Officer’s Narrative:

On October 4th 2021 at 1654 hrs., I, Officer Nichols was patrolling the area of Chapel Crossing. While patrolling that area, I was using a calibrated Lidar Pro Laser III doing speed detection traveling Westbound. When I noticed a blue vehicle approaching at a high rate of speed. The calibrated Lidar detect that this vehicle was traveling 51 miles per hour in a 35 miles per hour zone. I then got behind this blue vehicle, initiated my emergency to perform a traffic stop. This blue vehicle was a Ford GT Mustang.

I exited my patrol vehicle and approached the driver side window. I introduced myself as Officer Nichols with the Glynn County Police Department and the reason for the stop is your speed. I asked the driver for his drivers license and advised him to remain in the vehicle and I would be right back. I then returned to my vehicle and ran the drivers information into GCIC/NCIC. The driver is identified as Ervin Simmons. He was not wanted and had a valid drivers license. I then wrote a warning citation for his speed and returned back to the Mustang to issue Mr. Simmons his warning citation.

While explaining to Mr. Simmons the dangers of this road and the speed limit, I smelled a strong odor of marijuana coming from the car. I then advised Mr. Simmons that a strong odor of marijuana is coming from the vehicle, do you have any marijuana in the car. He said “honestly officer I do have some weed in the car and it’s in that blue bag.” I thanked Mr. Simmons for being cooperative and advised him that I do have probable cause to search the vehicle but out of respect do you mind if I search you vehicle. He replied “I have no problem with that.”

While I conducted my search, Mr. Simmons was being observed by Officer Correll. I noticed the blue bag that Mr. Simmons informed me that he had marijuana in but I decided to search other places before reaching that blue bag. I lifted up the center console where I found a large bag of marijuana. I then informed Officer Correll to place Mr. Simmons under arrest. I then search the remainder of the vehicle and the blue bag. In the blue bag was a small mason jar with marijuana, scale, and grinder. I then place the narcotics on the hood of my car and read Mr. Simmons his Miranda rights. Mr. Simmons understood his rights.

I asked Mr. Simmons was this for personal use or distributing. He advised me that every time he gets paid he buys enough to last him for a while and he does not sell narcotics. There were no bags of evidence to support that he is distributing and he advised me that the only reason he has a scale so his buyer will not short him his weed. I then transported Mr. Simmons to headquarters so I could get the exact amount of grams that he possessed. The total grams the marijuana weighed was 64.3 grams which is more than an ounce. I then advised Mr. Simmons that he will be charged with felony possession of marijuana.

I then transported Mr. Simmons to the Glynn County Detention Center and filled out an Arresting and Booking Information Sheet. Mr. Simmons custody was then turned over to the Sheriffs Office. The marijuana was placed into evidence for process and the grinder and scale has been placed into evidence for destroying.
