I, Ptl Hatcher, responded in normal mode to 2822 Nottingham Way (Buffalo Wild Wings) in reference to a disorderly conduct. Dispatch stated the caller advised that a male dressed in gold with brown boots was refusing to pay for his $200 tab and was trying to fight the manager.

I arrived on scene and began to walk into the establishment. As I was approaching the front door a female exited a silver vehicle wearing a green sweat shirt and black tights and walked to the front door saying “they got me fu*ked up, I don’t give a fu*k”. The female then entered the establishment and stood next to the male dressed in gold (suspect). This female was later identified as Berniya Albritton. I entered into the establishment and then could hear the male later identified as Lucious Albritton saying “lets ride”. Berniya was saying to Lucious “they gone get your a*s”. Lucious tried to walk past me as I advised him to stop because he was he was not free to leave. Lucious was very intoxicated. Lucious was slurring his speech, had red watery eyes, and was swaying from side to side as if he could not keep his balance.

Manager [VICTIM #1] and [VICTIM #2] approached me. [VICTIM #2] stated that Lucious has been being very obnoxious and was refusing to pay his tab. As [VICTIM #2] was trying to speak, Berniya cut her off and stated “he (Lucious) could not pay the bill because his cards are declining, but he has money on his Capitol 1 card”. I advised Berniya Lucious could not leave the establishment until he paid his tab. Berniya stated “I don’t give a fu*k I aint trying to hear sh*t y’all be saying”. [VICTIM #1] (manager) spoke up and stated we can do cash. I then asked Lucious if he had cash he could pay the tab with. Lucious replied by saying “what we doing, what we doing”. Cpl Covington who was on scene asked if the staff could try the cards again. Lucious stated “I aint got time for all this, y’all can get out of my way is what y’all can do”. Berniya then told Lucious to be quiet and Lucious replied with “I aint studding these folks (police) man”.

I asked again if there was anyone who could pay the bill for them. Lucious ignored the question and began to walk forward. I reached my arm out so Lucious could not get close to my person and asked him to back away. Berniya then told Lucious to chill out and Lucious stated “you think I give a sh*t about these people (police)”. I advised Lucious he could not be yelling obscenities in the public establishment with patrons and staff present. I then advised Lucious that he needed to figure out how to pay the bill or he would be charged with theft of services and taken to jail. Lucious then placed his hand behind his back and walked backwards towards me and stated “let’s do it, let’s do it”. [VICTIM #2] spoke up and stated can y’all please take him (Lucious). Berniya then stated “no, we are not so you can shut the fu*k up!”. Lucious then began to yell “hey, hey, hey!”. I gave loud verbal commands for both Berniya and Lucious to be quiet. Berniya replied by saying “I aint gotta shut sh*t what is you talking about”.

At this point I had already to Berniya and Lucious to stop yelling and cursing. I attempted to grab Berniya, but Lucious tried to grab my right arm. I advised Cpl Covington to take Berniya into custody. I then proceeded to place Lucious into double locked handcuffs. Cpl Covington walked towards Berniya and Berniya told Cpl Covington “don’t touch me, don’t grab me”. At this time, I saw Berniya begin to walk away from Cpl Covington. Cpl Covington attempted to grab Berniya, but she snatched away from her. Cpl Covington then pushed Berniya into the wall so she Berniya could not take flight. I immediately grabbed Berniya and assisted her to the ground. I advised Cpl Covington to let go of her. Berniya began to snatch away and kick towards me. Berniya then began to yell at Cpl Covington and stated “I’ma beat your mother fu*king a*s bi*ch. What the fu*k is wrong with you h*e. I don’t give a fu*k if you are the police bi*ch. That badge don’t mean sh*t h*e. What the fu*k wrong with you bi*ch!”. Berniya never made contact with me. After a brief struggle I was able to get Berniya under control and deescalate the situation by placing Berniya into double locked handcuffs. Lucious began to yell out “y’all better lawyer up” several times.

I advised Cpl Covington to take Lucious to her patrol vehicle and I would take Berniya so there would be no further escalation. As I was taking Berniya to my patrol vehicle she began to snatch away from me. As I was taking her to the vehicle Lucious began to yell “leave her alone pu*sy a*s n*gga!”. When I got to my patrol car Berniya tried to snatch away and again and I had to forcibly push her into the car and pin her between the car and myself to get her under control. Cpl Covington walked by my patrol car with Lucious and he stated “if you hurt my child you gone die” multiple times. I then asked both Berniya and Lucious to be quiet and Lucious replied back saying “shut up pu*sy a*s cracker”. Cpl Covington then placed Lucious into her patrol vehicle. I opened the rear passenger side door to my patrol unit (18-113) and attempted to place Berniya inside of it. Berniya then began kicking the vehicle and putting her feet on the door frame so I could not get her inside. I then grabbed Berniya and placed her in the car on her back and grabbed her legs and pushed her inside the vehicle. Berniya began kicking the door to my patrol car. Berniya was then placed into leg irons.

Sgt P Guhl was called to the scene and briefed on the situation. Sgt P Guhl began to talk with Berniya in the back seat of the patrol unit. Berniya told Sgt P Guhl that her hand cuffs were too tight. I immediately checked the fitment of the handcuffs and adjusted them until Berniya was comfortable. Berniya was asked if she had any injuries to her person. Berniya stated her left hand was hurting. Upon closer examination she had a small scrape on her left hand thumb. Berniya refused EMS. Photos of the injurie were taken.

I went back into the establishment and talked to [VICTIM #1] and [VICTIM #2]. Cpl Covington and Sgt P Guhl stood by with Berniya. I made contact with [VICTIM #1]. [VICTIM #1] stated Lucious and Berniya arrived at the location and started off by sitting at a table and then made their way to the bar. [VICTIM #1] also stated Lucious was buying drinks for several women inside the establishment.

I made contact with Lucious’s and Berniya’s waiter they had at their first table. The waiter state his name is [VICTIM #3]. [VICTIM #3] stated Berniya was the first one to come into the establishment. [VICTIM #3] stated Berniya ordered a drink and everything was okay and calm. [VICTIM #3] stated Lucious then came into the establishment and sat with Berniya. [VICTIM #3] stated Lucious became a trouble maker. [VICTIM #3] did not go into detail of why Lucious was being a trouble maker. [VICTIM #3] stated Lucious then went to the bar and began ordering drinks. [VICTIM #3] stated went to [VICTIM #2] and advised her to put all Lucious’s orders on one tab so he would not pay just one of them and leave without paying the other. [VICTIM #3] stated [VICTIM #2] gave Lucious his check. [VICTIM #3] stated Lucious gave [VICTIM #2] three different credit cards that all declined. [VICTIM #3] stated he saw Lucious get up from his table and made a hand motion to Berniya for them to go. [VICTIM #3] stated he observed Berniya get up and follow behind Lucious to the door. [VICTIM #3] stated he ad [VICTIM #1] stopped them and advised them they could not leave because they had not paid their tab. [VICTIM #1] and [VICTIM #3] stated this is when Lucious began to yell at them and cuss at them.

I asked [VICTIM #1] how much the actual bill was. [VICTIM #1] stated Lucious owed $168.81. [VICTIM #1] was able to get me a receipt with what Lucious and Berniya ordered. Between the two of them they ordered 3 Hennessy’s, 2 Jack Daniels, 1 spiked lemonade, 1 Budlight tall, a traditional sampler, a bacon patty melt, 2 Heineken’s, 7 Grand Marnier’s, and a spiked peach lemonade. This receipt will be logged in as evidence in this case.

I transported Berniya to the Dougherty County Jail. Cpl Covington transported Lucious to the jail. During the transport Berniya did not say anything. At the jail my duty weapon was secured in the trunk of patrol unit 18-113. Berniya was turned over to the jail intake officers. My patrol vehicle was searched prior to leaving the jail.

Warrants for disorderly conduct (25-000198-03APD) and Obstruction (25-000198-04APD) will be taken for Berniya. Lucious will have warrants for disorderly conduct (25-000198-01APD) and theft of services (25-000198-02APD).

During this interaction my Motorola V300 Body Camera (serial # BWC2-043808) was turned on. The red light was on ensuring that the body camera was activated and working properly recording video and audio. The body camera was left on for the entire duration of the call. This case is cleared by arrest.
