Officer’s Narrative:

I, Ptl. Bailey was working part-time at 2347 Dawson Rd. (Harvest Moon) when a Disorderly Conduct occurred.
While working part-time, I was inside of my patrol car in the parking lot at the time and I observed the security of Harvest Moon run into the building. I began heading into the establishment at which point I was met with multiple people flagging me to come inside to assist. Upon getting inside, I observed two males acting irate and I observed security advising the two males to leave. I was able to make contact with one male, who was later identified as Darius Moore. Darius was asked by security to leave, but kept refusing to leave. I advised Darius he needed to leave but he continued to be argumentative and failing to comply with the orders of myself and security to leave.
I began escorting Darius out of the establishment, at which point Darius continued to try to force his way without listening to leave the establishment. While escorting Darius out of the establishment to place him into custody, Darius and I fell down on the ground. I advised Darius to place his hands behind his back but he wouldn’t listen to my verbal commands. I had to eventually turn Darius around and place his hands behind his back with the help of one of the security officers on scene. At that moment I noticed that I left my body camera in the car and asked the manager, [WITNESS #1], to get my body camera out of my patrol car. [WITNESS #1] was able to retrieve my department issued body camera.
I began trying to assist Darius up from being on the ground but Darius pushed his entire body weight down. I asked Darius to stand up, to which he kept refusing and stated “my legs don’t work”. I had security assist me with getting Darius on to his feet, at which point Ptl. Q. Davis arrived on scene and assisted me in walking Darius to my patrol car (18-184). I placed Darius in the rear seat of my patrol car.
I walked back to the establishment to make contact with others involved in the incident. I was stopped by multiple people stating that Darius and two other males were fighting. [WITNESS #2] (security) advised that Darius and his brother were fighting with another male but advised me (Ptl. Bailey) to review the video surveillance to make sure. I made contact with, who [WITNESS #2] identified as Darius’ brother and placed him into double locked handcuffs. I walked him to Ptl. Jackson’s patrol car and placed him in the rear seat of Ptl. Jackson’s patrol car. I asked the male for his name, to which he stated he wasn’t going to provide it. I observed his license sticking out of his pocket and I attempted to get it but the male stopped me. I asked the male for his information to which he stated he wasn’t going to identify himself.
I made contact with [WITNESS #1], who pulled up the video surveillance of the incident. I observed a white male being punched by Darius and another male (Darius’ brother). I asked surrounding employees to see if they could locate the white male victim, to which they did. The white male made contact with me and identified himself as [VICTIM #1]. [VICTIM #1] was intoxicated and had slurred speech but was able to give me little information about the incident. [VICTIM #1] stated Darius began talking to his girlfriend, Caroline Speir. [VICTIM #1] stated Darius was being very inappropriate with Caroline. [VICTIM #1] stated he advised Darius that Caroline was his girlfriend. [VICTIM #1] stated Darius eventually began swinging on him causing his ear to be ringing. [VICTIM #1] kept reiterating that Darius was “hitting” on Caroline which is why the incident occurred.
In the video, I observed [VICTIM #1] shielding Caroline and eventually observed a male (later identified as Haryl Dubney) and Darius begin punching [VICTIM #1] in the face multiple times. I observed multiple people begin to separate Darius and Haryl from the altercation with [VICTIM #1].
I walked outside the establishment to make contact with Caroline, at which point, I observed Cpl. Renaue, placing Caroline into double locked handcuffs. I advised Cpl. Renaue that Caroline was an involved other in my incident. Cpl. Renaue advised he was told she was involved in the incident. Cpl. Renaue advised when attempting to get Caroline identified she refused and that Caroline also had an open container of an alcoholic beverage. I asked Caroline for her name at which point, Caroline stated “I will give you my information but not that fat bi*ch”. Caroline provided her information necessary for this report. Cpl. Renaue advised due to her providing false names and not complying with his orders about the open container of an alcoholic beverage that she would be charged with those offenses. Cpl. Renaue later transported Caroline to the Dougherty County Jail, where she was released to the jail intake staff without further incident.
I walked back to Ptl. Jackson’s patrol car, and made contact with the male in the rear seat of her patrol car. I asked the male for his name again, at which point the male eventually gave me his name (Haryl Dubney). I read Haryl his Miranda Rights, to which Haryl kept cutting me off from reading it. Haryl stated he understood but refused to talk because he didn’t know why he was in handcuffs. I explained to Haryl he was detained and I needed to hear his side of the altercation, I would have to read his Miranda Rights and if he agreed to talk to me, then I can ask questions. Haryl advised me to do my job and that he wasn’t going to talk to me under Miranda Rights. I searched Haryl for contraband and was met with negative results.
While talking to Haryl, I heard banging in the rear of my patrol car as if Darius was kicking my patrol car’s door. I walked over to my patrol car and advised Darius he needed to stop kicking because if any damage is done to the patrol car, he could possibly be charged with a felony for damaging government property. Darius began yelling and stating he wasn’t going to damage anything. I advised Darius he needed to calm down and that I wanted to read his Miranda RIghts. I began reading Darius his Miranda Rights, at which point Darius kept stopping me from finishing the Miranda Rights warning. Darius stated he knew his rights, I advised Darius, I would have to read it to him to be able to talk, but Darius kept interrupting me. When I asked Darius if he understood, he said he did but refused to talk to me (Ptl. Bailey) about the incident. I searched DArius for contraband and was met with negative results.
I began working on Caroline’s misdemeanor (City) citations, at which point Sgt. Diaz advised that Cpl. Renaue would be transporting Caroline. I advised Ptl. Jackson, since Haryl and Darius are brothers they could both ride together in my patrol car. Haryl advised he wasn’t exiting Ptl. Jackson’s patrol car. I went over to Ptl. Jackson’s patrol car, and began advising Haryl to exit, at which point Darius began kicking my patrol car’s rear door. I removed Darius out of my patrol car and placed him on the grass of the parking lot area. I got my leg irons to be placed on Darius. Leg irons were placed on Darius and double locked. Darius was placed in the rear seat of the patrol with assistance of other officers on scene. This was due to Darius dropping his body weight and advising he wasn’t going to move and kept pressing his body and feet against the door to prevent the patrol car from being closed.
Ptl. Jackson transported Haryl to Dougherty County Jail, where he was released to the jail intake staff without further incident. I began transporting Darius to Dougherty County Jail. Darius began stating “yea you speeding, I am going to tell and sue you because I don’t have a safety belt on and going to tell that my head got banged up on the door”. Darius wasn’t safety belted in due to his behavior to prevent myself from being hurt while placing his safety belt on. Once at the jail, I asked Darius to step out of the vehicle, to which he refused. Darius stated “I can’t walk”. I asked Ptl. Jackson for her assistance in getting Darius into the jail. Prior to assisting me, Ptl. Jackson advised Haryl uttered on the way to jail (which was recorded on her body worn camera) that he (Harryl) and Darius punched [VICTIM #1] first.
I placed my service weapon in the rear of my patrol car. Ptl. Jackson and I had to physically lift Darius into the sally port. Once inside of the Sally Port, Darius advised when the intake staff asked if he was hurt or injured that he was hurt from me (Ptl. Bailey) transporting him to jail. Darius advised that his eye was hurting from the fight at the club. Darius stated he couldn’t move or walk because I (Ptl. Bailey) made him hit his head and other body part inside of the patrol car while transporting. The intake staff contacted the nurse to take a look at Darius. Darius stated “I am going all the way with this, since you want to arrest me”. Nurse [REDACTED] came and took a look at Darius to see if he was safe to come into the jail. Darius began cursing and the jail intake staff and Nurse [REDACTED]. Nurse [REDACTED] eventually took Darius’ blood pressure and stated his pulse rate was too high to come into the jail and that he would need to be transported to Phoebe Main for further evaluation. Sgt. Wiley (Dougherty County Jail’s supervisor on shift) provided a refusal letter for Darius from the jail.
I transported Darius to Phoebe Main. Once on scene, Darius began being irate with the hospital staff. Darius eventually calmed down while inside of one of the rooms. Once at Phoebe Main for an extended period, Darius advised he no longer wanted to be treated. Darius made contact with one of the hospital staff members and advised he was ready to leave the hospital. Darius signed a refusal to be treated. I placed Darius back in the rear seat of my patrol car. I transported Darius to the Dougherty County Jail. Upon arrival, I placed my service weapon in the trunk of my patrol car. I walked Darius into the jail. Darius was released to the jail intake staff without further incident. I check the rear seat of my patrol car for contraband and was met with negative results.
Darius was booked on Interference with City Officer Prohibited (citation # BB001765), Disorderly Conduct (citation #BB001765). Haryl was booked on Disorderly Conduct (citation # BB001764). Caroline was booked on Interference with City Officer Prohibited (citation #BB001766) and Open Container of an Alcoholic Beverage (citation #BB001767).
Prior to completing this report, on March 08, 2025, I made contact with [WITNESS #1] at 2347 Dawson Rd. (Harvest Moon) to check the video surveillance. In the video, I observed Caroline constantly lighting a lighter. I eventually observed Caroline and Darius having contact with each other. I eventually observed [VICTIM #1] noticing that Caroline and Darius were having too much close contact with each other. At one point Caroline lit her lighter close to Darius’ hair. Eventually I observed [VICTIM #1] put his body in between Caroline and Darius. I observed a female who was sitting at the bar where everyone else was, made contact with Haryl and pointed at Darius and [VICTIM #1]. Haryl came over to [VICTIM #1], Darius and Caroline and began talking.
I eventually observed Haryl push [VICTIM #1] and began punching [VICTIM #1] multiple times. I observed Darius start punching [VICTIM #1] as well multiple times. I observed eventually [VICTIM #1] start trying to punch back at Darius and Haryl, but they were all separated. I observed one of the workers separating the fight and he was at work on March 08, 2025 also. After watching the video, I made contact with the worker, who identified himself as [WITNESS #3]. I asked [WITNESS #3] what he observed at the incident on March 07, 2025. [WITNESS #3] advised he observed Darius and [VICTIM #1] arguing. [WITNESS #3] stated all of a sudden he noticed everyone throwing punches. [WITNESS #3] stated he does remember seeing Haryl throwing multiple punches because he grabbed Haryl to separate him from the altercation. [WITNESS #3] stated the incident happened so quickly he was unsure who started the fight.
I will complete a service request to capture the video of the incident to be placed into evidence.
This case is cleared by arrest.
