Officer’s Narrative:

On the above date and time, I, Officer Acevedo, responded to Altama Avenue in refrence to a traffic offense.
I looked at my in car computer and saw that a traffic offense was called in on Altama Avenue. The caller stated that the driver was driving reckless and that the vehicle was a blue mercedes. I turned right off of Parkwood Drive. When coming towards to the intersection of Altama Ave and Fourth Street, I observed a vehicle turning right on Altama Ave going northbound. The vehicle turned to the inside lane not going towards the nearest lane. I then conducted a traffic stop on the vehicle turning my lights and audible sirens. The vehicle was a blue mercedes with Florida temporary tag of [REDACTED].
The vehicle came to a complete stop at Altama Ave and Townsend Street. I exited the vehicle and explained to the driver, later identifed as Alvertis Micheal Geddis, the reason for the stop. I then later explained that someone had called about a blue mercedes was driving reckless. While talking to Alvertis, I observed a green large can in the driver door.
I then went to go run the vehicle and driver’s name through GCIC/NCIC, I went back to further investigate the green can. When Alvertis opened the door the green large can was not there. I then asked Alvertis where the green can went. Alvertis then explained that he moved it. I asked Alvertis for the can, to which the can was a Cayman Jacked margarita strawberry extra strength. I then asked Alvertis to step out of his vehicle and step in front of my vehicle.
I then asked Alvertis if he had drank anything today, to which he responded “about 45 minuites ago.” I then had Officer Lovett stand with Alvertis while I ran his name through GCIC/NCIC for warrant checks. I then stepped out. While Alvertis was speaking to me and Officer Lovett, I smelled an fruity odor coming off of Alvertis. I then went back to his car and smelled the Caymen Jacked that was on the trunk of his vehicle. The odor of Alvertis breath and the odor of the Caymen Jacked both smelled the same.
I then asked Officer Lovett if he noticed anything, to which Officer Lovett advised that he smelled juice on his breath. I then have Officer Lovett smell the Caymen Jacked to which Officer Lovett advised they smelled the same. I then advised Alvertis that both myself and Officer Lovett agreed that the smell on his breath and the smell of the can smell the same. I then confirmed with Alvertis that he had been drinking at his Godbrothers house 45 minuites ago.
I then asked Alvertis what kind of alcoholic beverages whas he drinking at his Godbrother, to which he stated “A can and a half.” Alvertis advised that they were smaller cans but that the brand was Caymen Jack. Alvertis then said that his Godbrother had driven him to where his car was near the hospital. Alvertis then said that his wife gave him the keys to the vehicle and told hhim to leave.
I then asked Alvertis if he would take a portable breath test to make sure he was good to drive to which he said yes. Lt. Hurst then arrived with the portable breath test and confirmed with Alvertis that he agreed to a portable breath test to which he said yes. Alvertis did not complete the breath test after multiple attempts. I then asked Alvertis if he would be willing to conduct test’s to make sure he was good to drive, to which he said “yes I can.”
HGN: Horizontal Gaze Nystagmus
Due to Alvertis being taller then me, I had Alvertis sit on the front hood of my patrol vehicle. Alvertis head and spine where aligned. I then had Alvetis put his feet togther and have his hands by his side. I asked Alvertis if he had any problems with his eyes, to which he advised he wasn’t wearing his gasses nor did he have any contact in. I then told Alvertis that he was going to follow the tip of my finger with his eyes and eyes only. I then asked Alvertis if he understood, to which he said yes.
Clues: I then observed Alvertis pupils to be equal in size. I then did two complete passes, both approximately 4 seconds to check for equal tracking. I then did two complete passes, both approximately 4 seconds to check for Lack of Smooth pursuit, to which I observed Nystagmus, the involuntary eye movement of both eyes.
I the did two complete passes to check for Distinct and sustained nystagmus at maximum deviation and held for approximatlly 4 seconds. I observed both eyes to have nystagmus, the involuntary eye movement. I did two complete passes for onset of nystagmus prior to 45 degrees to which I did not observe any clues. I then did two complete passes for vertical nystagmus, to which I did not observe any clues. 4/6 clues.
Walk and turn:
I then moved Alvertis to the parking lot across from the vehicle spot. The parking lot had lights all over. I then told Alvertis to put his feet togther and hands by his side. I then asked Alvertis if he had any medical conditions that are going to prevent, to which he interrupted me and said he had hip surgury and that he “Was straight.” I asked him how long ago to which he said a year or two ago.
I then placed Alvertis in the starting position by telling him to place his right foot in front of his left foot heal to toe. I advised him to stay in that position until I tell him. I then demonstrated the walk and turn and asked him if he understood to which he said yes. I then advised Alvertis that while doing the walk and turn he would have to be looking at his feet while counting outloud the number of steps. I asked Officer Lovett to mark the clues that he observed on my Standardized Field Soberity testing notepad. Officer Lovett is also trained in Standardized Field Soberity.
Clues: While Alvertis conducted the walk and turn, Alvertis stopped while walking, missed heel to toe in his first set of nine steps and in his second set of nine steps. Alvertis also stepped off of line. Alvertis made an improper turn and did an incorrect amount of steps on his second set of nine walking 11 steps. 5/8 clues
One leg stand:
I then advised Alvertis that we were going to do the leg stand. I told Alvertis to stand with your feet togther and arms down by your side. I advised him not to begin until I tell you to. I then asked Alvertis if he understood to which he advised yes. I then said, When I tell you to, raise one leg approximatley six inches off of the ground with your toes pointed out in front of you and count out loud in the following manner. 1001, 1002, 1003, and so forth untill I tell you to stop. I then advised him that at all times, keep both legs straight, arms by your sides, and look at the elevated foot. Alvertis had to be further expplained the instructuions to which at the end he advised he understood. He then started the test and I timed him for 30 seconds.
Clues: I did not observe any clues. 0/4
I then went back to my patrol vehicle and placed Alvertis in handcuffs and double-locked. I then advised Alvertis he was under arrest for driving under the influence. I then serched Alvertis incident to arrest and placed him into the back of my patrol vehicle. I then read implied consent from my Georgia implied consent card DDS-354 (05/2019). The officer’s in-use date: 10/6/2024. Alvertis is 35 years old at the time of the traffic stop, to which I read Implied consent notice for suspects age 21 or over.
I then asked Alvertis if he will submit to the state administered chemical test of your breath, to which he said “Yes I will.” I then tansported Alvertis to 206 Mansfield Street. Upon arrival, I took Alvertis into the police station. I obsevred Alvertis not drink any liquids from 0309 hours to 0351 hours. I also did not hear Alvertis burp, throw up, gag or spit from 0309 to 0351 hours.
I started up the Intoxlyzer 9000 (S/N: 90-000847). I then conducted the breath test on Alvertis. The results indictated that Alvertis Measured BAC (g/210L) was 0.159 (+/-0.007). While at the station, I wrote Alvertis three tickets and filled out DDS-1205. I then transported Alvertis to the Glynn County Detention Center where an arrest and booking was complteted. All of Alvertis property was handed over to the jail staff. Alvertis was transferred over to jail staff for further booking.
Alvertis was charged with DUI per se, Open container and methods turning at an intersection.
