On October 2nd, 2021 at approximately 0127 hrs, while on patrol, I observed a pewter colored GMC Sierra (Georgia license plate [REDACTED]) failing to maintain the lane of travel while driving North on Highway 341. Shortly after passing Wages Road, I observed this vehicle suddenly swerve to the right and come close to hitting the raised shoulder of the road.

I activated the emergency equipment on my marked patrol vehicle and initiated a traffic stop. The truck pulled into the parking lot of Wendy’s at 4938 New Jesup Hwy, Brunswick and came to a stop. I approached the driver’s side of the vehicle, announced myself as a police officer, then explained to the driver my reason for the traffic stop (failure to maintain lane). I asked the driver, identified as Dusty Wooten, if there was a particular reason he was having difficulty maintaining the lane.

Dusty said there was not a reason. Dusty appeared confused and disoriented when speaking to him. Dusty’s eyes were also red and glassy. Due to these elements, I believed Dusty may be intoxicated and asked an officer experienced in field sobriety to assist with the traffic stop. I spoke to the passenger of the vehicle, [REDACTED] who said he and Dusty had just been at the bar Ziggy Mahoney’s drinking together. [REDACTED] said he was concerned about Dusty’s driving, but did not know what to do as a passenger in the vehicle.

Officer Cummings responded to my location and had Dusty perform a standardized field sobriety test. Based on Dusty’s performance of this test, Dusty was informed he was under arrest and told to put his hands behind his back. Dusty was placed in handcuffs. Due to his large size, Dusty was cuffed using two pairs of handcuffs. Implied consent was read to Dusty who

I escorted Dusty to the rear passenger door of my patrol vehicle and advised Dusty to have a seat. Dusty began to resist by refusing to get into the rear passenger compartment of my patrol vehicle. I advised Dusty to take a seat in the vehicle seven times and Dusty refused. Officer Cummings explained to Dusty he would be charged with obstruction if he would not get into the vehicle. Dusty responded, “that’s fine, I don’t care”. Officer Cummings and Officer Baloo assisted with placing Dusty in the rear of seat the vehicle. Dusty began to tense up and push back against myself and the other officers. Officer Cummings drew his OC spray and told Dusty if he did not get into the vehicle he would be sprayed. Dusty continued to refuse, at which point he was sprayed with OC. Dusty then entered the vehicle and was given water to flush his eyes and face.

Dusty was transported to the Southeast Georgia Healthcare Systems where he was provided with jail clearance paperwork. While at the ER, Dusty said he had changed his mind and consented to providing a breath sample. Dusty was transported to Brunswick Police Department where he provided a breath sample. While waiting to take a breath sample, Dusty was advised of his fourth amendment rights. Dusty said he understood, then continued to talk. Dusty said he had been drinking beer earlier in the night before driving and being stopped.

After taking a breath sample, Dusty was then transported to Glynn County Detention Center where he was booked for the following charges:

  1. DUI 0. C. G. A. 40-6-391,
  2. Obstruction of a Law Enforcement Officer 0. C. G. A. 16-10-24,
  3. Failure to Maintain Lane 0. C. G. A. 40-6-48.

Dusty was released to detention center without incident. My patrol vehicle was searched before and after transport with negative results for weapons or contraband. A warrant for the charge of Obstruction in being pursued at this time. For the charge of DUI, Dusty was released on citation 275043. For the charge of Failure to Maintain Lane, Dusty was released on citation 275044. My Axon body camera was activated during my response and this footage has been uploaded. Nothing further.
