I, Cpl. M. Hunt, responded in normal patrol mode to 2610 Dawson Rd (Club 809) in reference to a hit and run.

Prior to my arrival, the call notes stated that a grey in color Toyota Camry (Ga Tag [REDACTED]) had struck the rear of the vehicle and was trying to leave.

Upon my arrival, I observed the Grey Toyota Camry with the driver side door open with rear end paint transfer and a white in color Hyundai Elantra (Ga tag [REDACTED]) with severe rear end damage across from each other. I made contact with the caller, [VICTIM #1] who was standing with a group of people near her car. [VICTIM #1] stated to me that I was no longer needed. [VICTIM #1] stated that no one needed to get into trouble and they had swapped insurances.

I asked who the other driver of the Toyota was so I could confirm that they no longer needed police. [VICTIM #1] pointed to the group and no one responded. I then asked if the vehicle was abandoned and no one responded. I returned to my vehicle and observed a black male start walking away from the group towards the end of the parking lot where no cars filled in the rest of the spots. I then asked [VICTIM #1] again who was the driver of the other vehicle and she pointed to the male who walked away (Javarious McDaniel).

I made contact with McDaniel and he stated that he was the driver of the Toyota. I could smell the odor of alcohol coming from his breath and I could smell the odor of marijuana as he stepped within an arm’s reach of me. I could also observe that McDaniel eyes were blood shot red and dilated. McDaniel stated that he had had two or three shots of alcohol and smoked weed an hour prior to driving the vehicle.

Due to him being evasive previously I began to detain him. McDaniel then pulled against my arm into his pocket refusing verbal commands to stop. I then grabbed his hand and he pulled out a money clip that contained several bills. McDaniel then gave the money to a black female who later identified herself as [REDACTED] (his sister). McDaniel stated that he wanted [REDACTED] to keep his money.

McDaniel was then searched and then secured into the rear of my patrol vehicle. McDaniel was read his Miranda Warnings and he stated that he understood and wanted to speak with me. McDaniel stated that he had arrived at the club to pick up [REDACTED]. McDaniel stated that he pulled into the parking spot and began to back out. McDaniel stated that he did not see [VICTIM #1] backing out at the same time and their vehicle’s collided together. McDaniel stated that he had drank two or three shots Don Julio and smoked weed approx.. a hour prior. McDaniel was read implied consent and he agreed to take a chemical breath test of his BAC.

I made contact with [VICTIM #1] and she stated that she observed McDaniel pull into the parking spot. [VICTIM #1] stated that she began to back out and then noticed McDaniel baking out as well. [VICTIM #1] stated that she did not want anyone to get in trouble.

I searched McDaniel’s vehicle for a source of intoxicant. In the passenger side floorboard I located a half full bottle of Alta Azul Tequila (%40 alcohol). This was collected and later poured out and thrown away after pictures were taken. The vehicle was turned over to the vehicle’s owner [REDACTED]. A GCIC/NCIC check on McDaniel showed that he had a suspended license from child support obligations on 03/02/2026 without a serve date.

I then transported McDaniel to the Dougherty County Jail. At the Jail Deputy L. James performed the chemical test of McDaniel’s breath with a Intoxilizer 9000 (SN 90-001798). The test resulted in McDaniel’s Blood Alcohol Content being .136. McDaniel’s was then released to the intake staff.

McDaniel was cited with DUI- Per Se (G0064611), a DDS 1205 form and a DDS 1150 form was completed.

This case is cleared by arrest.
