Officer’s Narrative:

On The date of December 30, 2025 at approximately 2:29pm, I Sergeant Robinson was advised by dispatch that there was a call holding for a welfare check and call for further information. I called dispatch and they said there was a welfare check called in due to the children texting an aunt that “the step dad was going to beat their a*s”. The aunt was concerned and wanted three juveniles checked on. I responded code one with no lights or sirens.

Upon arrival at the residence, I knocked on the door and could hear some loud talking and someone stomping through the home going away from the door. I then knocked louder and a woman (identified as [WITNESS #1]) answered the door and was yelling to the rear of the home that the cops were here.

A man appeared (identified as Cody Whittemore) and he came out on the porch and started saying the kids were unruly and don’t do what they are supposed to do. [WITNESS #1] said that one of the kids had already been in trouble with the law and was even in alternative school. I told her that I was here to check on the children and to get them for me.

The two young males walked out (identified as 14y and newly turned 16y) and both were holding back packs packed full of clothing. Both boys had marks around their necks and the 16y said that he may have a broken finger. I looked at his hand and most of the top of his hand was red. I took pictures and secured the boys in the rear of my patrol unit.

I then asked them briefly what happened as 14y had red marks all the way around his neck and up to his ears. The 16y had red marks around the right side of his head, ear and under his chin and neck there was a line looking mark. The 14 y said that Cody got mad because they went to the room to eat due to the baby having the flu and he coughs all over everything. They said they did not want to get sick. Then Cody came into the room and that is when things started.

They said they (mom and Cody) told them to leave, they could not stay there anymore and then Cody got physical with 14y. He held 14y by the neck and was banging the back of his head against the wall. 16y said that he tried to get Cody off of his brother by pulling him and then Cody grabbed him and was choking him. They said they texted their aunt as she could come get them.

I shut the door and radioed dispatch to send me another unit. When Deputy Knight arrived I approached Cody and advised him he was under arrest. I handcuffed him with his hands behind his back and checked the handcuffs for fit and double locked them.

[WITNESS #1] said, “He was just correcting them.” I told them both that there are better ways to do that. Deputy Knight placed Cody in the rear of his patrol unit then transported to the Gilmer County Adult Detention Center.

Deputy Heptinstall arrived as well. I advised him to call DFCS and let them know we had a situation that was necessary to have them on scene. I then called and spoke with Detective Farnham and advised him of the situation. He said they would be on the way. DFCS, Detectives Farnham and Daves arrived. They spoke with all subjects there and it was decided that the mother and children were all going to the aunt’s home. The aunt, [REDACTED], had been called and was on her way. I stayed to ensure the scene was safe until the aunt arrived and every one was secured into the vehicle.

Cody was charged with battery F/V, aggravated assault F/V and cruelty to children x2. The mom and aunt were given a victim’s pamphlet with the case number on it and were taken for FI interviews.
