Officer’s Narrative:

On the above date and time I was dispatched to the area of [3200 BLOCK] Cypress Mill Rd (The Cove At Golden Isles Apartment) in reference to a incident of shots fired in the area.
When I arrived at the location I came in contact with one of the tenants of the apartments and she advised me that the shot were somewhere in the vicinity of the rear of the complex. After I was advised of this I made my way to the rear of the apartment complex and began looking out for anything that was out of the ordinary. While searching the area Ofc. Wood advised me that he seen some individuals run towards the area of Cypress Mill Rd.
At that moment I made my way towards Cypress Mill Road, where I saw two individuals one black male and the other a Hispanic female. The black male later identified of as [WITNESS #3]. Cpl. Spaulding and I placed Mr. [WITNESS #3] under an investigative detention until we determine who was at fault during this incident.
I began by introducing myself to Mr. [WITNESS #3] and asked him if he could provided me with his license and he advised me that he did not have it and that it was in the room and that his girlfriend ([REDACTED]) has the key to the room and she know where the license is. With this new information I asked Cpl. Spaulding if she could keep an eyes on Mr. [WITNESS #3], I proceeded to ask [REDACTED] if she could go get the ID, but I was advised by Pfc. Splauding that she did not want [REDACTED] to go inside until the investigation is done.
I asked [REDACTED] what is the information for Mr. [WITNESS #3] and she provided me with his name and date of birth. I also asked [REDACTED] for her information and she was able to provided with to me. I was also able to get the information of two other Hispanic females involved in this incident. I asked [REDACTED] if she could tell me what happened during the incident and she told me that she hear gunshots and that she grabbed her pepper spray and came outside looking for her boyfriend (Mr. [WITNESS #3]), and that she did not know anything more.
After speaking with [REDACTED], I proceeded to speak with Ms. [WITNESS #1]. I proceeded to ask Ms. [WITNESS #1] if she could tell me what happened and she stated that her boyfriend and her were just “pulling up” and she saw a truck and “some fu*king Mexican shot up in the air” and she stated that is all she knows. I proceed to asked if she could described me the truck or what the individual was wearing and she stated that she could not.
After I spoke with Ms. [WITNESS #1], I proceeded to speak with [REDACTED]. I asked [REDACTED] if she could tell me what happened during the incident, I also noticed that [REDACTED] was having what look like a mild panic attack. I advised her that everything is all right and that she is not in trouble and to take deep breath and to exhale slowly.
After advising her of this, I proceeded to ask her if she could tell me what happened during the incident and she advised me that she was by a set of bushes that are located across from their apartment and that she heard gunshots and that she does not know anything more.
After I spoke with [REDACTED], I proceeded to speak with Mr. [WITNESS #3]. While I was heading to speak with Mr. [WITNESS #3], I saw a Hispanic male later identified as Mr. [WITNESS #2]. While I was trying to have Mr. [WITNESS #2] leave the scene, Cpl. Spaulding began speaking with him, so I redirected my attention to Mr. [WITNESS #3].
As I approached Mr. [WITNESS #3] I asked him if he could tell me what happened during the incident and he advised me that his girlfriend ([REDACTED]) came to his room and woke him up and told him that her friend are “wilding” outside. He came outside and saw that there was a commotion going on and that he was trying to stop an individual and he hear gunshots. He advised me that he knows the individual that made the shots and he identified him as Ms. Bryan Espinoza.
Mr. [WITNESS #3] advised me that him and Mr. Espinoza had gone to school together and that he knew the family but had grown apart from them. Mr. [WITNESS #3] also advised me that Mr. Espinoza was driving a Red or Burgundy in color truck, but he did not know the make. He advised me that during the incident he was trying to stop Mr. Espinoza and was telling to “chill”, that is when Mr. Espinoza shot in a diagonal trajectory towards a set of trees that are located in front the apartments. He also advised that when this happened he had to go check on everyone inside the apartment and that his priority change to see that no one was hit by and that he knows how it feels since he was shot while he was a Marine.
After I was done taking the statement from Mr. [WITNESS #3], I proceeded to speak with Mr. [WITNESS #2] I asked Mr. [WITNESS #2] if he could provided me with his information, Mr. [WITNESS #2] provided with his information. Prior to me speaking to Mr. [WITNESS #2] I was advised by Ofc. Wood that Mr. [WITNESS #2] had a picture he would like show me. After getting Mr. [WITNESS #2]’s information I asked him if he could show me said picture. Mr. [WITNESS #2] showed me a profile picture of Mr. Bryan Acero (AKA Bryan Espinoza).
I also asked Mr. [WITNESS #2] if the person in the picture was the person that shot, he advised that it was the person. I also asked him if he could tell me what happened during the incident and he advised me that he was getting out of his car when Mr. Espinoza approached him and pushed him telling him if “he wanted pressure” and he advised Mr. Espinoza that “oh man chill bro, I don’t have any problems with you” Mr. [WITNESS #2] advised me that Mr. Espinoza did not stop and that is when he took his shirt off and told Mr. Espinoza “alright yeah what up”, that is when Mr. Espinoza went to his truck ([WITNESS #2] was not able to give me make of the truck or model but told me it was red) and tried to get his gun but everyone else was trying to stop him. That is when Mr. [WITNESS #2] ran to the apartment and when he was turning the corner to the door of the apartment he her the shots go off, also that he did not see in what direction Mr. Espinoza shot.
After getting Mr. [WITNESS #2] statement, I proceeded to provided Cpl. Spaulding with the information that I was provided with, while advising Cpl. Spaulding, Pfc. Wood advised that Mr. [WITNESS #2] had giving him information that involves Mr. Espinoza on another shooting this time on a house. I proceeded to go ask Mr. [WITNESS #2] of the information I was just given. I asked Mr. [WITNESS #2] if he could tell me what happened. He advised me that a “Buddies” house was just “shot up” about a month before and that the bullets that Mr. Espinoza used were .380 caliber. After taking every ones statement I proceeded to take the handcuff off Mr. [WITNESS #3]. I also provided everyone with a case card and advised them on how to obtain a copy of the report. After that I proceed to pick up 5 .380 caliber bullet shells.
