On Sunday, July 13th, 2025, at approximately 01:49 hours I, Officer Gibbs, responded to [100 BLOCK] Dodd BLVD regarding a medical issue with a child. Information given described the complainant, Ashton Freeman, had a 3 year old daughter [JUVENILE VICTIM [REDACTED BY AGENCY] who had ingested drugs. It was detailed she found a bag of drugs and is now throwing up blood. It was described she was not having problems breathing, but was more active than normal and kept sticking her fingers down her throat.

This incident was then said to have occurred at her cousin’s apartment, Kilene Boatner, of [REDACTED]. It is noted the complainant, Ashton Freeman, admitted to being somewhere else and drinking…and thought daughter was ok at her cousin’s house…came in and saw daughter with the baggie at the foot of the bed…and had it at her mouth. Does not know what was in it. Threw the baggie away in the bathroom trash. Thinks cousin [Kilene Boatner] has possibly flushed the baggie.”

I then arrived on scene but was on the opposite side of the building of EMS. They requested assistance due to dealing with irate subjects. I made my way to them, and they had the juvenile victim in the back of the ambulance and Ms. Freeman was preparing to ride with them. I stood by and allowed them to leave for treatment. I then attempted to make contact at APT [REDACTED] but was unable to do so.

I then followed up at Floyd-Atrium Health ER, where I spoke with Ms. Freeman. She stated she went to the bathroom and upon exiting, she observed her child with a baggie that contained a white powdery susbstance. She attempted to confront her cousin, Kilene Boatner, asking what it was and to call 911. She advised Kilene was dismissive, stating it was nothing to worry about and the child just needed to rest. She was also allegedly adamant 911 not be called. The child began to have extreme health symptoms such as throwing up blood and Ms. Boatner was able to call for medical assistance.

I asked Ms. Freeman who was at the residence, and she stated herself, her children [to include JUVENILE [REDACTED BY AGENCY] who she had given to a neighbor she did not know in the meantime], Kilene Boatner and her child [JUVENILE [REDACTED BY AGENCY]

I also spoke with the EMT that transported the child, along with other medical staff, who stated that they suspect the child had swallowed methamphetmaine due to the symptoms being presented.

Other officers remained on scene and continuously attempted to make contact at the apartment but were unable to do so.

Based on testimony given and evidence of the incident, an arrest warrant was filed against Kilene Boatner for Cruelty to Children in the 2nd Degree under OCGA 16-5-70. A search warrant was also filed on the apartment which was then executed due to the urgency of the circumstances, being that another child was in the home along with possible drugs or drug related objects.

In executing the search warrant, a property manager was contacted and a key holder was able to provide multiple keys we attempted to use however none of them worked. Ms. Boatner then suddenly opened the door at which time another officer displayed his firearm toward her and gave her verbal orders to exit the residence. She complied. I was able to place her in handcuffs behind the back which were checked for fit and double locked. She did claim she was sleeping but she heard the keys and did not hear the multiple ongoing attempts that have been made to attempt making contact.

Her juvenile child was located sleeping in the bed. No other party was present. We then made contact with Ms. Boatner’s mother, [REDACTED], to come take custody of the child per Ms. Boatner’s request and she did.

I then read Ms. Boatner the miranda warning, which she advised she understood and did not want to answer questions. I explained the incident, and Ms. Boatner claimed the incident did not occur within the apartment.

The search yielded negative results. I then escorted Ms. Boatner to the rear passenger compartment of patrol unit 165 which was checked prior to and following her transport to the Floyd County Jail. She was booked in and charged on the warrant for Cruelty to Children in the 2nd Degree under OCGA 16-5-70. A fact sheet was also filed, charging her with Tampering with Evidence under OCGA 16-10-94.

I then relocated to the hospital and again spoke with Ms. Freeman. In the meantime, DFACS had been called and transported her other child to the hospital as well, and they were working on drafting a safety plan.

I spoke with Ms. Freeman to clarify if she ever left the residence after the call log read that the complainant admitted to being somewhere else drinking. Ms. Freeman stated again she never left, only to get diapers out of her vehicle or use the bathroom. She then stated she sat down and noticed a baggie near a charger first and that is when she confronted Kilene about it. She stated she does not know who introduced the methamphetamine, or how it entered the apartment. When asked if anyone else was there, she stated a black male with face tattoos who goes by “[REDACTED]” was there earlier in the day and the three of them were hanging out together.

CID requested to follow up to further the investigation.
