On the above date and time, I responded to the listed location in reference to a “brawl” happening in the driveway. I was advised by dispatch that a male was being dragged and did activate emergency equipment in order to get to the location quicker due to possible risk of life/injury to persons. Sergeant Penny and PFC Masciovecchio did arrive before me and I did respond normal response at that time. Upon arrival, I observed PFC Masciovecchio speaking with Alex and [WITNESS #1] and Sergeant Penny speaking with two individuals I could not make out.
I did speak with [WITNESS #2] and [VICTIM #1] about the incident. [VICTIM #2] began to tell me that she was struck by Alex’s girlfriend, [VICTIM #3], but then started to panic when she saw Alex approaching our location. [WITNESS #2] did back up toward the door and fell backward into it. Once [WITNESS #2] got up, I did notice that the pinky finger on her left hand was ripped up. I am not sure if it occurred when she fell, or during the altercation. However, I did begin to get the rest of the story. [WITNESS #2] stated that Alex and [VICTIM #3] were fighting around back when she and [VICTIM #1] went outside to break it up. [WITNESS #2] stated that [VICTIM #3] struck her, so she struck back. [WITNESS #2] then stated that Alex struck her in retaliation. [VICTIM #1] was able to fill in the gaps and help clear up the air on the above.
I then spoke with [VICTIM #2]. [VICTIM #2] stated that she heard Alex and [VICTIM #3] yelling back and forth when she did observe Alex striking [VICTIM #3]. [VICTIM #2] stated that she also observed Alex dragging [VICTIM #3] around the yard and she did attempt to break them up. [VICTIM #2] stated that as she was attempting to break up the fight, she did yell and [WITNESS #1], [VICTIM #1], and [WITNESS #2] all came outside. [VICTIM #2] stated that a fight just started at this point.
I did attempt to speak with Alex at this time, but the only thing I could get from him was that he was just having an argument with [VICTIM #3]. I did ask Alex why people were saying that it got phsyical, but Alex began to speak in circles about what he just told me a moment prior.
I spoke with [WITNESS #3] and [WITNESS #4]. [WITNESS #3] was the caller and she stated that she heard Alex and [VICTIM #3] arguing for a while. [WITNESS #3] stated that she did look outside at one point and saw [VICTIM #3] strike Alex in the face. However, [WITNESS #3] was unsure if [VICTIM #3] struck him first or if it was in retaliation of some sort.
[WITNESS #4] stated that he observed the arguing and that he observed the physical altercation begin. [WITNESS #4] stated that once everyone entered and began attempting to break up the fight between Alex and [VICTIM #3], a big “brawl” started and everyone began to migrate toward the front of Lot [REDACTED]. [WITNESS #4] stated that he did see the older lady, [VICTIM #2], on the ground and someone just beating on her with some item, but was unsure what.
The final person I spoke with was [WITNESS #5]. [WITNESS #5] stated that she had left her residence to walk her dog when she observed a shoving match between Alex and [VICTIM #3]. [WITNESS #5] then went on to state that she observed Alex dragging [VICTIM #3] around the yard before she observed [WITNESS #1], [WITNESS #2], and [VICTIM #1] attempting to stop the fight. [WITNESS #5] stated that she then observed a “brawl” as well and that it was a big ball of people just fighting leading toward the front of Lot [REDACTED].
Due to the above testimonies, the physical evidence on [VICTIM #1] and [VICTIM #3], I was able to determine that Alex was the predominate aggressor in the altercation and his actions led to the brawl. Due to this, I did place Alex under arrest for the listed charges. Handcuffs were placed on his person, checked for fit, and double locked per policy. PFC Masciovecchio did transport Alex to the jail for me at this time as the camera on patrol vehicle 65 was full and not able to record.
[End of Narrative]
