Paulding County (November 28, 2022) – Police were called to the Hooters Restaurant on Wendy Bagwell Parkway after receiving a call from a concerned employee about a man, later identified as Tracy Brown, masturbating while dining in the restaurant.
When police arrived on the scene, they met with the store manager, who stated that Brown had exposed his genitals to two female employees since he had been dining in the establishment. She personally had not witnessed the actions of Brown.
According to one of the servers, she had taken Brown’s order and stated he had moved from the bar to a table to better view the television. Later that night, as she was standing in the bar, she looked in Brown’s direction and noticed the tip of his penis hanging out of his pants. She immediately notified the manager of what she saw.
Later that night, while helping another customer, the server looked in Brown’s direction and noticed his penis in his hand and “jerking off” while staring at her. She once again went to the manager, and they immediately called 911. The server stated that another server working also witnessed Brown performing these lewd acts, making both of them uncomfortable.
When speaking with the other server, she stated that she was preparing to-go orders when she looked up and noticed Brown with his penis in his hand “jerking off” while staring at the other server. She also notified the manager.
When confronting Brown about his actions, he had nothing to say about what had happened
Police asked the restaurant to show them video footage, which they were able to provide to confirm the allegations. Both servers informed police they wanted to prosecute, and the manager asked for Brown to be issued a criminal trespass from the property.
With the video footage and two testimonies, police charged Brown with public indecency, and he was placed under arrest. He was transported to Paulding County Adult Detention Center.

[NARRATIVE #1 on November 28, 2022]
On November 28, 2022, I, Officer Alarid (Badge #4721) was dispatched to the Hooters located at 5464 Wendy Bagwell Pkwy, Hiram, GA 30141 about a dispute. Upon my arrival, I met with the complainant, [WITNESS #1], who stated she was the manager and that she had a customer, later identified as Tracy Brown, that had exposed his genitals to two staff members while he had been there. I asked [WITNESS #1] if she had witnessed the actions the staff members witnessed, and she stated she did not.
I then spoke with [VICTIM #1], who stated she was the server taking Brown’s order. [VICTIM #1] stated Brown came in and ordered a drink, she stated he then moved from the bar to a table to see the television better. [VICTIM #1] stated later in the night she was standing behind the bar and looked in Brown’s direction. [VICTIM #1] then stated she noticed the tip of Brown’s pen*s hanging out of his pants at which point she immediately notified [WITNESS #1] of what she saw.
[VICTIM #1] stated that another server, [VICTIM #2], witnessed Brown performing lewd acts in front of her, making both [VICTIM #1] and [VICTIM #2] feel uncomfortable. [VICTIM #1] stated later in the night she was helping another customer when she looked in Brown’s direction and noticed him with his pen*s in his hand “jerking off” while looking at [VICTIM #1]. [VICTIM #1] stated she immediately notified [WITNESS #1] at which point she called 911.
I then spoke with [VICTIM #2] who stated she noticed Brown sitting at a table away from the bar for about an hour. [VICTIM #2] stated that [VICTIM #1] had come to her stating she believed she saw Brown’s pen*s. [VICTIM #2] then stated that approximately 30 minutes later she was preparing to go orders, she stated she then looked up and noticed Brown with his pen*s in his hand “jerking off” while staring at [VICTIM #1]. [VICTIM #2] then stated she informed [WITNESS #1] of their actions against Brown.
I then asked Tracy Brown about the actions he was being accused of Brown stated he had nothing to say about what was going on.
I then spoke with [WITNESS #1], [VICTIM #1], and [VICTIM #2] and asked if they had a video of the incident. [WITNESS #1] stated she does but the store owner would have to pull the video. I informed [WITNESS #1] to call when the video would be available or that I would follow up the next day regarding the video. I then asked [VICTIM #1] and [VICTIM #2] what they would like to do about the incident, and they stated both wanted to prosecute. I then asked [WITNESS #1] if she would like Brown to criminally trespass from the property and she stated yes. Brown was issued a criminal trespass warning.
Due to two testimonies and a video of the incident, I determined there to be enough probable cause for an arrest. I then informed Brown he was being placed under arrest for public indecency. I secured Brown into handcuffs while checking for a double lock and proper fit. I then placed Brown into the rear of my vehicle while buckling his seatbelt.
I transported Brown to the Paulding County Adult Detention Center where he was given custody of the jail staff and booked in on two counts of public indecency. A rear seat check was conducted of my vehicle before placing Brown into the vehicle and after Brown had exited the vehicle, no contraband was found.
