[NARRATIVE #1 on March 21, 2026]

On 03/21/26 at 06:36 hours, I PFC B. Smith was in full uniform and in a marked patrol vehicle when I responded to Salem Dr at SR 20 in reference to a motor vehicle accident.

I arrived and was informed the driver of the white pickup, later identified as Remigio Lopez-Pascual, had fled the scene. I checked the area for him and then checked out at the accident scene. I observed the white pickup on the wrong side of the road still up to the front of the other vehicle. The truck also smelled like marijuana. I called for the on call wrecker, and then began to search the vehicle for narcotics. I located Remigio’s license and two empty corner baggies containing marijuana shake. There was also Modelo Beer bottles full in the backseat.

After the accident investigation I began searching the area. Myself and other officers located Remigio on Polaris Terrace. I drew my taser due to not knowing if he was armed and not being able to see his hands. I gave him commands which he refused to comply with. I pointed my taser at him and he finally complied and was put into handcuffs. I did not complete field sobriety due to him already fleeing and the fact he would not cooperate with commands.

I could smell alcohol and marijuana on his person and he had slurred speech and bloodshot eyes. Based on this, as well as the manner of driving displayed by the accident, I read him implied consent to which he agreed and he was transported to Floyd EMS for a blood draw before being taken to Floyd County Jail where he was medically cleared and booked in. He did state to me “I smoked marijuana but not alcohol.”

The blood kit was entered into evidence on 03/21/26.

[NARRATIVE #2 on March 21, 2026]

On 3-21-26 I Pfc Jenkins responded to the area of Salem dr in regards to a hit and run that occurred and the driver fled on foot.

I arrived on scene in a marked patrol car wearing a full police uniform displaying my badge of office. Once I arrived in the area I began to search the area for the subject that fled the scene. After roughly an hour of searching another officer located the suspect later identified as REMIGIO LOPEZ-PASCUAL in the front yard of [SINGLE DIGIT BLOCK] Polaris Ter. I advanced to the officers who located the subject and noticed REMIGIO on his side with his back to me where I could not see his hands.

Other officers were giving REMIGIO verbal commands as to which REMIGIO was failing to comply with and refused to show his hands. Due to REMIGIO already fleeing a scene of the accident and not complying with officers commands to show his hands. I pulled out my department issued firearm and kept it at a low ready until REMIGIO began to follow commands and show his hands. REMIGIO was then placed handcuffs and read implied consent. While he was being read implied consent REMIGIO swayed forward and backward.

While placing REMIGIO in handcuffs I could smell an odor of alcoholic beverage emitting from his person. As I lead REMIGIO to the patrol vehicle he struggled to maintain his balance and began to walk at an angle. Once I placed him in the back seat REMIGIO was unable to understand directions of how to turn his body to be more comfortable in the back seat. See other officers reports
