On Monday October 14th 2024 I Pfc Wilbanks (Rpd75) was on uniformed patrol in the city of Rome. At approximately 0717 hours, I responded to [100 BLOCK] Chambers St unit [REDACTED] in reference to a domestic dispute. Dispatch advised that an anonymous caller could hear a male beating his girlfriend. The female could be heard “screaming and wailing”. Dispatch also advised that there was a no contact bond in effect from a prior arrest of the occupants of the residence between Miguel Wimby and [VICTIM #1].
Once on scene Pfc Carswell (Rpd64) and I approached the residence. We could hear a female and male just inside the door. I could not make out what the male was saying due to the wind, but could hear him talking in an aggressive manner and a female crying. I knocked on the door and the noise stopped. The male inside asked who I was. I said several times that I was a police officer and for him to open the door. At first the male did not respond.
I knocked again and the male said he was getting dressed. I heard a noise at the back of the residence and radioed to Officer Palmer (Rpd41) to go around back. Soon the front door opened. Due to the nature of the call and the male being non-compliant opening the door at first, I ordered the male to show me his hands first before coming outside. The male came and and he was detained. He was identified as Miguel Wimby. He was given a miranda warning. He stated to me that he and his girlfriend ([VICTIM #1]) had been arrested previously. She was said to have ran out the back door due to her being scared of the police after her last arrest.
I went to Pfc Carswell who was standing with Ms. [VICTIM #1]. Ms. [VICTIM #1] began thanking us. I was advised that Mr. [Wimby] had come to the residence around 0600 this morning and began threatening Ms. [VICTIM #1] with a gun. Ms. [VICTIM #1] described the pistol as a black 9mm taurus. I asked if she had left out the back door. She said yes and that she ran away. Mr. Wimby was said to have been strangling her. While speaking with Ms. [VICTIM #1] she was clearly distraught and had visible marks and scrapes upon her face/neck consistent with someones hands around her neck in a struggle. I asked Mr. Wimby where his gun was at. He said it was in the house. I asked where. He advised that he did not know and that he did not have it.
With Ms. [VICTIM #1]s permission, Pfc Carswell and I entered the residence with Ms. [VICTIM #1]. Ms. [VICTIM #1] advised that upon him showing up to the residence, Mr. Wimby was said to have taken her phone and would not let her call anyone. Upon entering into the residence officers noticed that the residence was in deplorable conditions with bedbugs and roaches crawling all over the residence. There was also fecal matter and urine from the two dogs laying on the floor through out the apartment, including a room clearly for a child. I inquired as to where the children were at. I was advised that they were with Ms. [VICTIM #1]s mother. With gloves on, Pfc Carswell and I began to look for the pistol Mr. Wimby was said to have. Officers looked around the residence but were unable to locate it. Ms. [VICTIM #1] went on to state that after I knocked, Mr. Wimby let go of her and that is when she ran.
I spoke again with Mr. Wimby who advised that after they were arrested his belongings had been left at the residence. He believes that someone stole the firearm as he has not seen it. He went on to state that Ms. [VICTIM #1] was said to have gone to the courthouse and got a no violent contact order so they could be around each other. He advised that after being arrested, he had been staying various places. He advised that he came over last night when she was not at the residence.
Mr. Wimby was placed in the back of my patrol car and transported to the Floyd County Jail without incident.
