On 11/02/2025, I, Ofc. K. Dockery was working patrol with the Newnan Police Department when I responded to Walmart, located at 1025 Bullsboro Dr, Newnan, GA, regarding Disorderly Conduct. This incident occurred as Lt. V. McPhie was working part-time at the store. During his shift, he radioed for assistance regarding a subject on the scene who was being disorderly.
Upon arrival, Lt. McPhie had the male (later identified as offender Mario Barber) calmed down and outside of the store. Lt. McPhie insisted that he had probable cause to arrest Mario for his Disorderly Conduct. I placed Mario under arrest with his hands cuffed behind his back, double locked, and checked for proper fit. I then searched Mario incident to arrest and placed him in the rear partition of my patrol vehicle.
I spoke with Lt. McPhie regarding the case, and he generally provided the following. He was alerted by store manager [REDACTED BY AGENCY] that Mario was near the general merchandise self-checkout registers and was being disorderly. Lt. McPhie approached Mario and found him yelling derogatory words very loudly in the store, where a lot of people could hear him. Lt. McPhie attempted to calm Mario down; however, he kept being boisterous in the presence of Lt. McPhie. Lt. McPhie eventually calmed Mario and escorted him out of the store. I transported Mario to the Coweta County Jail. Once at the jail, I read Mario his Miranda Warning and spoke with him regarding this incident. Mario insisted that his actions were freedom of speech and that he was angry about something. Mario was searched again at the jail before being turned over to the staff there.
Mario was booked and charged with Newnan Ordinance 14-61 Disorderly Conduct for his actions detailed above. He was also trespassed from Walmart at the request of This warning was explained to Mario, and he insisted that he understood. [REDACTED BY AGENCY]
