On 12/10/2025 at approximately 2105 hours, I, Officer Pruitt, was dispatched to a traffic accident in the area of E Hwy 53 & E Belmont Dr. Dispatch advised that the accident occurred near the Subway, that no injuries were reported, and that one of the vehicles involved was a Chevy truck.
While in route, Dispatch continued to provide updates relating to the accident. Dispatch informed me that they had received an auto crash detection alert phone call. Dispatch informed me that they could hear a male subject stating things such as “I’ll go to jail for DUI,” as well as “I got to get out.” Dispatch would later inform me that the phone number they received the crash notification call from was listed as “[REDACTED BY AGENCY].” Dispatch would further inform me that the vehicles would be pulling into a Chevron station.
I arrived in the area of the accident at approximately 2107 hours. Upon arrival in the area, I asked Dispatch about what Chevron the drivers had pulled into. Dispatch informed me that the vehicles had possibly pulled into the Citgo located at the intersection of Hwy 41 and Hwy 53.
I asked Dispatch if they knew what vehicle the crash detection was alerting on. Dispatch then informed me that they were unfamiliar and that they could also hear a female’s voice that was attempting to tell a male not to do that, that’s bad. Dispatch informed me that the vehicle was pulled into the Citgo.
I did observe a black in color Chevrolet Silverado that was in the parking lot of Citgo. I parked my patrol vehicle and made contact with the driver, who was later identified as [REDACTED BY AGENCY]. The license plate to the Chevrolet Silverado was displayed as “[REDACTED BY AGENCY],” through Georgia.
In making contact with [REDACTED BY AGENCY], I asked him who all was involved in the wreck. [REDACTED BY AGENCY] informed me that he was involved. [REDACTED BY AGENCY] then pointed at the intersection located at E Hwy 53 and E Belmont Dr. [REDACTED BY AGENCY] explained that you could see the other vehicle, and that the other vehicle was still in the turning lane (On E Hwy 53).
[REDACTED BY AGENCY] informed me that the other vehicle hit [REDACTED BY AGENCY] vehicle in the turning lane on E Hwy 53. [REDACTED BY AGENCY] informed me that the other driver told [REDACTED BY AGENCY] to pull over. [REDACTED BY AGENCY] informed me that he and the other vehicle were traveling Westbound on E Hwy 53.
[REDACTED BY AGENCY] informed me that they ([REDACTED BY AGENCY] and the other driver) had stopped at the red light, at which point the other driver’s vehicle struck the left side rear end area of [REDACTED BY AGENCY] Chevrolet Silverado. I asked [REDACTED BY AGENCY] if he was hurt at all. [REDACTED BY AGENCY] stated that he was not hurt.
I asked [REDACTED BY AGENCY] about what kind of vehicle the other driver was in. [REDACTED BY AGENCY] described the other vehicle as a black older vehicle. I informed Officer Chandler that I was out with vehicle 2 at the Citgo and that the other vehicle was on Hwy 53 by the Verizon store. I requested that [REDACTED BY AGENCY] hang out for me and that I was going to go make contact with the other party.
I then drove over to Officer Chandler who was parked behind the other vehicle that was involved in the wreck. The other vehicle was observed to bear Tennessee license plate number “[REDACTED BY AGENCY].” Officer Chandler ran the license plate number through Dispatch. Dispatch informed Officer Chandler that the vehicle was a 2007 Mercedes black in color, belonging to a Kenneth Davis. Dispatch advised that insurance was confirmed, with valid registration and no stolen entries reported. Officer Chandler requested that on call wrecker be in route to the scene.
Officer Chandler and I approached the black Mercedes E350, at which point we discovered that the vehicle was unoccupied and the driver had fled the scene. The Mercedes was observed to be parked in the inside Westbound travel lane of E Hwy 53 at the intersection of E Belmont Dr. The left side tires of the Mercedes were positioned over the white line that separates the inside Westbound travel lane of E Hwy 53 from the left-hand turning lane that leads onto Hwy 41 S.
I observed a large pool of vehicle fluids underneath the Mercedes. The driver’s steering wheel airbag was deployed and the right side of the front end of the Mercedes had extensive disabling damage. I also observed what was determined to be the spare tire of [REDACTED BY AGENCY] Chevrolet Silverado, which was laying on its side in the inside Westbound travel lane of E Hwy 53, near the right-side front-end area of the Mercedes E350. Dispatch informed me that Cherokee Salvage was in route to the scene. I took numerous photographs of both vehicles that were involved in the accident. All photos taken will be attached to this incident report.
While examining the vehicle, I observed a prescription drug bottle that was laying on the road behind the Mercedes E350. I observed the pill bottle to have a label affixed to it. The pill bottle was prescribed to “Kenneth W Davis,” of [REDACTED BY AGENCY] Dr, Calhoun, Ga 30701. The prescription was listed as “DIAZEPAM 10MG TABLETS.” The pill bottle was listed as being from Walgreens located at 1101 Red Bud Rd NE, Calhoun, Ga.
Officer Gilbreath arrived at the Citgo station where [REDACTED BY AGENCY] was standing by. I requested that Officer Gilbreath meet with [REDACTED BY AGENCY] to get a statement and to get [REDACTED BY AGENCY] information. Dispatch then informed me that they did have a number for the crash detection for the male subject (driver of the Mercedes). Dispatch informed me that the number was “[REDACTED BY AGENCY].”
I further requested that Officer Gilbreath get a personal description of the suspect from [REDACTED BY AGENCY]. Dispatch would then inform me that a possible description on the subject was the subject wearing a quarter zip blue jacket, and that he was a white male.
I called [REDACTED BY AGENCY], which was later confirmed to be Kenneth Wayne Davis’s phone number. No one answered the phone, at which point Kenneth’s voicemail message played. The voicemail message stated “Hello, you’ve reached the voicemail of Ken Davis, please leave your name, your phone number, and a brief message and I’ll call you back.”
I then left a message that stated “Ken, this is Officer Pruitt with the Calhoun Police Department. I think you know why I’m calling you; you got involved in an accident and I need to speak with you about it. You fled the scene, so call [REDACTED BY AGENCY] or call if you’re in Calhoun, call 911 and let them know to speak with Officer Pruitt to meet with me about this accident you were involved in. I strongly suggest you do reach out to me, call me back.”
Officer Chandler and I then performed an inventory search of Kenneth’s Mercedes E350. Officer Gilbreath would then explain that per [REDACTED BY AGENCY] the male suspect driver was slurring his words, and that [REDACTED BY AGENCY] believed the suspect driver was wearing a pair of slacks with a blue quarter zip jacket on, that the suspect male driver was a white male, possibly 6’2″, with no hat. Officer Chandler informed me that during the inventory search, he found a couple medications that said, “Kenneth W Davis.”
I spoke with Lt. Ulibarri on the phone, where he informed me that ABC Liquor had a camera that would’ve captured the crash, but that the person working presently didn’t have access to the playback. Officer Chandler informed me that one of the pill bottles he found was in the center console. I believe this was the bottle I found on the ground behind the Mercedes. Officer Chandler further informed me that more Diazepam was located inside of a suitcase in the trunk of the Mercedes. I photographed both the bottles of Diazepam, both of which were prescribed to Kenneth W Davis.
I sent Lt. Ulibarri the photo of Kenneth that was attached to his driver’s license return on GCIC. I asked Officer Chandler if he could smell alcohol in the vehicle. Officer Chandler could not smell alcohol, only the airbag, which had deployed in the steering wheel. Officer Chandler and I completed the vehicle tow-in and impound record form, where I listed all items of value that I observed. I did not locate Kenneth’s phone inside the Mercedes.
Officer Gilbreath and [REDACTED BY AGENCY] drove over to Officer Chandler and me, so [REDACTED BY AGENCY] could retrieve his spare tire and so I could show [REDACTED BY AGENCY] the picture of Kenneth to see if [REDACTED BY AGENCY] could identify Kenneth as the driver of the Mercedes. I showed [REDACTED BY AGENCY] Kenneth’s driver’s license photo, at which point I asked [REDACTED BY AGENCY] “Is that him?” [REDACTED BY AGENCY] stated “Yes.” I asked [REDACTED BY AGENCY] how certain he was on a scale of 0 to 100. [REDACTED BY AGENCY] stated, “I would say about 9.. uh about 85 percent sure.”
While speaking with [REDACTED BY AGENCY], an elderly white male approached us on the roadway. I asked the elderly white male who he was. The elderly white male informed me that he was [REDACTED BY AGENCY]. [REDACTED BY AGENCY] informed me that he got a call that his nephew had an accident. [REDACTED BY AGENCY] asked me who was driving that car, referring to Kenneth’s Mercedes.
I asked [REDACTED BY AGENCY] who his nephew was, to which [REDACTED BY AGENCY] stated “Ken Davis.” I informed [REDACTED BY AGENCY] that whoever it was took off on foot. I asked [REDACTED BY AGENCY] who he got a call from. [REDACTED BY AGENCY] informed me that his ([REDACTED BY AGENCY]) wife called him, and that his ([REDACTED BY AGENCY]) wife was in the hospital.
[REDACTED BY AGENCY] informed me that Kenneth’s son lives in Wyoming. [REDACTED BY AGENCY] informed me that Kenneth’s son got a text on his (Kenneth’s son) phone that his dad (Kenneth) was in an accident. [REDACTED BY AGENCY] informed me that it said that the crash was at Kroger.
Officer Gilbreath and I asked [REDACTED BY AGENCY] if he knew where Ken was. [REDACTED BY AGENCY] informed us that that’s the reason he ([REDACTED BY AGENCY]) came out to the scene, so [REDACTED BY AGENCY] could see if he could find Kenneth. [REDACTED BY AGENCY] confirmed that he was Kenneth’s uncle.
Prior to allowing [REDACTED BY AGENCY] leave the scene, I had [REDACTED BY AGENCY] explain to me what happened with the accident. [REDACTED BY AGENCY] confirmed that he was traveling Westbound on E Hwy 53 in the inside Westbound travel lane. [REDACTED BY AGENCY] informed me that he himself had just got out of Little Ceasar’s, and that [REDACTED] was traveling Westbound on E Hwy 53.
I asked [REDACTED BY AGENCY] what color the traffic light was, to which [REDACTED BY AGENCY] informed me that he believed it was green. [REDACTED BY AGENCY] informed me that he just heard a boom, at which point [REDACTED BY AGENCY] pulled over kind of into the turning lane, at which point [REDACTED BY AGENCY] stopped. [REDACTED BY AGENCY] informed me that the other driver exited the Mercedes.
[REDACTED BY AGENCY] confirmed that his Silverado was moving when the Mercedes struck his Chevrolet Silverado. [REDACTED BY AGENCY] confirmed that the Mercedes was behind his Silverado in traffic and that the Mercedes struck [REDACTED BY AGENCY] pickup truck out of nowhere.
[REDACTED BY AGENCY] explained that after the accident occurred, they both pulled over. [REDACTED BY AGENCY] inormed me that the other driver walked up and came to [REDACTED BY AGENCY]’s window. [REDACTED BY AGENCY] informed me that the other driver asked [REDACTED BY AGENCY] if he [REDACTED BY AGENCY] wanted to pull over was pointing toward the direction of S Wall St while explaining this) they would exchange insurance.
[REDACTED BY AGENCY] informed me that he asked the driver where (to pull over) a couple of times, but the other driver never answered him. [REDACTED BY AGENCY] informed me that he told the other driver that he [REDACTED BY AGENCY] was pulling over to the Chevron (Citgo). [REDACTED BY AGENCY] informed me that the driver of the Mercedes didn’t say anything, and that the driver of the Mercedes just walked back to the Mercedes. I confirmed with [REDACTED BY AGENCY] that after [REDACTED BY AGENCY] proceeded to the Chevron (Citgo), [REDACTED BY AGENCY] had no idea where the driver of the Mercedes went after that point.
Upon completing the inventory sheet, I had the tow truck driver sign the form, at which point I provided the tow truck driver with his copy of the inventory sheet. The inventory sheet will be scanned and attached to this incident report. Cherokee Salvage subsequently towed the Mercedes from the scene.
At approximately 2255 hours, Officer Gilbreath and I were dispatched to [REDACTED BY AGENCY] Holly Dr. to meet with Kenneth Davis about filing a stolen vehicle report. Dispatch informed me that per Kenneth, Kenneth stated that he was warming up his car around 45 minutes prior. Officer Gilbreath and I arrived on scene at approximately 2312 hours.
Upon arrival I knocked on the door that was located in the garage of the residence. Kenneth’s adult daughter whom I did not get the name of, came to the door. Kenneth’s daughter granted me consent to enter the residence. Upon entry, Officer Gilbreath and I were informed by Kenneth’s daughter that Kenneth was inside his office located at the end of the hallway. I knocked on the door to the office, at which point Kenneth asked me to come in.
In meeting with Kenneth, I asked him about what happened. Kenneth informed me that he had left his car running in the driveway while he (Kenneth) was taking a shower. Kenneth informed me that after his shower, he came back outside and discovered that his car was gone. I asked Kenneth about what time he noticed his car was gone. Kenneth informed me that it was about 10 o’clock (PM).
I asked Kenneth about his vehicle. Kenneth informed that his vehicle is a black 2007 Mercedes E350. Kenneth informed me that he thinks that he had a couple of credit cards in his Mercedes, which Kenneth informed me that he was skeptical about that. Kenneth informed me that he didn’t think that he had a gun in the Mercedes (that he’s alleging was stolen).
I asked Kenneth what his phone number was. Kenneth stated “[REDACTED BY AGENCY].” Kenneth informed me that he didn’t have his phone, that it was in the car (the 2007 Mercedes E350). While speaking with Kenneth, he did inform me that the phone he currently had with him was his daughter’s phone.
I asked Kenneth if he would fill out a witness statement form about what happened, Kenneth did subsequently fill out a witness statement form. Officer Gilbreath and I were curious as to whether Kenneth had contacted 911 to report the vehicle stolen from the same phone number that had made the crash detection alert phone call from the scene of the accident.
I contacted Dispatch and asked them for the phone number that was used to call us out to [REDACTED BY AGENCY] Holly Dr. Dispatch informed me that the number Kenneth had called from at Holly Dr. was “[REDACTED BY AGENCY].” Kenneth confirmed that the aforementioned phone number was his daughter [REDACTED]’s.
Kenneth provided me with his handwritten witness statement form. On the form, Kenneth wrote “I was warming up car, taking a shower & looked out & car was gone. Had the car running to warm up. Bags, computer, packed including credit cards. looked but car was gone.”
Officer Gilbreath asked Kenneth where they were headed. Kenneth informed Officer Gilbreath that they were headed out to Nashville, and that’s why they had their clothes packed in the back. Kenneth confirmed that his phone was in the Mercedes on the charger.
I informed Kenneth that I saw that they (Kenneth and [REDACTED BY AGENCY]) had a ring doorbell camera on the front of the house. Kenneth informed me that he did have the camera, but he didn’t have it hooked up. I then walked out of the garage to see if the camera was functional. As I approached the ring doorbell camera, I did see glowing red lights which made me believe that the camera was functional. I pressed the doorbell camera button, at which point the doorbell chime was audible and the button turned blue.
I informed Kenneth that the camera was hooked up and I requested to see if they (Kenneth and [REDACTED BY AGENCY]) could pull up the footage. Kenneth informed me that he didn’t have his phone, so he didn’t know how to pull it up (the footage). Kenneth and [REDACTED BY AGENCY] talked about the footage, and they both came to the conclusion that they could not access the footage. I checked the neighbor’s house across the street from Holly Dr., but I did not locate any cameras.
I re-entered the residence after getting permission from Kenneth. I provided Kenneth with my business card which included the case number to this incident report. I informed Kenneth that earlier tonight, about 9:05, we had gotten a call about an accident on Hwy 53 by the Verizon store. I informed Kenneth that somebody that was driving Kenneth’s vehicle had hit the back of someone’s pickup truck. I informed Kenneth that the person had gotten out and told the driver [REDACTED BY AGENCY] “lets pull over there and exchange insurance information.” I informed Kenneth that the driver [REDACTED BY AGENCY] pulled into the Citgo gas station across the street from Kroger.
I then informed Kenneth that the person that was driving Kenneth’s car left the area and ditched the car with it sitting in the road. Kenneth asked me where his car was at now, to which I informed him that it was at Cherokee Salvage. I provided Kenneth with a piece of paper that had the information for Cherokee Salvage listed on it. Kenneth asked me what he needed to do. Kenneth asked me if the car was okay, I informed him that it was totaled.
I informed Kenneth that when I showed the driver [REDACTED BY AGENCY] the picture of Kenneth since Kenneth was the registered owner of the Mercedes, the driver [REDACTED BY AGENCY] told me that he was very certain it was Kenneth that was driving the car (Mercedes).
I informed Kenneth that I wanted to afford him the opportunity to be honest with me if Kenneth was driving the car. Kenneth then stated, “No I wasn’t driving that car.” I then asked Kenneth where he had been at today, just here? Kenneth informed me that he had just been at home.
I then informed Kenneth that there were cameras all over that area, and that we would be looking into all of the different perspectives. I asked Kenneth if I was going to find out that he (Kenneth) was driving that car. Kenneth then stated, “No.” I explained to Kenneth that if he wasn’t driving and his car was legitimately stolen, then he had nothing to worry about as far as criminal charges.
I informed Kenneth that if I found out otherwise, I would be taking warrants for his arrest. Kenneth then stated, “That’s fine.” Officer Gilbreath told Kenneth that hopefully we can catch whoever took it. Kenneth then stated “I’m sorry I won’t do it.. I won’t crank it up and leave it no more.”
Upon concluding speaking with Kenneth, Officer Gilbreath and I then returned to service.
On 12/11/2025 at approximately 1750 hours, I went to the businesses located near E Belmont Dr. which were the Verizon store, Goodyear, and Subway. I first checked with Verizon but in speaking with an employee I confirmed that there were no exterior surveillance cameras on the Verizon building.
I then went to the Goodyear store located at 220 GA-53 Spur. I located a surveillance camera on the front of the building that faced toward the area of the accident. I entered the store and spoke with staff about the cameras. The staff confirmed that the cameras worked.
An employee and I entered the rear office where I was then shown the surveillance footage. On the footage, shortly after approximately 2100 hours, I did observe the crash. The Mercedes did strike the Chevrolet Silverado on the rear-end-area. A short time later, [REDACTED BY AGENCY] pickup truck was observed to travel further down the road, which was when [REDACTED BY AGENCY] was pulling over to the Citgo station.
On the footage I observed what appeared to be two subjects that walked away from the Mercedes and then proceeded to walk Northeast on E Belmont Dr. The two subjects walked out of frame of the surveillance footage, but they were walking toward the direction of the Subway that was located at 200 GA-53 Spur.
I left my business card with the Goodyear employee that showed me the footage, I further requested that they send the surveillance footage to my work email address. I then left the Goodyear store and walked over to Subway.
I spoke with two Subway employees about accessing the surveillance footage. The female Subway employee attempted to pull up the surveillance footage but was unable to do so due to a lack of access. A female manager spoke with the female employee on the phone and informed me that they would be able to access the footage on 12/12/2025 in the morning once the manager arrives between 7-8. I then left the Subway.
Calhoun PD will be following up with Subway to review footage.
