On February 11, 2025 at approximately 2247 hour, I (PFC Blankenship) was dispatched with other officers to [SINGLE DIGIT BLOCK] Abigail Ln in reference to a domestic where boyfriend of the complainant’s mother was drunk and threatening others in the house.
Upon arrival, I observed the male, identified as Michael Reece Ochoa, coming out of the front door of the residence. I placed him in handcuffs, fit and double locked, and advised him that he was being detained due to the the allegations of threats that he had made and his drunken state; I observed a strong odor of an alcoholic beverage coming from his person that grew as he spoke. I further observed he had watery eyes and was unsteady on his feet.
I advised Michael of his Miranda rights and asked if he would tell me his side of the altercation. He advised he didn’t really know, that he was trying to talk to his girlfriend, [VICTIM #1], and advised “those two guys” came out of nowhere. He then advised he was referring to [WITNESS #1] ([VICTIM #1]’s Son) and [WITNESS #2] ([VICTIM #1]’s brother). While talking to Michael, he continued to slur his words heavily; at one point saying “wishinish” in place of the word “witness”.
I then spoke with [VICTIM #1] who summarized his actions by saying “he’s drunk and he’s being a d*ck”. She advised that she had been at her daughter’s home when Michael began calling and texting her non-stop telling her that he wants her home. She advised that he had been drinking and that he “gets that way”. When she did arrive home, Michael came outside and up to [VICTIM #1] who was still seated in the driver seat of her 2008 silver Nissan Versa bearing Ga registration [REDACTED]. She advised that Michael leaned in over her pressing her back which caused her to panic. She advised that she felt like she couldn’t breath and that Michael then began to punch her car window.
She then advised that the verbal altercation became physical with Michael grabbing onto her and she then grabbed onto him with Michael pulling her down the muddy incline from the car and into a boat in the front yard. She advised that Michael pulled her down onto him and would not let her go. She advised that Michael then began “swinging at me” and kicking and flailing at her while she yelled at him “you’re not gonna hit me”.
[VICTIM #1] advised it was after this last statement that she was yelling while Michael held her in the boat that her brother, [WITNESS #2], came running up to separate them. She advised that the altercation grew to include [WITNESS #2] and Michael with Michael yelling and drunk and [WITNESS #2] pulling him off of her and slapping at Michael.
I then spoke with [WITNESS #1] ([VICTIM #1]’s son) who advised me that [WITNESS #2] had picked him up from work and that when they pulled up to the residence, he observed that [VICTIM #1] and Michael were both in the boat and heard his mother yelling “you’re not gonna hit me again”. He advised that they got them out of the boat and that Michael started slipping and falling in the muddy front yard while yelling at everyone telling them “you’re fu*ked” and “you’re screwed”. He advised that he called 911 because he didn’t want Michael to start fighting with anyone. He advised that Michael has fought and hit them in the past and advised that, “you never know with Michael”.
I then spoke with [WITNESS #2] who told me a similar story saying that they could hear screaming as they pulled up to the residence. He said [VICTIM #1] was yelling “you hit me, don’t put your hands on me ever again” and “you hit me, are you ever gonna hit me again?” He then advised that he got [VICTIM #1] and Michael separated and that Michael was intoxicated. He advised that [VICTIM #1] told Michael not to come near her and that he got up and started toward her again. [WITNESS #2] advised that at some point Michael began grabbing at him after he had tried to talk Michael into calming down and going inside to sober up.
[WITNESS #2] said that Michael was yelling and accusing everyone of jumping him and that Michael attempted to hit him. He advised that while Michael was flailing he hit [WITNESS #2] in the chin. [WITNESS #2] advised that he had also slapped at Michael while he was yelling and flailing and grabbing at him. [WITNESS #2] advised that Michael continued to yell and struggle against him and kept trying to get at [VICTIM #1] until Michael jumped in to [VICTIM #1]’s car. [WITNESS #2] advised at that point he gave up. He said that Michael continued to be disorderly and began tossing items in [VICTIM #1]’s car and throwing items out of the window. He advised that Michael was drunkenly yelling that they were jumping him, that they had broken his glasses, and that he was calling people to come over to the house. I was unable to observe any marks on [WITNESS #2]’s face, but did see dried mud all over his jacket.
I spoke with [VICTIM #1] again and she advised that she didn’t know if Michael had actually made contact with her, but advised that he had been swinging at her. I was able to see that her face was red and flushed and had dried mud on it.
I then spoke with Michael again and re-advised him of his Miranda rights. I asked him about the altercation in the car and he advised that it occurred because he and [VICTIM #1] had been reaching for the same Polar Pop. I then asked him how they had got into the boat from the car and he advised “we’re freaks sometime” and clarified that he thought that the altercation between him and [VICTIM #1] was leading to a sexual encounter between them. I clarified if he meant that he believed that he and [VICTIM #1] were about to have sex in her vehicle/front yard boat in the dark, rainy night and he indicated yes. As I spoke with Michael he slurred his words and his eyelids appeared very heavy and the odor of an alcoholic beverage filled the back of my patrol vehicle.
I observed that Michael was soaking wet and covered in mud. I placed Michael under arrest and searched him incident to arrest. I then transported him to the Floyd County Jail where he was booked in on the charges of Simple Assault FVA and Disorderly Conduct. A victim notification was filled out for [VICTIM #1] at the jail.
The back of my patrol vehicle was checked before and after transport.
