On 09/25/25 at 2320 hours I, DS Purdon, responded to a fight in progress at 89 Herring Rd (Danthony’s Bar and Grill). E911 advised that a male [REDACTED BY AGENCY] was rendered unconscious from a physical altercation and the other party (Zachary Dunstan) left the scene in a black GMC truck.
Upon arrival, I found [REDACTED BY AGENCY] being escorted into a vehicle from the bar. [WITNESS #1] stated that [REDACTED BY AGENCY] was playing grab a*s with a bunch of people at the bar as it was closing. [WITNESS #1] stated that a verbal argument occurred between [REDACTED BY AGENCY] and Dunstan, which later became physical in nature.
[REDACTED BY AGENCY] was sitting in the passenger seat of his girlfriend’s vehicle [REDACTED] when I spoke to him. [REDACTED BY AGENCY] was holding the backside of his head, however I could not see any visible injuries at the time. [REDACTED BY AGENCY] stated that nothing happened and that he was fine. [REDACTED BY AGENCY] refused to provide his ID and refused treatment from medical personnel.
[WITNESS #1] stated that Dunstan grabbed [REDACTED BY AGENCY] by the neck and then threw him toward the ground. [WITNESS #1] stated that Dunstan then grabbed a chair and then struck [REDACTED BY AGENCY] while on the ground. [WITNESS #1] stated that [REDACTED BY AGENCY] lost consciousness and then E911 was called. [WITNESS #1] stated that Dunstan left the scene of the incident in a black extended cab GMC truck. [WITNESS #1] stated that Dunstan was tall, slender, and wearing a green shirt.
[WITNESS #2] stated that she saw [REDACTED BY AGENCY], and a man in green (Dunstan) yelling at each other in the bar. [WITNESS #2] stated that those three males started pushing each other and then [REDACTED BY AGENCY] fell, hitting his head on a foot stool under the bar. [WITNESS #2] stated that Dunstan kept yelling at other males and wanting to fight. [WITNESS #2] stated that Dunstan left the scene when E911 was called.
[WITNESS #3] stated that she was at the bar finishing her drink when Dunstan tried to hit [REDACTED]. [WITNESS #3] stated that somebody else put [REDACTED] in a chokehold and then Dunstan swung at [REDACTED BY AGENCY]. [WITNESS #3] stated that [REDACTED BY AGENCY] hit the ground and the foot rest on the bar. [WITNESS #3] stated that everything went silent and [REDACTED BY AGENCY] was unresponsive. [WITNESS #3] stated that she checked [REDACTED BY AGENCY] pulse and started rubbing his chest to wake him up. [WITNESS #3] stated that everybody at the bar started yelling at each other. [WITNESS #3] stated that [REDACTED] helped [REDACTED BY AGENCY] out to the car.
[WITNESS #4] stated that a tall guy in a green shirt (Dunstan) wanted to fight everyone and went after them. [WITNESS #4] stated that Dunstan threw people to the ground and [REDACTED BY AGENCY] got hurt. [WITNESS #4] stated that they called for an ambulance. [WITNESS #4] was working at the bar and closing out tabs during the incident.
Multiple witnesses ([WITNESS #2], [WITNESS #3], [WITNESS #4], [WITNESS #1]) at the bar filled out witness statements and identified Zachary Dunstan as the aggressor for the fight that broke out at the establishment. Dunstan was seen pushing and physically attacking [REDACTED BY AGENCY] and other patrons on scene. Dunstan was identified as the direct cause of [REDACTED BY AGENCY] falling to the ground and rendering [REDACTED BY AGENCY] unconscious. The witnesses claimed to have little to no alcohol in their system during the incident.
Newnan Police Department found Dunstan’s vehicle (black 2007 GMC Sierra, VIN [REDACTED], IL tag [REDACTED]) near 947 Bullsboro Dr (Arby’s parking lot). NPD Officers advised that Dunstan was wearing a green shirt and had the odor of alcohol on his person. I relocated to NPD’s traffic stop and Officer McKenzie advised me that he stopped the vehicle for failure to maintain lane traveling eastbound in the #1 lane on Bullsboro Dr and I85 S On Ramp. Officer McKenzie stated that he observed Dunstan’s vehicle traveling in the middle of two lanes, which prompted his traffic stop.
I could smell the odor of alcohol coming from Dunstan’s person as I spoke with him. Dunstan stated that he was coming from Danthony’s bar and grille and he did consume 5 beers in the past 5 hours. Dunstan stated that he left Danthony’s because people were getting into it. Dunstan stated that he did know [REDACTED BY AGENCY] and that a bunch of them work together at the rodeo. Dunstan stated that he was willing to perform standard field sobriety testing.
During the horizontal gaze nystagmus exercise, I observed 6/6 clues from Dunstan. Dunstan displayed a lack of smooth pursuit, horizontal gaze nystagmus at maximum deviation, and nystagmus prior onset to 45 degrees in both eyes. Dunstan stated that he did not have resting nystagmus, not in a car accident recently, no medical conditions that I needed to be aware of, and he did wear contacts. Dunstan stated that he was not currently wearing his contacts.
During the walk and turn exercise, I observed 6/8 clues from Dunstan. Dunstan was not able to maintain the start position, missed heel to toe, stepped off line, used his arms for balance, started too soon, and stopped walking. Dunstan stated that he did just buy a new pair of boots and that might affect his performance. Dunstan stopped in the middle of the test to ask questions about the turn and steps.
During the one leg stand exercise, I observed 4/4 clues from Dunstan. Dunstan swayed, hopped on one foot, used his arms for balance, and put his foot down too early. Dunstan also failed to keep his raised foot in the correct position during the exercise. Dunstan stated that he did have some trouble with his feet and knees.
Dunstan refused to provide a PBT breathalyzer sample. I placed Dunstan under arrest for disorderly conduct and driving under the influence of alcohol. I handcuffed Dunstan to the rear, double locked, and checked for fit. Dunstan refused Implied Consent breath but agreed to Implied Consent blood. Caswell’s towing secured Dunstan’s vehicle. I noted miscellaneous clothes, hard hats, tools, trash inside of Dunstan’s vehicle during the inventory. There were alot of loose bills in the center console. I transported Dunstan to Fire Station 1 for a blood draw (483 Turkey Creek Rd) and retrieved a blood kit from SGT Doss at Academy Sports (1096 Bullsboro Dr).
The fire fighter on scene had a difficult time retrieving blood from Dunstan because he kept moving around and refused to be cooperative. The fire fighter was only able to retrieve enough blood for one vial from Dunstan. The fire fighter informed me that GSP would allow them to transfer blood from the full vial into the empty vial in similar situations. I agreed to have the fire fighter transfer Dunstan’s blood from vial to vial.
The fire fighter accidentally broke the tape seal on one of the blood vials. I was not able to seal the evidence bag with the adhesive alone. I sealed the blood kit from the outside and initialed the seals. I transported Dunstan to 560 Greison Trail (CCSO) and released him to the jail’s custody. I submitted the blood kit into evidence.
