On May 31, 2026, I, D/S Weber, was dispatched to the area of I-85 S 41MM in reference to an accident.
Upon arrival, I observed a silver Honda off the right side of the highway, and the driver was out of the vehicle with Tag #[REDACTED], walking around. The driver, identified as Markevius Berkeley, stated that he fell asleep while driving on the highway. Markevius said that he went off the road and woke up when he felt the vehicle going off the road. I observed Markevius stumbling to walk, slurred speech, bloodshot watery eyes, and the odor of marijuana coming from his person.
I asked Markevius where he was coming from, and he stated that he was heading home from a house party in Atlanta. I asked Markevius when the last time he consumed any alcohol, and he said that he had one beer when he first got to the party. I asked Markevius if he would submit to the Standardized Field Sobriety Test, and he agreed.
I gave Markevius clear instructions for the Horizontal Gaze Nystagmus test. During the test, I observed a lack of smooth pursuit in both eyes during all passes, distinct and sustained nystagmus at maximum deviation in both eyes, and distinct and sustained nystagmus in both eyes prior to 45 degrees.
I gave Markevius clear instructions on the Walk and Turn test. I also demonstrated to Markevius how the test will go use three heel-to-toe steps, a shuffle turn, and three heel-to-toe steps back. I had Markevius start the test and observed him only miss one heel-to-toe step.
I gave Markevius clear instructions for the One Leg Stand test. I observed Markevius stand on his left leg, raising his right leg, and counting to 15, one thousand. While doing so, Markevius was swaying side to side and using his arms for balance.
I asked Markevius if he would blow into a portable breath test, and he complied, which resulted in a .006 reading.
I got consent to search Markevius’s person and his vehicle. While searching Markevius’s vehicle, I located numerous wrappers for THC products and smoked blunts. After finding the items in the vehicle, I asked Markevius when the last time he smoked marijuana was, and he denied smoking.
Markevius was placed under arrest for DUI Combined Less Safe, and No Proof of Insurance. I read Markevius Georgia Implied Consent Notice for drivers over 21 years old, and he agreed to submit to a blood test. Markevius was placed in the rear of the patrol vehicle and transported to Piedmont Newnan Hospital for the blood draw and medical clearance. Once cleared, Markevius was transported to the Coweta County Jail, where he was turned over to the jail staff.
It should be noted that Markevius’s vehicle with Tag #[REDACTED] was picked up by Johnny’s Wrecker Services. The Blood test sample was submitted into evidence.
