On 07/24/2026 at approximately 08:54, I DS deSilva responded to the 42 south mile marker on I-85 in reference to a report of a dispute. A passerby on the interstate had called 911 and advised that there was a man choking a woman on the side of the road by a car.

When I arrived on scene, I found [REDACTED BY AGENCY] at the car, a Kia Sorento with no tag, by herself. [REDACTED BY AGENCY] appeared to be stunned, standing still and slightly swaying. She had tears in her eyes and was sniffling. Her hands were shaking and her legs appeared to be trembling. I asked her if there was someone else with her and she said that there had been, but he was walking down the road. I then drove approximately ¼ of a mile on the side of the interstate and found the male. I ordered him to the ground at gunpoint and told him to put his hands behind his back. I then detained him in handcuffs and put him in the back of my patrol car. At this time, DS Kirby had arrived on scene and was with [REDACTED BY AGENCY]. I relocated to the original location and got back out with [REDACTED BY AGENCY].

I asked [REDACTED BY AGENCY] what had happened and she said that it was an argument over her not stopping to buy Samuel a Red Bull and nothing more. She said that nothing physical happened and she didn’t want to “get anybody in trouble”. While speaking with [REDACTED BY AGENCY] I observed that she had red marks all around her throat and small bruises forming similar to those caused by finger imprints. She also had red marks around her right wrist and a scrape approximately an inch above the marks. I told [REDACTED BY AGENCY] that we had gotten a 911 call about a man choking a woman. She said again that nothing physical had happened. She was still crying, shaking, and would not meet my eye contact.

DS Kirby went to speak with Samuel while I talked to [REDACTED BY AGENCY]. DS Kirby read Samuel his Miranda Warning and agreed to speak with officers. He said that they had been arguing about something stupid but nothing became physical. I then went over to speak with Samuel as well. He reiterated that he was willing to talk to us and answer questions without an attorney. I asked Samuel what had happened. He told me that he and [REDACTED BY AGENCY] had been arguing about getting a Red Bull and she had pulled over to the side of the road. He said they both got out of the car, but said they were no longer arguing when they did so.

I noticed that Samuel had two scratches on the right side of his neck. He told me that he had scratched himself because he was ridden with anxiety. He was sweating profusely throughout the duration of our conversation. He told me that the only physical thing that happened was that he and [REDACTED BY AGENCY] hugged each other “around our waists”.

I went back to talk to [REDACTED BY AGENCY] again. When I did so, DS Kirby and DS McKenzie advised me that [REDACTED BY AGENCY] had told them Samuel had a THC vape in the car, so they were beginning to conduct a probable cause search of the vehicle. While they did so, I began asking [REDACTED BY AGENCY] again what had been happening. [REDACTED BY AGENCY] hands were still shaking. She said that she and Samuel were “breaking up”. She told me that Samuel has been to jail before for abusing her and her daughter, who was not on scene. I asked [REDACTED BY AGENCY] what her relationship was with Samuel. She advised that he was her boyfriend. Samuel is not the father of her child and they do not live together.

I asked her if she loves Samuel and she said yes. I asked her if she loves her daughter and she said yes. I asked her if she would want this situation for her daughter and she said no. She then asked if she could just take Samuel’s belongings out of the car and they could go their separate ways. I asked her if she thought Samuel would find her again and she said no. I then asked her if she wanted Samuel to find her again and she said no and began crying even harder.

I asked [REDACTED BY AGENCY] again what had happened and she told me that she was taking Samuel’s belongings out of the car on the side of the road. She then stopped speaking and continued crying. I asked her if that was when he had grabbed her and she said yes. She expressed that he had grabbed her arm and her throat. At this point. she was making eye contact with me.

While I had been interviewing [REDACTED BY AGENCY] again, DS McKenzie had found a glass bowl pipe of the sort commonly used to smoke marijuana in a side pocket of Samuel’s duffel bag. The bowl had remains of what I suspected to be burnt marijuana still inside.

[REDACTED BY AGENCY] completed an official statement form. I gave her a case card with the relevant case number and explained to her the resources that she had available, specifically the Victim’s Advocates. I then transported Samuel to the county jail, where he was turned over without incident. The jail took custody of Samuel’s remaining belongings in his duffel bag. I completed a victim notification form to be added to Samuel’s file in the jail and submitted a copy of my warrantless affidavit to the Real Time Crime Center.

I entered the pipe into evidence. The burnt substance inside the bowl tested positive for THC on a mobile detect kit. 911 sent me the recordings of the initial emergency call to upload into RMS. I reviewed the recording. The caller had said that an Asian male was choking a white female. Samuel Kim is an Asian male and [REDACTED BY AGENCY] is a white female.
