Officer’s Narrative:

I, Cpl. M. Hunt, responded in normal patrol mode to [1400 BLOCK] Stuart Ave in reference to a disorderly conduct in progress.
Prior to my arrival, Dispatch advised that the caller, [VICTIM #1], stated that there was a white male attempting to break into her house. [VICTIM #1] stated that the male had ended up laying on her front porch.
Upon my arrival, I observed a white male, Benjamin Luck, laying on the porch in front of the front door. I could observe that the screen door was displaced off of the frame and a welcome sign was damaged in the yard. It appeared that Luck was asleep, and I immediately placed him in handcuffs. [VICTIM #1] and her husband, [VICTIM #2], came outside and stated that they did not know who Luck was.
The [VICTIM #1] stated that they heard banging outside their house which caused them to believe someone was attempting to come in the residence and harm them. [VICTIM #2] stated that he had gotten his firearm ready in case the male entered the residence. [VICTIM #1] stated that the damage to the door is approx. $200. [VICTIM #1] provided security camera footage for the incident. On the video I could observe Luck ramming his shoulder into the front door at the screen porch.
I attempted to speak with Luck but he would not answer to directly asked questions. Luck was stating let me go, and what are you doing. Luck had the odor of alcohol coming from his breath. Luck stated that he knows where he is at and he mentioned that it is a female’s fault but did not elaborate. Luck also stated “watch what I am going to do, I am not scared of you”.
Once Ptl. Steel arrived on scene we carried Luck into the yard away from the door and put him on his stomach to apply leg irons on and changed the handcuffs from the front to the back. Ptl. Steel then searched Luck incident to arrest and placed him in the back of my patrol vehicle (18-221) securing him with a seat belt.
While speaking with [VICTIM #1], I could hear Luck pulling on the door handles and kicking at the door. I then began to transport Luck to the Dougherty County Jail. While enroute to the Jail, Luck became irate and began kicking and banging his head on the door. Luck stated several times while kicking the partition “I will kill you, I will choke you out” Luck continued kicking the partition, the door, window, and seat. While on Liberty Exp. I turned to look at Luck and could observe his feet in the air and that his seatbelt was no longer on.
Upon my arrival, to the jail I secured my weapon in the rear of the truck. Upon opening the door I could observe that Luck had a laceration on his forehead that was bleeding profusely. I could observe that the partition, seats, and both doors had blood over it. Instead of taking him inside the sally port I notified Sgt. Laethem and transported Luck to Phoebe ER.
While enroute to the ER, Luck continue to state that I was going to die. Upon my arrival at Phoebe, the security guards assisted me in escorting Luck inside to the charge station. Luck was still screaming and the staff escorted us to trauma room two. Inside the room, we secured Luck to the bed. Luck was still screaming that he is going to kill “you” while there were several people in the room. I then went to notify Lt. Diaz over the incident and Ptl. Rathel notified me that Luck had told the Doctor [VICTIM #3] that he would kill him and his wife.
When I spoke with [VICTIM #3], he stated to me that Luck did threaten to kill him and his wife. After receiving staples for the laceration Luck was still yelling and attempting to get out of the restraint. At another point, Luck started to threaten Ptl. Steel by stating I will kill you to him several times. The staff then sedated Luck and were able to treat him. I then transported Luck back to the Dougherty County Jail.
I had Ptl. Harris make contact at Luck’s residence, where she made contact with [REDACTED]. Ptl. Harris advised that Luck had walked away from the residence and was depressed.
Upon my arrival to the Jail, I secured my weapon in the trunk and escorted Luck inside. Luck was then released to the intake officer’s custody. Pictures of the vehicle were turned into evidence locker 02. The vehicle was also parked at the LEC and requested to be decontaminated due to the large amount of blood in the rear compartment.
Warrants for Disorderly Conduct (26-001292-01APD), Criminal trespass (26-001292-02APD), Terroristic Threats and Acts F (26-001292-03APD, 26-001292-04APD, 26-001292-05APD), and Interference with Government Property (26-001292-06APD) was signed the following day.
This case is cleared by arrest.
