Gilmer County (October 22, 2022) – An Ellijay woman called the police out to her parent’s home to report that she had been sexually assaulted in the residence’s basement five days earlier by a man identified as Austin Nix, 38.
The victim said she met Nix at a community thrift store, where he was very nice to her. Nix asked her out, and the victim agreed. The victim brought Nix to her parent’s house, where the two went to the basement.
The victim stated that while they were in the basement, Nix pulled out his penis and continuously tried to put it in her mouth while slapping her in the face with it. She said that Nix then held her down and forcefully performed oral sex on her, even though the victim stated she was on her period. The victim said that she told Nix she was not interested, and Nix continued to masturbate, eventually ejaculating on the victim’s face and in her hair.
Upon inquiring with the victim, they learned that both of her parents had been at home and upstairs in the residence during the assault. The victim said she told her parents what happened in the basement, and her parents told the victim not to call 9-1-1 and that the incident was something she needed to keep to herself. Her parents then drove Nix back to the halfway house where he resides.
October 27, Nix was arrested and charged with sodomy and aggravated sodomy. He was transported to the Gilmer County Detention Center. This case is currently pending in court.

On October 27, 2022 at approximately 12:08 P.M. I (Deputy J. Carver #529) was dispatched to [200 BLOCK] Zenith Trail in reference to an assault report that had happened a few days prior. I responded code one with no emergency equipment activated. I activated my audio and video prior to my arrival.
When I arrived on scene I met with the complainant ([VICTIM #1]) at the front door of the residence. Ms. [VICTIM #1] invited me into the residence and advised me that she was almost raped this past weekend on Saturday night. I advised Ms. [VICTIM #1] to explain further. Ms. [VICTIM #1] stated that she met a guy by the name of Austin at a community like thrift store on Saturday but couldn’t remember the name of it because she had just moved here from Wisconsin and isn’t familiar with the area yet. Ms. [VICTIM #1] stated that Austin was very nice to her at the store and had asked her out and she agreed.
Ms. [VICTIM #1] stated that she brought Austin back to her parent’s residence at [200 BLOCK] Zenith Trail and went down to the basement. Ms. [VICTIM #1] stated that while in the basement Austin pulled out his pen*s and kept trying to put it in her mouth and slapping her on the face with it. Ms. [VICTIM #1] then stated that even after she told him she wasn’t interested he kept playing with himself and ejactulated on her forehead and in her hair. Ms. [VICTIM #1] then stated that he held her down and licked her vagi*a even though she was on her period.
I asked Ms. [VICTIM #1] if anyone was at the house when all this happened and she stated her dad [REDACTED] and her mom [REDACTED] were upstairs. Ms. [VICTIM #1] stated that she told her parents and they took Austin to a half way house where he’s staying but didn’t know the name of it. Ms. [VICTIM #1] stated that her parents advised her not to call 911 and its something she should keep to herself. At this time I made contact with the on-call detective (Detective Champion #597) and advised him of the situation. Detective Champion advised me to have her come to CID so he could start the interview process.
I then had Ms. [VICTIM #1] write out a written statement and asked if she would be willing to meet with Detective Champion at CID. Ms. [VICTIM #1] agreed to meet with Detective Champion. After completing the written statement Ms. [VICTIM #1] grabbed the clothing she had on during the incident and Austin’s sandals he left. I then had Ms. [VICTIM #1] follow me in her vehicle to CID. We arrived at the CID office at 1:09 P.M. I walked Ms. [VICTIM #1] inside to meet with Detective Champion. I then provided Detective Champion with Ms. [VICTIM #1]’s written statement and excused myself from the office.
