On Monday at approximately 1720 hours I responded to 999997 Norwitch st EXT in reference to a Hit & Run.
Upon arrival, I spoke with [VICTIM #1] who in a silver Toyota Tundra (GA [REDACTED]). The back of the Tundra was damaged. [VICTIM #1] told me that he was traveling southbound on 341 when a vehicle (white Chevy Impala) rear ended him. [VICTIM #1] saw the driver of the Impala exit the vehicle and leave the scene. [VICTIM #1] was not injured. I gave [VICTIM #1] a case card for the accident and allowed him to clear the scene.
I looked through the Chevy Impala which was affixed with the license plate of GA [REDACTED]. I saw multiple documents such as mail, insurance cards, a employee ID card, and a birthday card with the name of Brandon Faircloth on it. The tag GA [REDACTED] came back to a 2005 dodge caravan registered to Brandon Faircloth. I requested the next rotational tow for the vehicle.
I was contacted by Brunswick police Ofc J. Smith 424 who advised me that he was out with a white male adult on fourth st with the name of Brandon. I advised them the name of the suspect is Brandon Faircloth. Ofc Smith placed Brandon under arrest and transported him back to the scene. When Ofc Smith arrived he transferred custody to Ofc Donahue 222. Brandon additionally was wanted out of the Glynn County Sheriffs office for a probation violation (CR1600221063)
Ofc Donahue read Brandon his Miranda advisement. Brandon agreed to speak. Brandon said that he was not driving the vehicle. He said a lady paid him money for the car and he’s been letting her drive it. Brandon did not have a name for the lady. I asked why he was found on fourth st in the pouring rain with no shoes on. Brandon said he was fishing on the FJ Torres Causeway and he got a ride to the city. Brandon requested that I call Star Recovery to take his vehicle. I called service and advised them to notify Star Recovery and they agreed to come.
Brandon was arrested for Hit & Run and Illegally affixing a registration tag to a different vehicle. Ofc Donahue transported Brandon to the hospital for medical clearance and then transported him to the Glynn County Jail for booking.
Star Recovery responded on scene. I spoke to the tow truck driver, [REDACTED] who told me that he sold the Chevy Impala to Brandon approximately four months ago.
When I cleared the scene I saw in the CAD notes that a [VICTIM #2] called requesting to speak to officers about a male she gave a ride to from the scene of the accident. I called [VICTIM #2] who told me that she was traveling west bound on 341 and saw an accident which appeared to have recently happened. She then saw a large heavy set white male approximately 40-50 years old walking barefoot in the center of the road, Brandon Faircloth. [VICTIM #2] slowed down unsure if the man needed help. The man walked to the other side of her car and opened her passenger door and got inside.
[VICTIM #2] was in shock and did not know what to say. She said she was scared of the man and had a 3 month old baby in the back seat, named [REDACTED BY AGENCY]. She said the man was in a frantic state and said “just drive, just drive”. [VICTIM #2] was afraid of what he might do if she put up a fight or pushed back in anyway. [VICTIM #2] said “where are we going”. Brandon gave her directions of where to turn.
She only remembers that Brandon said something about Emmanuel avenue. [VICTIM #2] was afraid that she if called the police while he was in the car with her that he might do something to her or her baby. [VICTIM #2] got to the area where Brandon was trying to go. Before she could come to a complete stop Brandon jumped out of her car and left. [VICTIM #2] then called the police.
OCGA 16-5-40 Kidnapping
(a) A person commits the offense of kidnapping when such person abducts or steals away another person without lawful authority or warrant and holds such other person against his or her will.
(b)
(1) For the offense of kidnapping to occur, slight movement shall be sufficient; provided, however, that any such slight movement of another person which occurs while in the commission of any other offense shall not constitute the offense of kidnapping if such movement is merely incidental to such other offense.
(2) Movement shall not be considered merely incidental to another offense if it:
(A) Conceals or isolates the victim;
(B) Makes the commission of the other offense substantially easier;
(C) Lessens the risk of detection; or
(D) Is for the purpose of avoiding apprehension.
Due to the fact and circumstances of this incident I found probable cause of two additional charges for kidnapping. Brandon and [VICTIM #2] do not know each other. Brandon was not invited into [VICTIM #2]’s vehicle. A reasonable person would not enter a strangers’ vehicle without permission. Brandon gave her orders to drive away in order to lessen risk of detection and avoid apprehension.
[VICTIM #2] felt isolated as she believed there might be retaliation if she reached out to the police while Brandon was in the car with him. Brandon is significantly larger, stronger and older than [VICTIM #2] which factored into her sense of fear and intimidation of Brandon. Brandon is 6’1″ and 290lbs and [VICTIM #2] is 5′ and 165lbs [VICTIM #2] felt at the time the best thing to keep her and her baby safe was to comply with Brandon’s demands.
I spoke to [VICTIM #2] on the phone and was not able to give her a victims rights pamphlet. I will conduct a follow up with [VICTIM #2]. She could not tell me exactly where she dropped Brandon off but told me she could lead me to where she ended up dropping Brandon off at.
