On the above date and time, I Pfc. Flippo was dispatched to the intersection of Mark St and Orr St for an incident that previously occurred.
When I arrived on scene at Orr St, there were two male subjects in the vehicle, [WITNESS #1] and [VICTIM #1]. [VICTIM #1] stated he and [WITNESS #1] went to [10 BLOCK] Mark St to sell a gaming pc to Evan Stratton. [VICTIM #1] stated he listed the item on Facebook Marketplace for $300. [VICTIM #1] stated when they arrived at [20 BLOCK] Mark St, Evan only gave him $260. [VICTIM #1] stated when he confronted Evan about being $40 short, Evan began arguing with him.
[VICTIM #1] stated Evan then told [VICTIM #1] to plug the pc in to the outlet located in the garage to make sure it worked. [VICTIM #1] stated as Evan was saying that, he was cussing. [VICTIM #1] stated as he was plugging the pc in to the outlet in the garage, he felt a gun placed on his temple. He stated Evan advised “don’t move”. [VICTIM #1] stated he then hit the gun away from his head and took off running in fear for his life. [VICTIM #1] did have a cut and blood on his finger and he stated he believed it was from hitting the gun away from his head.
[VICTIM #1] stated he did keep the money that Evan gave him and left the pc at Evans residence. [VICTIM #1] also stated he did drop his iPhone 13 somewhere in the yard of [10 BLOCK] Mark St as they were running away. He stated there was a gray case on the phone and a screen protector. [VICTIM #1] stated when they were able to get back in the car, they did drive back home on Cherry St, where [VICTIM #1] left the money. He stated the only reason they went back was to get his phone back. [VICTIM #1] stated there was another male outside with Evan during the incident. Pfc. Vicente spoke to [VICTIM #1]s mother, [REDACTED], and she advised she did want to press charges against Evan for the incident.
When I spoke to [WITNESS #1], he stated they went to [10 BLOCK] Mark St to sell the pc, that was his. He stated when [VICTIM #1] was asked to plug the pc in inside the garage, [WITNESS #1] stayed outside of the open garage and was looking at his phone. [WITNESS #1] stated he did not see the gun as it was being placed on [VICTIM #1] temple, but he did see [VICTIM #1] hit the gun away from [VICTIM #1] head. He stated when he seen [VICTIM #1] take off running, that was when he took off running also. Evan stated he did run in the roadway on Old Dalton trying to get someones attention. Prior to police arrival, there was a call for a suspicious person running in the roadway, being [VICTIM #1].
Myself and Pfc. Vicente along with several other units arrived at [10 BLOCK] Mark St. Pfc. Vicente spoke on the PA and ordered all occupants of [10 BLOCK] Mark St to exit the residence. As people started coming out, we asked if Evan was inside and they advised he was. It did take Evan several minutes to exit the residence. As he was walking out, I advised him to face away from me, put his hands up and walk backward to me. He was advised to put his hands on top of his head. At that time I placed him under arrest.
I read Evan Miranda Rights and asked if he wished to speak with me. He refused. As I began talking to him, he told me what happened from his perspective. He told me [VICTIM #1] drove to [10 BLOCK] Mark St to sell a gaming pc to him. He stated it was listed for $100. He stated there was only one occupant in the vehicle, that being [VICTIM #1]. He stated he got in the car on the passenger side of [VICTIM #1] car to look at the pc. He stated he then handed [VICTIM #1] the $260. He stated [VICTIM #1] advised him it was $400 but then Evan changed his story a couple more times and stated it was a different amount.
Evan was also running over his words and stuttering as if he were nervous. When asked if he had a gun, he stated he did not. He stated he asked [VICTIM #1] to plug the pc in to make sure it worked. He stated [VICTIM #1] then took the pc and ran in the middle of the roadway, saying Evan was robbing him. Evan also stated [VICTIM #1] was running saying Evan had a gun. When I asked if he was the only one outside, he stated his friend, [WITNESS #2], witnessed it. When I spoke with [WITNESS #2], he stated he was inside most of the time. He stated he was outside for a short amount of time. He stated he only seen one person, not two.
Ofc. Smith and Ofc. Rickett got permission to search the residence. No weapons were found but a gun holster was located. There were rooms in the house that they would not give consent to be searched. There were also holes in the walls so it was possible the firearm could have been placed in the wall.
I transported Evan to the county jail with no issues.
