[NARRATIVE #1 on December 02, 2023]
I placed the complainant identified as [VICTIM #1] a phone call. He stated he owns two cabins one in Fannin County and one in Gilmer County. He stated he had someone tried to rent his cabin in Fannin but the company he uses caught the fraudulent credit card. He stated then the one in Gilmer was booked last min and the card went through. He stated the card holder called him stating he did not book a cabin in Gilmer.
Mr. [VICTIM #1] stated someone has done this in the past and he thinks it could be the same people. He stated he has video footage but it’s hard to see their face. He stated they drive a dark blue SUV. I asked if he had any of their information. He stated no they use fake IDs and fake addresses. I asked what time they were supposed to check in. He stated any time after 4. I advised if he saw them on his cameras to call us, and we would go to the residence to make contact with them.

[NARRATIVE #2 on December 03, 2023]
Sunday 12/03/2023 at approximately 0300 hrs I, Sgt Blaylock, was dispatched to place a phone call to [REDACTED] to speak with [VICTIM #1] in reference to renters showing up to his cabin having used a stolen credit card.
I spoke to Mr. [VICTIM #1] who advised he had called earlier in the day to report the use of a stolen credit card to rent one of his cabins at [200 BLOCK] Windsong Bluff East. He stated he was told to call back if or when the inividuals showed up at the cabin. Mr. [VICTIM #1] informed me two individuals, a male and female, had just arrived at the residence; he was watching them on his Ring doorbell. He informed me it appeared they were driving a dark in color, possibly dark blue, SUV.
I checked GPS and told Mr. [VICTIM #1] I had about an 18 minute drive time, maybe more due to inclimate weather. Mr. [VICTIM #1] said he would try and keep them there as long as possible (giving them incorrect keypad codes). While en-route Mr. [VICTIM #1] called me back and stated they had just left but he called them and gave them another incorrect passcode to try (four in total I believe). Mr. [VICTIM #1] also advised the male subject was wearing a mask covering his head and face however the female was not.
With the information the male was keeping his face covered, I had Deputy Howard and Cpl. Robinson en-route as well. At 0326hrs I was approaching the residence when the vehicle, a dark blue SUV, was pulling out of the carport. I activated my emergency lights and pulled in the vehicle’s lane of traffic to stop the vehicle. At that time the driver drove down the embankment around my patrol car. I advised other units he was running and turned around to pursue. (I did observe the driver had his face and head completely covered with what appeared to be some type of bandanna).
Deputy Howard was behind me and also turned to pursue the vehicle. Both Deputy Howard and I lost sight of the vehicle. I was then informed by Deputy Robinson she had been intentionally struck by the fleeing vehicle as she entered the gate to the subdivision. She stated her vehicle was not drivable and believes she had a broken tie rod.
It was later determined the Blue SUV had also struck and damaged the open gate. Cpl. Robinson advised the vehicle went left onto Gates Chapel toward Chatsworth Hwy. Deputy Howard had dispatch ask for an Ellijay unit to stage in the area of Chatsworth Hwy.
Deputy Howard and I continued out Gates Chapel and East on Chatsworth Hwy. Both Pickens and Murray Co. was given the BOLO, blue SUV with damage to both the driver and passenger side. I went back to Cpl. Robinson’s location driving slower this time to see if the vehicle had possibly wrecked off the roadway due to heavy rain.
I called for next list and on-call GSP to work the accident. Just prior to the entrance of Watersong Bluff I stopped to retrieve the glass Patron tequila bottle that had been tossed out of the driver’s window of the blue SUV; bottle was was sitting in the middle of the south bound lane.
Once back out with Cpl. Robinson we returned to the residence to check to see if the female subject had been left at the residence due to neither myself or Cpl. Robinson observing the female in the passenger seat. The female subject was not in the area. During this time East Ellijay Officer Green was giving dispatch information on the blue SUV.
At 0354 hrs Chatsworth P.D. was 10-80 with the blue SUV. I notified them we (Gilmer) have Felony charges.
At 0355 hrs Murray Co. was 10-80 on Hwy 411 heading to Gordon Co.
At 0408 hrs vehicle comes through Fairmount Gordon Co is 10-80 with Murray Co., Chatsworth P.D. following.
At 0409 hrs vehicle crosses into Bartow Co. 0414 hrs vehicle is back on Hwy 411 SB.
At 0415 hrs vehicle stops-taken at gunpoint but 10-80’s on foot. 0417 hrs male subj. taken into custody. Male suspect identified as Marqual Demonne Broadwater.
At this time I was informed the female suspect was detained as well. I spoke to Detective Champion about this case and charging the female.
The female, identified as Cantina Nykiesha Galbreath, will be charged with Criminal Attempt to start and was taken into custody by Murray Co. S.O/Chatsworth P.D.. Due to only having one deputy in service (Howard) we were not able to meet with Murray Co. to take custody of Ms. Galbreath.
Trooper Jones #821 responded to complete the accident report for Cpl. Robinson. I advised Jones since I was taking warrants out for the driver for other charges I would add the traffic offenses as well. Clarks was contacted to tow unit #618 to Kars.
I will be charging Marqual Broadwater with the following:
Aggravated Assault on a Peace Officer
Fleeing and Attempting to Elude
Failure to Maintain Lane
Duty to Stop at the Scene; Hit and Run
Criminal Trespass
Littering
Driving on Suspended License
I will leave Theft by Deception and/or other charges to be brought by Criminal Investigations once the stolen credit cards and other possible criminal activity have been investigated.
On 12/03/2023 the following evening I spoke with Mr. [VICTIM #1] again to gather more information. The stolen credit card belonged to [VICTIM #2] of Canton. Mr. [VICTIM #1] stated [VICTIM #2] had gotten an alert his credit card had beern used to rent the cabin in question without his knowledge or permission. Mr. [VICTIM #2] can be reached at [REDACTED].
Mr. [VICTIM #1] also informed me the false name used as the renter was Jacob Meyer. Mr. [VICTIM #1] stated he has all the corresponding emails and video footage of the suspects. The night of the incident Mr. [VICTIM #1] sent me Ring footage of both subject which I will place with this case file. I verbally gave Mr. [VICTIM #1] this case number for his records.
On 12/04/2023 at approximately 0400 hrs I spoke with Ofc. Greyson Remz with Chatsworth P.D. Ofc. Remz let me know he is the one who would be taking additional charges on both subjects and was on scene when they were taken into custody. He informed me among other charges he was charging Broadwater with DUI. I explained I had recovered the Patron bottle that was thrown from the vehicle at [1600 BLOCK] Gates Chapel; he will add that to his report.
I was also informed that they had acquired a search warrant for the vehicle and recovered large amounts of cash. The night of the incident I had them place a hold on the vehicle, I was informed it was now secured at Cartersville Towing.
