On November 21st 2025, at approximately 19:19 hours, I, Deputy J. Parks 531 was dispatched to a call at [600 BLOCK] Harpers Creek Road in reference to a 21 year old male dropping the caller’s 19 year old daughter off intoxicated and left in a black Honda Civic tag number [REDACTED]. I responded code one no lights or sirens in patrol unit 121.

While in route dispatch put out an update that the caller had come back to get their daughter and left again while intoxicated. When I came to the intersection of Zion Hill Road and Harpers Creek Road I made contact with the Black Honda Civic and conducted a traffic stop on the vehicle. The vehicle stopped almost pulling off of an embankment.

I made contact with the driver of the vehicle identified as a Mr. John Michael Ramos-Mendoza and the passenger a Ms. [WITNESS #1]. When I made contact with John I observed his eyes to be very glossy and bloodshot. I asked John to step out of the vehicle to talk to me. While I was talking to him I asked him if he had anything to drink and he stated he had a Four Loco earlier in the day. I then asked him if he would be willing to do standardized field sobriety testing and he agreed.

While conducting standardized field sobriety I observed the following clues

Horizontal Gaze Nystagmus:
Equal pupil size
Equal tracking
Lack of smooth pursuit
Distinct and sustained Nystagmus at maximum deviation
Onset prior to 45
I also observed a vertical nystagmus

Walk and turn
Missed heel to toe going first 9 steps and second 9 steps

One leg stand
None

The clues I got from the Standardized Field Sobriety indicated a blood alcohol level of .08 grams or higher. I asked John if he would take a preliminary breath test and he agreed. Cpl. R. Sawyer 546 then administered the preliminary breath test which indicated a blood alcohol level of .089.

I then placed handcuffs on John and read him implied consent from the green Georgia implied consent card asking for breath and he agreed. I then had Cpl. Sawyer transport John to the Gilmer County Adult Detention Center to meet with Lt. Hefner 510 for a breath test on the Intoxilizer 9000.

I stayed on scene with [WITNESS #1] and called for next list due to [WITNESS #1] stating she had been drinking as well. [WITNESS #1] stated that John had bought her the alcohol she had earlier that day. She stated it was a Four Loco that he had given her at her parent’s house. She stated they had passed out after drinking and her parents came home. She said when her parents came home they all got into an argument because they don’t want John at their house and they made John leave the residence. She said that’s when John left, and then she had him come back to get her because she didn’t want to be there. She said when they left together was when I stopped them.

[WITNESS #1] then left with her sister to go to John’s mom’s house for the night because she didn’t want to go home. I stayed on scene and completed a vehicle inventory until Bradburn’s towing arrived on scene and towed the black Honda Civic to their private lot. I then went in route to the Gilmer County Adult Detention Center.

When I arrived at the detention center Lt. Hefner 510 advised me that the intoxilizer results were a 0.077 Blood Alcohol level for John. I decided to only charge John with Disorderly conduct under the county ordinance 31-1(a14) for knowingly allowing [WITNESS #1] to gather with him at her parents’ home at [600 BLOCK] Harpers Creek Road to drink alcohol. I then served him with his copy of the Uniform citation.
