On 12/02/2025, I, Ptl. Harris, responded in normal patrol mode to [500 BLOCK] Pine Ave Apt [REDACTED] in reference to a contact person.
Dispatch received a call on the emergency line at [500 BLOCK] Pine Ave Apt [REDACTED] from a male named David Moises on 12/01/2025 at approx. 2312 hours. Moises called and stated his neighbor was speaking on her cellphone. I attempted to make contact at the door, but was met with negative contact.
At approx. 2242 hours, Moises called again and said that his neighbor was still talking on her phone. Ptl. Barrett responded to the area and was unable to make contact with Moises. Moises then called again at 0030 hours on 12/02/2025 about his neighbor speaking on her cellphone. Moises has continued to call the 911 emergency line for non emergencies.
I looked back at the call history for this location and found that Moises has constantly called the police on his neighbor. Moises called on 11/22/2025, 11/24/2025, and today in reference to her speaking on her cellphone.
I made contact with Moises and asked him what was going on. Moises stated he was calling on his neighbor because she was speaking on the phone. I asked Moises if he would qualify speaking on the phone while inside of your own apartment qualifies as an emergency and he said no, but “she’s not supposed to be on the phone after 10”.
I asked Moises if he spoke to his property manager about this incident and he said that she was supposed to be receiving a sanction for it. I asked Moises why would he continue to call if he already spoke with the property manager and he said that “she kept talking on the phone”. Moises stated he has been calling on his neighbor for weeks for the same reason.
Moises was placed in double-locked handcuffs to the rear and searched incident to arrest. The search yielded negative results for any weapons or illegal contraband. Moises was placed in the rear of my patrol vehicle, car 18-198. Moises was placed in a safety belt. A GCIC/NCIC check was completed and he was negative for any wants/warrants.
Moises was not complaining of any injuries at this time. An arrest booking card was completed. Moises was then transported to the Dougherty County Jail. Upon arrival at the jail, my weapon was placed in the trunk of my patrol vehicle. Moises was escorted into the jail and released to the jail staff without incident.
Moises was given citation BB002320 for Unlawful Use of 911 Emergency Telephone Calls. A search of the rear of my patrol vehicle was conducted before and after the transport and it was negative for any weapons or illegal contraband.
This case has been cleared by arrest.
