On Sunday January 22, 2023 at approximately 2030 hours, Deputy B.G. POTTER with the Gordon County Sheriff’s Office Uniform Patrol Division responded to [100 BLOCK] County Line Rd Plainville, Gordon County Georgia in reference to an unruly Juvenile that had been physical.

Upon arrival Deputy POTTER spoke with the complainant [WITNESS #1] who stated that her son had gotten caught with a “vaporizer” on this date. [WITNESS #1] stated that her son, Juvenile [VICTIM #1] was already on probation for smoking pot. [WITNESS #1] stated that when she confronted Juvenile [VICTIM #1] about the vaporizer he began to scream and cuss at her.

[WITNESS #1] stated that once she told Juvenile [VICTIM #1] that they were going to have to tell the probation officer about this incident he began to push her. [WITNESS #1] stated that in the process of Juvenile [VICTIM #1] pushing her, his elbow hit her in the side of the face. Deputy POTTER did not observe any marks or redness. Deputy POTTER asked [WITNESS #1] were Juvenile [VICTIM #1] was and she stated that he had left the residence and went to the neighbor’s house.

Deputy POTTER and [WITNESS #1] walked to the neighbor’s house to get Juvenile [VICTIM #1]. Deputy POTTER made contact with Juvenile [VICTIM #1]. Deputy POTTER, [WITNESS #1] and Juvenile [VICTIM #1] walked back to the original residence.

Deputy POTTER asked [WITNESS #1] if he could speak with Juvenile [VICTIM #1] about the incident that took place. [WITNESS #1] stated that he could. Deputy POTTER asked Juvenile [VICTIM #1] what all happened. Juvenile [VICTIM #1] began to cry uncontrollably. Juvenile [VICTIM #1] stated that [WITNESS #1] had got into his face and began yelling and cussing at him. Juvenile [VICTIM #1] stated that they began to argue. Deputy POTTER asked Juvenile [VICTIM #1] what all was said but he could not recall.

Juvenile [VICTIM #1] stated that he was already on probation and he knew he was not supposed to have a vaporizer but chose to have it anyway. Juvenile [VICTIM #1] stated that when [WITNESS #1] boyfriend, KENNETH LEE BURCHFIELD and his sister, Juvenile [WITNESS #2] had gotten home from the grocery store BURCHFIELD came into the residence and choked him out. Deputy POTTER noticed red marks under Juvenile [VICTIM #1]’S chin and neck area. Deputy POTTER also noticed a scratch on Juvenile [VICTIM #1]’S left side check bone area.

Deputy POTTER asked Juvenile [VICTIM #1] if he felt like he could not breathe while BURCHFIELD was choking him. Juvenile [VICTIM #1] stated that he passed out for a few seconds because he could not breathe. Deputy POTTER asked Juvenile [VICTIM #1] how BURCHFIELD choked him. Juvenile [VICTIM #1] stated that he came up behind him and put his right arm under his chin while pulling up with his left arm. Deputy POTTER asked Juvenile [VICTIM #1] if he needed any medical attention. Juvenile [VICTIM #1] stated “I guess”.

Deputy POTTER advised E-911 Dispatch to have Emergency Medical Services en route. Deputy POTTER asked Juvenile [VICTIM #1] if anything else had happened. Juvenile [VICTIM #1] stated that nothing else happened and he went to his neighbor’s house. Juvenile [VICTIM #1] stated that his sister Juvenile [WITNESS #2] had witnessed the incident. Once EMS arrived on scene they advised that he was okay but did sound a little “horse”.

Deputy POTTER asked [WITNESS #1] if he could speak with Juvenile [WITNESS #2]. [WITNESS #1] stated he could. Deputy POTTER asked Juvenile [WITNESS #2] what happened. Juvenile [WITNESS #2] stated that she and BURCHFIELD had gone to the dollar store to get a few household items when her ant called asking what happened. Juvenile [WITNESS #2] stated that once she and BURCHFIELD had gotten back to the residence she heard Juvenile [VICTIM #1] and [WITNESS #1] screaming at each other from outside.

Juvenile [WITNESS #2] and BURCHFIELD entered the residence when [WITNESS #1] stated “that they need to call someone to come pick Juvenile [VICTIM #1] up because he wasn’t staying here.” Juvenile [WITNESS #2] stated that they continued to argue and scream at each other. Juvenile [WITNESS #2] said that she saw [WITNESS #1] push Juvenile [VICTIM #1]. Juvenile [WITNESS #2] stated that Juvenile [VICTIM #1] did not push back but that he did “buck up” at her. Juvenile [WITNESS #2] stated that BURCHFIELD grabbed Juvenile [VICTIM #1] by the throat with one hand and pushed him to the ground.

Juvenile [WITNESS #2] stated that she and [WITNESS #1] pulled BURCHFIELD off of Juvenile [VICTIM #1]. Juvenile [WITNESS #2] stated that once Juvenile [VICTIM #1] got up he stated to BURCHFIELD “that’s assault; you can’t do that to me.” Juvenile [WITNESS #2] stated that BURCHFIELD said to Juvenile [VICTIM #1] “I’ll show you assault.” Juvenile [WITNESS #2] stated that is when BURCHFIELD went behind Juvenile [VICTIM #1] and put him in a “choke hold”.

Deputy POTTER then spoke with BURCHFIELD who stated that when he and Juvenile [WITNESS #2] had gotten back from the store he heard Juvenile [VICTIM #1] and [WITNESS #1] screaming at each other. BURCHIELD stated that he told Juvenile [VICTIM #1] he was going to have to find somewhere to go because he was not going to be disrespected in his house. BURCHIELD stated Juvenile [VICTIM #1] and [WITNESS #1] began to argue some more. BURCHIELD stated that he couldn’t take any more of Juvenile [VICTIM #1] cussing at [WITNESS #1] anymore.

BURCHIELD stated that he walked into the bedroom and saw Juvenile [VICTIM #1] push [WITNESS #1] and that is when he put Juvenile [VICTIM #1] into a “rear naked choke hold” in order to restrain him. BURCHIELD stated that Juvenile [WITNESS #2] and [WITNESS #1] told him to let Juvenile [VICTIM #1] go so he did. BURCHIELD stated he only had Juvenile [VICTIM #1] in the hold for a few seconds. BURCHIELD stated that he did not slam Juvenile [VICTIM #1] and did not push him into the wall.

Deputy POTTER placed BURCHFIELD under arrest for Cruelty to Children in the First and Third Degree, Aggravated Assault and Battery FVA. Deputy POTTER then transported BURCHFIELD to the Gordon County Jail without incident.

Deputy POTTER notified the proper chain of command of this incident. Deputy POTTER took photographs of Juvenile [VICTIM #1]’S visible scratches and marks and uploaded them to the Gordon County Sheriff’s Office Database.

Deputy POTTER took out state warrants on BURCHFIELD for Cruelty to Children in the First and Third Degree and Aggravated Assault. Deputy POTTER filled out a DFACS referral form and a Form-90.
