On 10/26/2025 I, Deputy Heptinstall, and Sergeant Robinson #534 responded Code 1 (Non-emergency) to [200 BLOCK] Alpine Ct in reference to an Assault that had occurred to a 14 year old Juvenile who will be referred to as J1.

Upon arrival I met with the J1 and was informed that him and his mother’s boyfriend (Martin Akins) had gotten into a disagreement at the residence of [300 BLOCK] Alpine Ct that resulted in him being thrown to the ground and was placed in a choke hold that restricted his air flow. While speaking to J1, there were visible marks around his neck to indicate that he had been put in some sort of hold.

J1 advised that Martin accused him of drinking his energy drink and that it escalated when Martin had gotten into his face calling him a “Bit*h” and J1 informed Martin that he wasn’t a “bit*h” and informed Martin that he was the one acting like a bit*h. Martin went and retrieved a belt in order to punish J1 and J1 attempted to get away from Martin but Martin grabbed ahold of J1 and both of them fell to the floor with Martin on top of J1 while J1 laid on his stomach.

J1 eventually escaped and fled to [200 BLOCK] Alpine Ct to seek aid from the woman who resided at the address while he waited for his Dads arrival (Legal Guardian who J1 resides with in Dallas, Georgia). J1 then gave directions to the residence he had fled from so that Sergeant Robinson and I could attempt to speak to the other party. J1 informed us that there would be two red trucks in the driveway and upon arrival at [300 BLOCK] Alpine Ct there were no vehicles in the driveway.

While I was walking up to the porch of the residence, I could smell a strong odor of Marijuana coming from inside the residence. I knocked on the door and heard people moving around inside but no one would answer the door. I walked around to the side and heard what sounded like two children panicking in a room I was able to inform them who I was and then they came to the door. (Female Age 10) J2 answered the door and once again a very strong odor of Marijuana was resonating from inside the residence.

J2 informed us that everyone had left after her brother ran away and that her dad was on his way back to the residence. J2 informed us that she could hear J1 and Martin rumbling around in the floor before J1 left the residence in a hurry. I contacted Detective Champion and informed him of the strong odor of Marijuana resonating from the residence and was informed to detain everyone and that he would be applying for a Search Warrant for the Residence.

After I finished speaking with J2, Martin and Daryl Greggory (J2’s mother) arrived at the residence in a red F150 extended cab. When speaking to Martin about the incident that had occurred earlier he provided that same story as J2 just insisted that he didn’t choke him and informed me that his arm was underneath J1’s neck while he was on his back attempting to hold him down. I informed Martin that J1 had a visible injury on his neck to indicate that he had been choked and experienced a “lack of air” that put J1 in fear of passing out.

I informed Martin that he was being placed under arrest for Aggravated Assault (FV) and Cruelty to Children 1st Degree. Daryl Greggory became irate and insisted that J1 did this all the time and that he had done it with her previous boyfriend.

Martin was placed in cuffs double locked and checked for fit then placed in the back of Car #324 for the time being. I then informed Daryl that she was being detained for the time being due to a search warrant being submitted for the residence due to the strong odor of Marijuana. Daryl was placed in the back of Car #1324 until Detective Champion arrived with the search warrant.

Detective Champion arrived on scene with the Search Warrant at 1632 Hours. A search of the Daryl and Martins bedroom produced a zip lock bag of Green Leafy substance, a jar of left over Marijuana’s Cigarettes, and a Kel-Tec .22 Pistol that was inside of a Safe under the Bed. A Gilmer County Sheriff’s Office Inventory of the Items taken was completed and all of the items were turned over to Detective Champion.

J2 was turned over to his dad and left the scene enroute to the Ellijay Piedmont Hospital due to a possible injury to the throat as a result of the incident.

Warrants for Aggravated Assault (FV) and Cruelty to Children were applied for and granted.
