[NARRATIVE #1 on January 22, 2026]

On the above date and time I, PFC Vasser, was dispatched to [600 BLOCK] N Avery Rd in regards to a Matthew Allen Wagner (Offender, Arrestee) banging on the house. Dispatch advised that there was a location note for three officers to responded because Matthew would fight with law enforcement.

Upon arrival I met with a male sitting on the front porch of the residence surrounded by several small bottles of alcoholic beverages. The male identified himself as Jeff Daniel McWhorter with the date of birth of [REDACTED]. I asked Jeff why he was at the residence, and he advised that he was there because the homeowner, [VICTIM #1], invited him there he also advised that he did not live at the residence, and had been there for 45 minutes. I asked the male if he knew anything about anyone beating on the house or if he knew who called 911, and he advised that he didn’t know about either.

I attempted to open the glass door to the front door, and I observed that it was locked which indicated to me that the male was not telling the truth. I then went to my patrol vehicle to look on my in-car computer to see if the name that the male gave me was coming back with a photo. Once I pulled up the log I observed a photo of the male on the porch but I misread what I was looking at, and thought it was a picture for the name that he gave me. At this time PFC Flippo and PFC Dutton arrived on scene so I advised the male to step down off the porch to speak with them while I made contact with the residents inside.

Once I knocked a female answered the door and allowed me to come inside. The female was inside with another adult female and two children. The female that answered the door, [VICTIM #2] (Complainant, Victim), advised that the male was Matthew Wagner, and that he was not supposed to be at the residence. She then advised that she had a video of Matthew beating on the house.

I was then shown the video by one of the children. The video didn’t show Matthews face, but it did provide audio of [VICTIM #2] telling Matthew that he needed to stop and leave because he was scaring the kids. You could hear Matthew in the background screaming that he wasn’t leaving, and [VICTIM #2] saying that she was calling 9-11. You could also hear a constant beating which is believed to be Matthew beating on the house. Around this time E-911 Dispatch advised that the name that the male gave me was coming back Driver Not Found which in normal if someone provides a false name.

I then went outside and began to speak with the male and asked him where he lived, and he advised that he lived in Garden Lakes. He then advised that he had walked from his house to the residence. I then asked him again what his name was, and he advised Jeff. I advised him that I had already seen a video of where he had been beating on the house, and that I didn’t believe his name was Jeff. I then detained the male and walked him over to my patrol car. While placing him in handcuffs he began getting aggressive toward me, and pulling away from me I could also smell a strong smell of a alcoholic beverage on his breath.

The male then began saying that I was lieing about the video, and began yelling at me. Once he was taken to the front of my patrol vehicle the male was made aware that he was under arrest for prowling on the property. I then began conducting a Search Incident to Arrest. While conducting this I observed that the male had a name tag on his shirt underneath his jacket that said “Matt”. PFC Flippo then found the males ID inside his wallet that indicated he was in fact Matthew Allen Wagner.

While I continued to search Matthew he began to attempt to pull away from PFC Flippo, PFC Dutton, and I. Matthew attempted several time to stand up and pull away from us resulting in Matthew being pushed back onto the car to keep control of him during the search. One of the times that Matthew was pushed back onto the car to search him safely his head hit the hood causing his mouth to bleed. I was unaware of the injury for a few minutes until it was made aware to me that he was bleeding. I then stood him up, looked at his mouth, and continued searching him. Once the search was complete Matthew was placed into the rear of my patrol vehicle. Around this time Sgt Ward and Lt Pendley arrived on scene.

I then gathered Matthews items and placed them into a bag to keep his items together. Lt Pendley advised that we needed to get Matthew out of the car so he could document his injury to his mouth per procedure with visible injuries from uses of force. When we got matthew out of the car he would not allow Sgt Ward document the injury. Matthew then began yelling at all of us so Lt Pendley advised that he could just go back inside the car. I gave Matthew several lawful orders to sit down, and he refused so we had to force Matthew back into the car so he could be transported to the Floyd County Jail.

While getting Matthew back into the car he motioned that he was about to kick me in the face then he advised that he should do it. Matthew was placed in this position because his legs had to be picked up, and him placed into the back seat head first. Once we got him there I went to the other side of the car to pull Matthew the rest of the was inside the car so we could close the doors. After this Lt Pendley advised me to go ahead and get Matthew to the jail while PFC Dutton gather the rest of the information for me. I then got into my car, and transported Matthew to the Floyd County Jail with Sgt Ward.

While en-route to the jail Matthew continued to scream and bang his head on the cage inside my patrol vehicle. While I attempted to contact PFC Dutton to let him know to ensure we got a copy of the video they children had Matthew began screaming louder to prevent anyone from hearing me. At this point Lt Pendley advised dispatch to have more people at the jail to help escort Matthew into the booking lobby. Once we arrived to the jail Matthew was taken inside the booking lobby, cleared by the jails medical staff, and booked on his charges.

Later that morning I met with PFC Dutton, and he provided me with the names of everyone in the house.

[NARRATIVE #2 on January 22, 2026]

On January 22, 2026 at approximately 12:31am. I assisted Pfc. Vasser with a domestic violence call at [600 BLOCK] North Avery Rd. Once on scene I observed Pfc. Vasser and Pfc. Flippo placing Matthew Wagner in handcuffs in an attempt to detain him while we investigated the allegation that he was in violation of a probation order that stated he wasn’t allowed to be at the above mentioned address.

As Pfc. Vasser was placing the handcuffs onto Matthew, he became very belligerent. He began to cuss at Pfc. Vasser and attempted to snatch away from him. At this point I assisted Pfc. Vasser in gaining control of Matthew by using passive guidance to relocate him to the front of Pfc Vasser’s patrol car. As we were escorting him to the patrol car Matthew became more combative and attempted to pull away harder. Resulting in him being laid across the hood of the patrol car.

At this time Pfc. Vasser advised Matthew that he was initially placing him in handcuffs only to detain him, but due to his actions he would now be under arrest. At this time Pfc. Vasser began searching Matthew. During this time Matthew continued to resist resulting in the need to use greater force to hold him in place. While holding him in place to complete the search of his person Matthew sustained an injury to his mouth causing him to bleed.

Once Pfc. Vasser completed the search Matthew was placed in the back of the patrol car. At this time I went in to speak with the complainant and witnesses. I spoke with [VICTIM #2], [VICTIM #1], and two juvenile females who witnessed the incident.

[VICTIM #1] advised that there was a probation condition prohibiting Matthew from being on her property which was later confirmed to be true. She stated that Matthew has some mental health issues and he showed up uninvited banging on her doors and windows begging to get inside of the house. Nearly waking their 19 month old son.

She stated that she told him to leave but he refused and continued to knock at which point she called for police. [VICTIM #1] advised that although Matthew wasn’t allowed on her property they would spend time together almost daily at his residence. She also stated that she maintained possession of his mental health medications so that she could administer them to him daily. [VICTIM #2] and her two juvenile daughters advised that they also witnessed this all take place. Once the complainants and witnesses statements were heard and their information was collected I left the scene.
