On the above date and time, I PFC. Quijada, responded to the Circle-K service station located at 1881 Calhoun Rd to assist OFC. Talley and SGT. Forrister who were conducting a motor vehicle traffic stop involving a possible impaired hispanic male driver who did not speak English.

Prior to my arrival, SGT. Forrister contacted me via telephone call and advised me that the driver who was identified as Alexis Darinel Munoz-Velasco stated that he had three alcoholic beverages prior to driving.

Upon my arrival OFC. Talley advised me that she had initiated a motor vehicle traffic stop on the vehicle after observing a fluctuation of the vehicles speed and fail to maintain it’s lane of travel. OFC. Talley also advised me that she observed the vehicle drive onto the wrong side of the road before pulling into the Circle-K service station.

I then made contact with Alexis and advised him that OFC. Talley observed his speed was fluctuating, to which he stated that the reason his speed was fluctuating was because he reduced his speed after observing multiple police vehicles drive past him. I then advised Alexis that OFC. Talley also observed him fail to maintain its lane of travel to which he stated “No”. I then advised him that OFC. Talley observed him drive on the wrong side of the roadway before turning into the service station to which he stated “I feel like not”. I did advise Alexis that his driving manners were going to be recorded by OFC. Talley’s patrol vehicle dash camera.

While talking with Alexis I was able to smell a strong odor of an alcoholic beverage emitting from his breath and person. I noticed that the odor of an alcoholic beverage would get stronger when he spoke to me. I was also able to observe watery glassy bloodshot eyes and slurred speech. I then asked Alexis how much he had to drink today to which he stated that he drank two to three 12oz beers of an alcoholic beverage.

Alexis stated that he drank them before driving and stated that he had the rest of the beers in the back seat of his vehicle. I then asked Alexis if he could show them to me to which he proceeded to open the rear door if his vehicle and handed me a sealed 12oz Modelo beer of an alcoholic beverage which was still cold to the touch. I was able to observe he had two more sealed 12oz Modelo beer’s in the back seat and I also observed an open 12oz Modelo beer in the back passenger floorboard. I asked Alexis if he had any open containers inside his vehicle to which he stated “No”.

I then advised him that he did have one and told him it was in the passenger’s floor board to which he then stated “It fell, I don’t know”. I then asked Alexis how long ago he drank his last beer to which he stated 15 minutes prior to getting stopped by OFC. Talley. Alexis was then advised of Standardized Field Sobriety Test which he agreed to.

***Horizontal Gaze Nystagmus, (HGN)***

I asked Alexis if he has any issues with his eyes to which he stated “No”. Alexis also stated that he was physically okay and had no issues.

• Equal tracking and pupil size located in both eyes observed on both passes.
• Lack of smooth pursuit in both eyes observed: 2 out of 2 clues.
• Distinct and sustained nystagmus at maximum deviation observed: 2 out of 2 clues.
• Onset of nystagmus prior to 45 degrees present: 2 out of 2 clues.
• Vertical nystagmus not present.

While conducting HGN I had to advise Alexis to keep his head still multiple times. I was able to smell the strong odor of an alcoholic beverage emitting from his breath and his person and I also observed his eyes where watery glassy bloodshot.

***Walk and Turn***

Upon placing Alexis into the starting position and advising him of the instructions, I observed he began to take heal to toe steps without being told to do so. I then placed him into the starting position once again and after advising him to begin he stopped on step two and asked me if he could step to the side of the line because it was not leveled to which I advised him he could. I did observed the line to which I observed it was straight and leveled.

• Improper turn (did not turn as instructed).

I then advised Alexis to blow into a Breathalyzer which showed positive for alcoholic beverage displaying a breath alcohol concentration of .119. Alexis was placed into handcuffs and advised he was under arrest. I advised Alexis that I could only read the State of Georgia Implied Consent Notice in English and advised him that I could not translate it to him in Spanish. I did advised Alexis that I was asking him to provide a breath sample. I advised him of the State of Georgia Implied Consent Notice for breath which he stated “No”. I then re-read the State of Georgia Implied Consent Notice for blood which he stated “No”.

I proceeded to place Alexis in the back seat of my patrol vehicle and asked him if he had any questions to which he asked me if he did something wrong by replying “No”, to which I advised him that I could not give him an answerer because per the State I was not allowed to explain anything about it. Alexis stated that he did not understand and asked me what was I asking for to which I advised him to provide breath into a machine and I once again advised him that I could not translate it to him or explain it to him because I was not allowed to.

I also advised Alexis that I could not tell him what to say or what to do and advised him that his answer was up to him and it had to be voluntary and that nobody could obligate him to give an answer. I did ask him that if he wanted me to read it again to which he stated yes. I once again read him the State of Georgia Implied Consent Notice for breath to which this time he stated “Yes”. Alexis was then transported to the Floyd County Police Station were he provided two breath samples into the INTOXILYZER 9000 with the lowest sample reading at .105.

Alexis was then transported to the Floyd County Jail were he was booked and medically cleared. Handcuffs checked for proper fit and double locked.

Back seat of patrol vehicle checked prior and after transportation.

Alexis wife was able to arrive on scene per his request and take possession of the vehicle.
