Officer’s Narrative:

I, Cpl. N. Richardson responded in normal patrol mode to [1800 BLOCK] Regalwood Dr. in reference to a disorderly conduct with a weapon.
Upon arrival, I made contact with white male [VICTIM #1]. [VICTIM #1] stated that on today, he informed white male Nyi-Niy Lwin that he had to leave the residence. [VICTIM #1] stated that the residence is an employee housing for Tokyo Japanese Steakhouse. [VICTIM #1] stated that he was asked by the homeowner and owner of Tokyo, white male [REDACTED] told him that Lwin was supposed to leave on yesterday, but did not.
[VICTIM #1] stated that he told Lwin that he needed to leave, to which he began yelling at [VICTIM #1]. [VICTIM #1] stated that he and Lwin then got into an argument. [VICTIM #1] stated that he then went to his bedroom. [VICTIM #1] stated that Lwin then came to his bedroom and knocked on the door. [VICTIM #1] stated that Lwin then began yelling at him again. [VICTIM #1] stated that he then told Lwin that “people may have guns” and to keep his voice down. [VICTIM #1] stated that Lwin then left his bedroom and went outside.
[VICTIM #1] stated that he then went to the kitchen. [VICTIM #1] stated that he then observed Lwin come back inside the residence and came into the kitchen with a long knife. [VICTIM #1] stated that Lwin then came towards him with the knife and forcefully asked him to apologize. [VICTIM #1] stated that he then bumped into a wall, waking up another member in the residence. [VICTIM #1] stated that he then apologized to Lwin who then put up the knife. [VICTIM #1] stated that Lwin made a forward motion with the knife while asking [VICTIM #1] to apologize. [VICTIM #1] did not provide a witness statement.
I then made contact with white male Nyi-Nyi Lwin. Lwin stated that [VICTIM #1] came to him and told him to get out of the residence. Lwin stated that he did not have any issues with leaving, but stated that he wanted him money from [REDACTED]. Lwin stated that he was in town to work at the business. Lwin stated that he began working at the business on Wednesday and was fired on Thursday. Lwin stated that once [REDACTED] paid him the money, he was going to leave.
Lwin stated that he and [VICTIM #1] got into a verbal altercation and [VICTIM #1] then went into his bedroom. Lwin stated that he then went to [VICTIM #1]’s room and knocked on the door. Lwin stated that he and [VICTIM #1] then got into another argument, to which he stated that [VICTIM #1] informed him that everyone had a gun. Lwin stated that he then went to his vehicle outside and grabbed a knife.
Lwin stated that when he came back into the residence, he observed [VICTIM #1] in the kitchen. Lwin stated that he never made any motion towards [VICTIM #1] with the knife. Lwin stated that he asked [VICTIM #1] to apoligze to him. Lwin stated that once [VICTIM #1] apologize, he put the knife away. Lwin stated that he then put the knife back into his vehicle. Lwin did not provide a witness statement.
Cpl. T. Perry, who was on scene made contact with white male [WITNESS #1]. [WITNESS #1] stated that he was in his bedroom asleep when he heard commotion outside of his bedroom door. [WITNESS #1] stated that when he came outside, he observed Lwin with a knife in his hands. [WITNESS #1] stated that Lwin told him to “mind your fu*king business”. [WITNESS #1] stated that he observed Lwin make thrusting motions towards [VICTIM #1] with the knife. [WITNESS #1] did not provide a witness statement.
Lwin was then placed into double-locked handcuffs, searched incident to arrest, and placed into the rear of my patrol vehicle (18-204). Sgt. A, Sherman and Lt, R. Diaz was notified of the incident and responded to the scene. Sgt. Sherman then informed dispatch to make contact with the on-call investigator in reference to this incident. Inv. C. Ely then responded to the residence and made contact with both [VICTIM #1] and Lwin.
While speaking to Lwin, who was in the rear of my patrol vehicle, Inv. Ely read Lwin his Miranda Warning. Inv. Ely then asked Lwin about the knife, to which Lwin informed her that the knife was inside of his vehicle in a shoebox. Inv. Ely then went inside of Lwin’s vehicle, with Lwin’s consent and retrieved the knives. The knives were photographed and will be placed into evidence locker #02.
Once Inv. Ely was done with her investgation, I then transported Lwin to the Dougherty County Jail and secured my service weapon into the trunk of my patrol vehicle. I then escorted Lwin into the Dougherty County Jail where he was then turned over to the intake officers. After turning Lwin over to the intake officers, I searched the rear of my patrol vehicle for any illegal contraband, but was met with negative results.
