On 9/6/2024 at approximately 16:06 hours, I PFC Alamia responded to the new fuel station, Arco, located at 1928 Shorter Avenue reference to a subject reportedly bent over throwing up. Upon my arrival, I observed the white male Cody Powers near a shopping cart cursing with his cargo shorts very low exposing his pubic hair. Powers was standing on a public sidewalk on Shorter Avenue with heavy traffic in direct view of the public.
I then turned my attention to the complainant [WITNESS #1], who said Powers cursed her accusing her of trying to steal from him when all she was trying to do was to check on him to see if he was ok. I asked [WITNESS #1] if Powers was exposed and she said “yes, I seen it all”. I then asked if his genitals were exposed she again replied “yes’.
I Officer Alamia, approached Powers and informed Powers he was under arrest for indecent exposure. Powers pulled away saying “don’t touch me” “don’t put your fu*king hands on me”, refusing to be handcuffed , at times darting into traffic. Due to Powers darting into traffic several times I was forced to wait for back up to arrive to avoid Powers potentially getting struck by a vehicle. Officer Carswell arrived on scene shortly thereafter and diverted his attention which gave me the opportunity to reach Powers and pull him against a fence in order to handcuff and complete the arrest. Once I was able to gain physical control by placing my around the body of Powers I began to place him in handcuffs. PFC Carswell also assisted by controlling his left arm while I completed the handcuffing process.
I then walked Powers to the rear of PFC Carswell’s patrol unit where I searched him incident to arrest. As I was requesting that Powers sit into the back of the patrol vehicle he continue to passively resist so i placed my had at the top of his chest and continued to assist him inside the vehicle. Once he was safely inside I closed the vehicle door.
Powers was transported to the Floyd County Jail without further incident and charged accordingly with Obstruction and Indecent exposure.
