On the above date and time, I Pfc. Flippo, driving on 20 West near 100 South. Dispatch advised a BOLO for a grey Chevy Camaro being driven by a person under the influence that crossed the state line from AL on to 20 West. Dispatch advised the caller stated they were behind the Chevy Camaro. The witness stated the driver of the Camaro drove off the roadway multiple times. The complainant also stated they had their flashers on and was driving directly behind the Camaro. Dispatch advised there was a second caller about the Chevy Camaro.

Since the Camaro was a few miles behind me, I parked my patrol vehicle 20 West at 100 South. When I spotted the car driving inbound to Rome on 20 West, I witnessed the driver of the Camaro driving under the speed limit. Due to my training, it looked like the driver was driving approximately 30 mph in a 55 mph area. I also seen the vehicle behind it with their hazard flashers on. I pulled out behind the Camaro and witnessed the driver exit the roadway on the right side of the road.

I immediately activated my emergency lights and sirens to conduct a traffic stop. The driver of the vehicle took an extended amount of time to stop the vehicle. One the vehicle came to a complete stop, I conducted a passenger side approach. As soon as I got up to the passenger side window, I was able to tell the driver was impaired. I also smelled an odor of alcohol coming from the vehicle.

The driver, Sebastian Martinez, turned to look at me and his body started wobbling as well as his eyes looked heavy. When I asked Sebastian how much he had to drink, he stated he had a few. I walked to the driver side of the vehicle to observe Sebastians behavior more. I advised Sebastian to turn the vehicle off and step out of the vehicle. As he was attempting to turn the vehicle off, his hand-eye coordination was extremely wobbly. He goes to turn the vehicle off and tries to turn the windshield wipers on.

I advised him one more time to turn the vehicle off. He was able to successfully do so. I then open the driver side door for him to step out. He did not have a seatbelt on so when I asked him to take his seatbelt off, he attempted to unbuckle. He was still wobbling around. Once he stepped out of the vehicle, I immediately noticed he was unable to stand up straight without falling over. I assisted him to the back of his car so he would not fall down. Once at the back of the vehicle, I asked him how many drinks he had drank and he stated a few. I then asked him how many was a few and he stated he needed to talk to his lawyer.

I asked him for his drivers license. While trying to get his license out, his hand-eye coordination was sluggish and wobbly so he was having difficulty getting his license out of his wallet. Once I ran him through dispatch, I asked him one more time how many alcoholic beverages he had and he stated he had to talk to his lawyer before answering any questions. While speaking with Sebastian, his speech was extremely slurred as well as his eyes heavy. He was unable to focus his eyes on me.

When Sgt. Penny arrived, Sebastian told him the same thing, that he was going to speak with his lawyer first. Due to Sebastian being unable to stand without falling over and to refrain from possible injury during any tests, I placed Sebastian under arrest.

When I placed Sebastian in the back of my patrol car, I read him Implied Consent for blood and he agreed. I transported him to EMS Headquarters for a blood draw. While at EMS headquarters, Sebastian stated he had not eaten anything all day prior to his alcohol consumption. While at EMS headquarters, I asked Sebastian if he took any medication or prescribed drugs and he stated he did not. Once the blood draw was complete, I transported Sebastian to the Floyd County Jail with no issues.

Ofc. Talley advised me that she located 4 open containers of alcohol in the back passenger floor board within arms reach for Sebastian. She located these alcoholic beverages when she was conducting an inventory search of the vehicle before it was towed.
