On May 13, 2026, at approximately nighttime hours, I was actively patrolling the area of 44 1st Ave., also known as 1st Avenue Park, located in Newnan. While patrolling the park grounds, I observed a red colored sedan bearing Georgia registration [REDACTED] parked inside the lot after park hours. Due to the park being closed to the public at that time, I approached the vehicle in order to investigate the occupants presence on the property.
As I approached the vehicle on foot, I observed two occupants inside the vehicle making rapid and erratic movements. Based on my training and experience, the movements appeared consistent with individuals attempting to conceal items and/or hurriedly adjust clothing. Upon reaching the vehicle, I made contact with the driver, later identified as MONTREVIOUS MOSS, and the passenger, later identified as [REDACTED BY AGENCY]. Both individuals appeared extremely nervous during the encounter and were actively attempting to put their clothing back on while I was speaking with them.
For officer safety and due to the suspicious behavior being displayed by both occupants, I instructed both individuals to exit the vehicle. Moss exited the vehicle appearing extremely nervous. While speaking with me, he repeatedly held his hands in the air, was breathing heavily, and was speaking rapidly and erratically. Due to the totality of the circumstances, including the closed park, the occupants’ movements inside the vehicle, their extreme nervousness, and Moss’s erratic behavior, I continued my investigation.
During the encounter, Officer Poythress arrived on scene to assist. Identification was requested from both occupants and was provided voluntarily. [REDACTED BY AGENCY].
While speaking further with Moss, I asked him if there was anything illegal inside the vehicle. Upon being asked this question, Moss became visibly more nervous and avoided eye contact. Based on my training and experience, I believed there may have been illegal contraband or weapons inside the vehicle due to his physical demeanor, nervousness, and behavior throughout the encounter. I then specifically asked Moss if there were any weapons inside the vehicle. Moss advised that there was a handgun located inside the glove compartment. I then entered the vehicle to secure the firearm for officer safety. Inside the glove compartment, I located one Taurus 9mm handgun bearing [REDACTED BY AGENCY]. The firearm was secured without incident.
Shortly thereafter, Officer Poythress advised me that Moss was only 18 years of age and therefore under the legal age of 21 to possess a handgun under Georgia law. Based on the firearm being in his possession and his age being confirmed through identification records, probable cause existed to place Moss under arrest for O.C.G.A. Possession of a Handgun by a Person Under 21 Years of Age and public indecency.
Moss was then placed into handcuffs behind his back. The handcuffs were double locked and checked for proper fit. Moss was searched incident to arrest with negative results for additional weapons or contraband.
After being taken into custody, Moss was advised of his Miranda rights. Moss stated he did not wish to answer any further questions. No custodial questioning was conducted before Miranda was administered, and no further questions were asked after Moss invoked his right to remain silent.
