTED BY AGENCY] stated that the driver of the van had hit his passenger side door and kept driving. He then said he reversed down the road to try to stop him but he still refused to stop.
After collecting [REDACTED BY AGENCY] information, I went to the traffic stop where other officers had the van pulled over. Ofc Mcghee informed me of the odor of alcohol and the driver admitting to having two beers prior to driving. I then made contact with the driver, identified as Lizandro Luna. I was immediately able to smell the odor of alcoholic beverages coming from his breath, him having bloodshot watery eyes and him being unable to balance without falling over. I then moved Mr. Luna to a flatter and more even surface and asked if he was willing to allow me to put him through SFST, which he answered with yes. I then attempted to explain HGN, the Walk and Turn and One Leg Stand to him.

The first Standardized Field Sobriety Test I conducted was Horizontal Gaze Nystagmus. I explained the instructions to Mr. Luna to which he said he understood. I then asked Mr. Luna if he had any recent head trauma to which he replied no. I also asked if he wore contacts or glasses and Mr. Luna stated that he did not. I then made sure Mr. Luna was medically qualified to do the test by making sure of equal pupil size, equal tracking and a lack of resting nystagmus. While conducting the test, I observed jerking in the eyes, him being unable to balance on his own, Mr. Luna being unable to track the tip of my finger without moving his head and Mr. Luna being unable to maintain the position I instructed him to remain in before and during the test by putting his hands together behind his back, not placing his feet together and continuing to move around.
I then attempted to begin the walk and turn but Mr. Luna was unable to follow simple instructions on how to stand and remained in that position with me having to tell him multiple times on what to do. Mr. Luna was not able to maintain balance, was not able to allow me to finish giving instructions and kept starting before me telling him too. Sgt Wilcox then retrieved his Portable Breath Test from his patrol car. He asked Mr. Luna if he was willing to blow into a PBT, in which he answered with yes. He then instructed Mr. Luna on how to blow into the instrument. Mr. Luna proceeded to blow and the results came back as a 0.167. I then placed Mr. Luna under arrest with his hands handcuffed behind his back which were double locked and checked for proper fit. I then conducted a search on his persons before I placed Mr. Luna in the rear of my patrol vehicle for his transportation to Coweta County Jail.
While in the rear of my patrol vehicle, I read Mr. Luna both his Miranda rights and his Implied Consent, where he kept interrupting me stating “I’m not a criminal sir”. After reading him his Implied Consent, he refused breath. I then transported him to the hospital to be cleared for jail. Once at the hospital, I read him his Implied consent again but this time it was for blood but he also refused. Once he was cleared by the hospital, I transported him to Coweta County Jail. Once at the jail and before concluding my investigation, I issued Mr. Luna three citations for DUI, failure to maintain lane and hit and run. I then filled out, read to and attempted to have Mr. Luna sign a DDS form 1205 but he also refused that. I then left the jail and returned to the PD where I placed all 3 citations, his driver license and DDS 1205 form in the dispatch basket. Before placing the 1205 in the basket, I indicated that Mr. Luna refused to sign on the driver signature line.
While I transported Mr. Luna to the hospital, Sgt Wilcox stood by with his vehicle, which ended up getting towed by Charlie’s Towing.
