Dougherty County – A Dougherty County Sheriff’s Deputy was arrested on August 4 and charged with ‘Simple Battery’ after a fight with his girlfriend.
Deputy James Cortez Moss allegedly shoved the victim and slapped her across the face, leaving a cut on her lip.
The victim called police and reported the incident. She stated they had been involved in arguments in the past and that Deputy Moss hit her on other occasions. She did not reported the previous abuse.
Deputy Moss and the victim told police that the incident occurred because the victim was going through Moss’s ‘burner’ cell phone and then she placed a call to Moss’s ex-girlfriend. The two began to argue about cheating, at which point the victim attempted to leave.
According to the victim, Moss blocked the front door, shoved her, and struck her on the mouth. She showed the responding officers a cut on her lip. Moss then proceeded to leave the residence in his Sheriff’s vehicle.
When officers spoke with Moss, he stated that he did not remember what occurred between himself and the victim but that he did not hit her. He gave conflicting information to the officers regarding his living situation and what occurred during the argument. Moss continually blamed the victim for previous fights and stated that if she has and bruises on her, she must have done it to herself.
Moss was arrested based upon the statements from both individuals and the victim’s injury. He was booked into the Dougherty County Jail.

I responded in normal mode to [2200 BLOCK] Habersham Rd Apt [REDACTED] in reference to a domestic dispute.
Upon my arrival, I made contact with B/F [VICTIM #1] (victim). Ms. [VICTIM #1] stated that her boyfriend (Deputy James Moss) jumped on her and busted her lip due to an altercation that happened prior to my arrival. Ms. [VICTIM #1] stated that she was sitting at home when Mr. Moss decided to go to the grocery store to get some groceries for the home. She stated that when he left the residence, his cell phone was in the home. She stated that she decided to go through his cellphone to see who he has been in contact with besides her.
She stated that she went through his text messages and discovered that he has been dealing with his ex-girlfriend ([REDACTED]) behind her back. Ms. [VICTIM #1] stated that she immediately got upset and called the ex-girlfriend. Ms. [VICTIM #1] stated that they had a brief conversation about him cheating on them and things that he has done in the past to them. Ms. [VICTIM #1] stated that once she was done talking to “[REDACTED]”, Mr. Moss arrived at the residence with the groceries.
Ms. [VICTIM #1] stated that when he walked in the residence, she confronted him about cheating on her and she told him that she called his ex-girlfriend on the phone and spoke with her. Ms. [VICTIM #1] stated that Mr. Moss got upset and started asking her why did she call his ex-girlfriend. Ms. [VICTIM #1] stated that they started arguing and she advised him that he was never going to change and that she was tired of it. Ms. [VICTIM #1] stated that after she made that comment, Mr. Moss got in her face refusing to let her leave out of the front door. Ms. [VICTIM #1] stated that Mr. Moss then pushed her and then he hit her in her lip with an open hand. Ms. [VICTIM #1] stated that after he hit her in her lip, he left the residence in his work truck (Dougherty County Sheriff Department Vehicle). Ms. [VICTIM #1] stated that she was sick of Mr. Moss and she decided to call the police.
Ms. [VICTIM #1] stated that this is not the first incident where Mr. Moss has put his hands on her with they got into an argument but she never called the police. She stated that Mr. Moss would tell her that his department would take up for him if she did call and would not believe what she told them. I asked Ms. [VICTIM #1] did she have any visible injuries from the physical altercation and she stated “Yes”. I observed a small laceration to the inside of her lip. The laceration appeared to be very fresh as if it just occurred. Ptl. Jones took pictures of her lip for evidence.
After speaking with Ms. [VICTIM #1], I made contact with James Moss. I asked Mr. Moss what happened and he stated that he was confused as to what occurred between them. Mr. Moss stated that after he got off duty, he went to the grocery store to pick up some items for the residence. Mr. Moss stated that when he returned, he noticed that Ms. [VICTIM #1] was upset and he noticed that her young female child was not at the home. Mr. Moss stated that he then asked her what was wrong and she stated that she went through his phone and called his ex-girlfriend. Mr. Moss stated that the phone that she went through was a “burner phone”. Mr. Moss stated that she did however get upset with Ms. [VICTIM #1] because she shouldn’t have called his ex-girlfriend. Mr. Moss stated that he told her that what they were going through did not have anything to do with “[REDACTED]”. Mr. Moss stated that they continued to argue about the incident.
Mr. Moss then begin to start talking about an incident that happened previously where he hit her with his vehicle while trying to leave. I then asked Mr. Moss does he live at this address and he initially told me “No”. He stated that he spends the night from time to time. Then he stated that all of his uniforms and other clothing is at this residence. I then asked him does he spend the majority of his time at the residence and he stated “Yes”. Mr. Moss however initially advised that he does live at this address with her before I arrived on scene.
After getting off the subject at hand, I started back asking Mr. Moss some questions about the incident. I then asked Mr. Moss, did he hit Ms. [VICTIM #1] and he stated “No”. First Mr. Moss stated that something was on the floor and he slipped and fell then he stated that she pushed him. Mr. Moss then stated after she pushed him he stated “Oh I know what time it is” and he left the residence. I did not observe any wet substance on the kitchen floor when I arrived. Mr. Moss stated that he never put his hands on Ms. [VICTIM #1] during the altercation. Mr. Moss stated that this is not the first time that he has had an altercation with Ms. [VICTIM #1]. He also stated that she damaged his property a couple of weeks ago but he did not call police. Mr. Moss continued to bring up situations that has happened in the past that police were not called. Mr. Moss stated that if Ms. [VICTIM #1] have any bruises on her she had to do it herself.
I asked Ms. [VICTIM #1] did she want to write a written statement and she stated “Yes”. Based on the verbal testimony given from both parties and the physical injury to Ms. [VICTIM #1] lip, it was determined that Mr. Moss would be charged with Simple Battery (DV) WN #22-0108519 APD. Mr. Moss was handcuffed and advised that he was under arrest for the above mentioned charge. He was searched by Ptl. Cameron Jones incident to arrest for weapons and contraband with negative results. He was then placed in the back of Ptl. Pugh patrol vehicle. Mr. Moss duty belt, duty weapon and the keys to his take home vehicle was collected by Lt. Deron Johnson (Sheriff Department). Ptl. Pugh then transported Mr. Moss to the Dougherty County jail on above charge.
[REDACTED] (sister to Mr. Moss) responded to the scene to pick up her vehicle that Mr. Moss was driving. The photographs in this case will be logged into evidence locker #2. This incident was captured on my body camera. This case is cleared by arrest.
